PRESIDENTIAL DECREE OF THE REPUBLIC OF BELARUS

of March 9, 2011 No. 98

About approval of the Disciplinary charter of customs authorities of the Republic of Belarus

(as amended on 28-02-2022)

For the purpose of increase in efficiency of activities of customs authorities I decide:

1. Approve the Disciplinary charter of customs authorities of the Republic of Belarus it (is applied).

2. Recognize invalid:

Item 1 of the Presidential decree of the Republic of Belarus of September 10, 2007 No. 425 "About introduction of amendments, changes and recognition voided some regulatory legal acts of the President of the Republic of Belarus concerning customs regulation" (The national register of legal acts of the Republic of Belarus, 2007, No. 224, 1/8894).

3. To Council of Ministers of the Republic of Belarus to take measures for implementation of this Decree.

4. This Decree becomes effective in three months after its official publication, except for Item 3 and this Item which are becoming effective from the date of signing of this Decree.

Disciplinary charter of customs authorities of the Republic of Belarus

Chapter 1. General provisions

1. Are determined by this Charter content of office discipline in the State Customs Committee (further – the State Customs Committee), the customs, public institutions created for ensuring accomplishment of the functions assigned to customs authorities (further, unless otherwise specified, – customs authorities), the rights and obligations of chiefs by its maintenance, types and procedure for application of encouragement and authority punishments, and also procedure for appeal of decisions on application of authority punishments.

2. Operation of this Charter extends to officials of customs authorities, and also the citizens for the first time employed in customs authorities before assignment of personal rank by it (further – officials).

3. Office discipline - strict and exact execution by officials of the service duties established by this Charter, other acts of the legislation, the job description, orders of chiefs, and also conditions of the contracts (employment contracts) signed with them.

4. Violation of office discipline (minor offense) illegal, guilty non-execution or improper execution by the official of the service duties established by this Charter, other acts of the legislation, the job description, orders of chiefs, and also conditions of the contract (employment contract) signed with it.

5. The office discipline is provided:

5.1. the personal liability of each official for execution of the service duties;

5.2. strict observance by officials of the legislation, job description, employment policies and procedures, requirements for labor protection, operating procedure with office information, rules of wearing uniform and signs of distinction;

5.3. daily insistence of chiefs to subordinates, respect of their personal advantage, skillful and correct application for subordinates of encouragement and authority punishments;

5.4. maintenance by each official of the skill level necessary for execution of the service duties;

5.5. forming at officials of necessary business and personal qualities.

6. On the official position officials can be chiefs and subordinates.

Chiefs to whom the official is subordinated on service at least temporarily are direct chiefs.

The direct chief, closest to the subordinate, is immediate superior.

On the official position chiefs are:

The chairman of the State Customs Committee – for all officials of customs authorities;

the First Deputy Chairman of the State Customs Committee – for vice-chairmen of the State Customs Committee, and also for all subordinate officials of customs authorities;

the vice-chairman of the State Customs Committee – for all subordinate officials of customs authorities;

chiefs of head department, management, management as a part of head department, department (as management) the State Customs Committee – for all officials headed by them according to head department, management, management as a part of head department, department (as management) the State Customs Committee, and also for all officials of customs, the public institution created for ensuring accomplishment of the functions assigned to customs authorities (further – organization);

deputy chiefs of head department, management, management as a part of head department, department (as management) the State Customs Committee – for all subordinate officials according to head department, management, management as a part of head department, department (as management) the State Customs Committee, officials of customs (from the deputy chief of customs below), organizations (from the deputy manager below);

the chief and the assistant department head, the chief of the sector as a part of head department, management of the State Customs Committee – for all subordinate officials of department, the sector as a part of head department, management of the State Customs Committee;

the chief of customs – for all officials of customs;

the first deputy, the deputy chief of customs – for all subordinate officials of customs;

chiefs of customs post, department, the customs sector – for all officials of the customs post headed by them, department, the customs sector;

deputy chiefs of customs post, department of customs – for all subordinate officials of customs post, department of customs;
the chief and the assistant department head of customs post of customs – for all subordinate officials of department of customs post;

the head of organization – for all officials of organization.

The officials who are not subordinated each other on service can be senior or younger. The seniority is determined by post, and in case of equal positions – personal ranks. Seniors on personal rank shall require from younger respect for office discipline, rules of carrying the established dress code.

7. The order - the written or oral order of the chief made within its powers obligatory for execution by subordinates.

The order shall be executed precisely and at the scheduled time with submission of the report on its execution to the chief who gave the order.

The subordinate receives the order, as a rule, from the immediate superior. If the order is received from the higher chief, the subordinate shall perform it, having informed on it the immediate superior.

Has the right to repeal the order the chief who gave it or the higher chief.

The chief bears the personal responsibility for legality of the given orders.

8. The official in case of doubt in legitimacy of the order received by it for execution shall report without delay about it in writing to the immediate superior (the chief who gave the order), and also has the right to address the higher chief.

If the immediate superior (the chief who gave the order) or the higher chief in writing confirms this order, the official shall perform it, except as specified, when execution of the order contains signs administratively or penal act.
