About fishery and preserving water biological resources
This Law determines legal, economic and organizational basis of activities in the field of fishery and preserving water biological resources.
In this Law the following basic concepts are used:
water biological resources (further - water bioresources) - the fish, water invertebrates, water mammals, seaweed, other water animals and plants which are in condition of natural freedom;
anadromous species of fish - the species of fish which are reproduced in fresh water, making then migration in the sea for nagul and returning for spawning to places of the reproduction;
preserving water bioresources - maintenance of water bioresources or their recovery to levels in case of which the maximum steady production (catch) of water bioresources and preserving their biological diversity by means of implementation on the basis of scientific these measures for studying, protection, reproduction, rational use of water bioresources and protection of the circle of their dwelling can be provided;
production (catch) of water bioresources - withdrawal of water bioresources from the circle of their dwelling;
fishery - activities for production (catch) of water bioresources in water objects of fishery value;
trade fishery - activities for production (catch) of water bioresources with use of special means on acceptance, conversion, overload, transportation and storage of catch and products of conversion of water bioresources;
inshore fishing - the fishery performed in coastal part of the territory of Turkmenistan which purpose is production (catch) and delivery of catch of the fresh or cooled water bioresources for conversion and/or realization;
amateur fishery - fishery which purpose is production (catch) of water bioresources for the purpose of private consumption;
sports fishery - fishery which purpose is production (catch) of water bioresources when holding sporting events;
conservation coastal zone - the coastal territory of water object in which the limited mode of economic activity is set and which is used for the purpose of preserving water bioresources;
general admissible catch of water bioresources - evidence-based sizes of annual production (catch) of specific types of water bioresources in water objects of fishery value;
quota of production (catch) of water bioresources - part of general admissible catch of water bioresources;
permission to production (catch) of water bioresources - the document certifying the right to production (catch) of certain amount of water bioresources;
fishery vessels - the vessels used for fishery implementation, including court for acceptance, conversion, overload, transportation, storage of catch of water bioresources and products of their conversion;
auxiliary vessels - the specialized freighters accompanying fishery vessels and used for their supply with fuel, water, food, container and other materials. As auxiliary vessels also fishery vessels can be used;
fish breeding - system of the biological, biotechnical, technological and organizational actions directed to increase and reproduction of water bioresources;
aquaculture - activities of fish nurseries and fish farms for cultivation, acclimatization and cultivation of fish; to production of juveniles of oysters, mussels, spiny lobsters, shrimps and fish juveniles; to cultivation of seaweed and other edible sea plants for the commercial and economic purposes;
water objects of fishery value - sea waters, waterways and reservoirs of natural or artificial origin which create nutritious base of water bioresources and are used or can be used for reproduction of their inventories;
adnexal waters - streams, hollow, the channels, collector and drainage systems and other sources of water balance creating food supply of water bioresources and important for reproduction of inventories of water bioresources;
the sites determined for fishery - the water spaces of water objects of fishery value intended for fishery types or the sites consisting of their part and coastal strip of land;
the fishery conservation zone - the territory which adjoins to the water area of water object of fishery value and in which the specific mode of implementation of economic and other activity is set;
fishery reserved zone - water object of fishery value or its part with the territory adjoining to it in which the specific mode of economic and other activity for the purpose of preserving water bioresources and creation of conditions for development of fish breeding is set;
