About some measures for enhancement of state regulation in the field of compensation

For the purpose of expansion of the rights of employers on establishment of flexible payment terms of work of the workers who are most considering effectiveness of contribution of each worker and financial opportunities of subjects of business activity I decide:

1. The Item is excluded according to the Presidential decree of the Republic of Belarus of 18.10.2019 No. 386

2. Determine that:

2.1. the commercial organizations and individual entrepreneurs in case of introduction of new payment terms of work of workers shall provide:

non-admission of decrease in the sizes of the salary of workers at the time of their introduction;

establishment of the flexible payment terms of work directed to strengthening of material interest of workers in performance improvement of work and which are most considering complexity of the performed works, skill level, efficiency, quality and working conditions, and also contribution of each worker to general results of activities, his enterprise, creative approach;

observance for workers of guarantees in the field of compensation, stipulated by the legislation about work;

2.2. the tariff charges (tariff salaries) of employees of the commercial organizations raise employers depending on efficiency of managing and within the available financial opportunities if other is not established by the President of the Republic of Belarus;

2.3. total amount of the funds allocated for payment of awards for production results and allowances of all types paid to employees of the organizations included in the State register of subjects of natural monopolies belongs on product cost, goods (works, services) and joins in the costs considered in case of the taxation and pricing within the standard rate – 80 percent of the wages amount estimated on price-work quotations, and also the tariff charges (tariff salaries) and official pay rates taking into account increases, stipulated by the legislation for actually worked time in the accounting period on the organization in general if other is not established by the President of the Republic of Belarus;

2.4. the procedure for use of the funds allocated for payment of awards for production results and allowances of all types within the standard rate established in subitem 2.3 of this Item is determined by the employer based on the collective agreement, the agreement, other local regulatory legal act accepted according to the legislation.

3. In subitem 1.2 of Item 1 of the Presidential decree of the Republic of Belarus of May 15, 2008 No. 271 "About some questions of regulation of activities of banks" (2008, No. 120, 1/9702) of the word "based on the Single scale of charges of workers of the Republic of Belarus and other regulatory legal acts" shall be replaced with words the national register of legal acts of the Republic of Belarus "according to the legislation".

The decree of the President of the Republic of Belarus of July 18, 2002 No. 17 "About some questions of regulation of compensation of workers" (The national register of legal acts of the Republic of Belarus, 2002, No. 83, 1/3879);

The decree of the President of the Republic of Belarus of January 23, 2009 No. 2 "About stimulation of employees of the organizations of industries of economy" (The national register of legal acts of the Republic of Belarus, 2009, No. 27, 1/10424).

5. In three-months time to provide to Council of Ministers of the Republic of Belarus reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

6. This Decree becomes effective from the first following after month of its official publication, except for Item 5 and this Item which are becoming effective from the date of signing of this Decree.
