ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan

According to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of use of airspace of the Republic of Kazakhstan.

2. Suspend Item 8 of Rules of use of airspace of the Republic of Kazakhstan till November 17, 2011, having determined that during suspension this Item is effective in the following edition:

"8. Vertical separation in airspace of the Republic of Kazakhstan is performed on the following semi-circular system:

1) in case of the direction of airways, local airlines and the established routes with true track angles from 0 to 179 degrees echelons of flights (inclusive) are established: 900, 1500, 2100, 2700, 3300, 3900, 4500, 5100, 5700, 6300, 6900, 7500, 8100, 9100, 10100, 11100, 12100, 14100 (meters);

2) in case of the direction of airways, local airlines and the established routes with true track angles from 180 to 359 degrees echelons of flights (inclusive) are established: 1200, 1800, 2400, 3000, 3600, 4200, 4800, 5400, 6000, 6600, 7200, 7800, 8600, 9600, 10600, 11600, 13100, 15100 (meters).".

3. Ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 11.09.2015 No. 774

4. Recognize invalid:

2) the order of the Government of the Republic of Kazakhstan of January 24, 2008 No. 61 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of February 28, 1997 No. 285";

3) the subitem 1) Item 1 of the order of the Government of the Republic of Kazakhstan of February 2, 2010 No. 61 "About modification and amendments in some decisions of the Government of the Republic of Kazakhstan concerning aircraft" (SAPP of the Republic of Kazakhstan, 2010, No. 9, the Art. 109).

5. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of use of airspace of the Republic of Kazakhstan

1. General provisions

1. The these rules developed according to the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" of July 15, 2010 (further - the Law) and the Convention on the international civil aviation signed in the city of Chicago on December 7, 1944 determine procedure for use of airspace of the Republic of Kazakhstan for the benefit of economy and defense of the country, for the purpose of requirements satisfaction of airspace users, safety control of use of airspace.

2. In these rules the following determinations are used:

1) the region of aerial works - the area designated by geographical coordinates within which aerial works are performed by air vehicles;

1-1) current plans of flight - flight plan, including the possible changes caused by the subsequent air traffic control clearances;

1-2) routes of air traffic maintenance (further - Department of Internal Affairs) - the established route which is intended for movement direction of flow for the purpose of ensuring air traffic maintenance. The term "route of Department of Internal Affairs" is used for designation in appropriate cases of airway, supervised or uncontrollable route, route of arrival or departure and other routes;

2)  No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017;

3) No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017;

4) safety of use of airspace - the complex characteristic of established procedure of use of airspace determining it capability to provide accomplishment of all types of activity on use of airspace without threat of life and to human health, material damage to the state, citizens and legal entities;

5) use of airspace - activities in the course of which movement in airspace of different material objects (air vehicles, rockets and other objects) is performed and also other activities (construction of high-rise constructions, activities in the course of which there are electromagnetic and other radiations, emission in the atmosphere of the substances worsening visibility, carrying out explosive works, etc.);

6) coordinating of use of airspace - the activities performed in planning process of use of airspace and servicing (management) of air traffic, directed to optimization of use of airspace depending on the developing air, airflow, aeronavigation situation and according to the state priorities in use of airspace;

7) bodies of antiaircraft protection (further - bodies of air defense) - operational bodies of Armed Forces of the Republic of Kazakhstan to which the task of execution of alert on antiaircraft protection is assigned;

8) the plan of use of airspace - the certain data on the planned activities represented to bodies of planning of air traffic;

9) route of air traffic maintenance - the established route which is intended for movement direction of flow for the purpose of ensuring air traffic maintenance;

10) planning of use of airspace - the activities performed for the purpose of providing allowing and notifying procedure for use of airspace, air traffic management, the organization of flows of air traffic by distribution of airspace in the place, time and height between its users according to the state priorities;

11) the terminal area (the terminal control area (Terminal control area (TMA) - the dispatching area created in places of convergence of routes of Department of Internal Affairs in the neighborhood of one or several large airfields;

11-1) zone of airfield movement (Aerodrome Traffic Zone) - the airspace of certain sizes around airfield established for safety control of airfield movement;

12) the service area of air traffic - airspace of the established sizes in which borders air traffic maintenance on airways and routes out of them is performed by the dispatcher of district dispatch center;

13) structure of airspace - set of the elements of airspace limited in vertical and horizontal plane intended for implementation of activities for use of airspace;

14) side echeloning - dispersion of air vehicles at one height on the established distance intervals or to angular displacement between their track lines;

15) longitudinal echeloning - dispersion of air vehicles at one height on the established time distances or to distance along track line;

16) the Briefing group - the structural division of body of air traffic maintenance providing planning feature of air traffic and predpoletnoinformatsionny servicing;

16-1) dispatching area (CTA) - the controlled airspace stretching up from the border established over earth's surface;

16-2) control zone (CTR) - the controlled airspace stretching up from earth's surface to the established upper bound;

17) air traffic control clearance - the permission issued by body of air traffic maintenance to aircraft crew, connected with flight execution and proved by the corresponding conditions and statutory rules of flights;

18) dispatching specifying - the directions of body of air traffic maintenance ordering to the pilot to perform specific actions in specific situation;

19) zone (area) of responsibility - airspace of the established sizes within which bodies of air traffic maintenance (air traffic control) perform the functions;

19-1) airspace area with the mandatory requirement of availability of the defendant (transponder) (TMZ) - the airspace area of certain sizes in which when flying equipment of air vehicles by the defendant for watch systems exploited according to the established procedures surely is required;

20)  No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017;

21) airway of flight of Frontier of the Republic of Kazakhstan - the part of airspace over Frontier of the Republic of Kazakhstan determined for crossing by its air vehicles which are carrying out the international flights;

21-1) repeating flight plan (RPL) - the flight plan connected with row of often repeating, regularly carried out separate flights with identical main features which are provided by the operator for storage and re-usable bodies of Department of Internal Affairs;

22) short-term restriction - prohibition or restriction of use of part of airspace for ensuring safe accomplishment of flights of air vehicles;

23) products of dual purpose - products which owing to the properties and technical features can be used for the purposes of creation of weapons of mass destruction and means of its delivery;

24) additional regular flight - the flight performed by airline in addition to the regular flight along the same aviaroute in one date;

24-1) airspace area with obligatory maintaining radio communication (RMZ) - the airspace area of certain sizes in which when flying availability onboard the equipment for the maintaining two-way radio communication operated according to the established procedures is obligatory;

25) vertical separation - dispersion of air vehicles on height on the established intervals;

25-1) estimated time of blocks away - estimated time when the air vehicle begins the movement connected with departure;

26) representation on establishment of the temporary modes - the application for establishment of the temporary modes submitted by airspace users for introduction of prohibition or restriction of activities of other airspace users for the purpose of safety control of implementation of the activities connected with use of airspace;

26-1) filed flight plan - flight plan in that form in what it is presented to body of Department of Internal Affairs by the pilot or his authorized representative without any subsequent changes;

26-2) zone of flight information (FIZ) - part of the region of flight information in which borders the aerodrome flight information service (AFIS) or other body according to the delegated powers provides flight and information servicing and the emergency notification;

26-3) estimated arrival time:

in case of fly-by-wires - estimated arrival time of the air vehicle in the planned point designated by navaids with which accomplishment of maneuver of instrument landing approach is supposed, or in the absence of the navaid connected with this airfield - arrival time of the air vehicle to point over airfield;

in case of accomplishment of VFR flights (further - PVP) - estimated arrival time of the air vehicle in point over airfield;

27) flight height - distance down from certain level to the air vehicle;

28) the unmanned aerial vehicle - the air vehicle which is carrying out flight without pilot (crew) onboard and managed in flight automatically, the operator from control center or combination of the specified methods;

29) flight track - the projection of the set (established) flight path of the air vehicle to earth's (water) surface determined by ports of reference;

30) the region of flight information (FIR) - airspace of certain sizes within which flight and information servicing and the emergency notification are provided;

31) the international airway - the airway open for the international flights;

32) echeloning - vertical, longitudinal or side dispersion of air vehicles in airspace on the established intervals;

33) NOTAM office - the structural division of the supplier of aeronautical servicing issuing the notice of NOTAM;

34) the notice of NOTAM - the notice containing information on enforcement, condition or change of any aeronautical equipment, servicing and rules, and also information on dangers, the timely prevention of which is important for the personnel connected with accomplishment of flights and also other aeronautical information;

35)  No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017;

36) No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017.

3. The air vehicles of the state aircraft equipped with the state radar-tracking system of identification of the Republic of Kazakhstan carry out flights in airspace of the Republic of Kazakhstan with the switched-on equipment of the state radar-tracking system of identification.

4. These rules are applied by all state bodies of the Republic of Kazakhstan, local actuators of areas, cities of republican value and the capital, areas, cities of regional value, and airspace users, and also bodies of air traffic maintenance (further - Department of Internal Affairs) or controls air traffic (further - the Department of Internal Affairs).

2. Structure and classification of airspace of the Republic of Kazakhstan

§ 1. Structure of airspace of the Republic of Kazakhstan

7. The structure of airspace includes the following elements:

1) regions (zones) of flight information and dispatching areas;

2) routes of air traffic maintenance;

3) terminal control areas, control zones and zones of airfield movement;

4) regions of uncontrollable airspace;

5) special flying areas of the state aircraft;

6) prohibited areas;

7) danger areas;

8) zones of restriction of flights;

9) airways;

10) airspace areas with the mandatory requirement of availability of the defendant (transponder) (TMZ);

11) airspace areas with obligatory maintaining radio communication (RMZ).

Certain parts of airspace and certain airfields on which the decision on ensuring air traffic maintenance is made shall be designated according to type of air traffic maintenance.

7-1. Differentiation of airspace in which air traffic maintenance shall be provided is based on structure of routes of Department of Internal Affairs and the need for effective servicing.

Agreements on differentiation of the airspace lying outside national borders are reasonable when they promote provision of air traffic maintenance.

In that case when differentiation of airspace is performed taking into account frontiers, it is necessary on the basis of the arrangement with the adjacent state to establish conveniently located hand-over function points.

7-2. Airspace of the Republic of Kazakhstan is down divided into two regions of flight information: lower and upper areas. The border between the upper and lower area is established at the height of FL of 245 (7450 m) from the level corresponding to the atmospheric pressure of 760 mm of mercury column (1013,25 of hectopascals / milibarrov).

7-3. Parts of airspace in which the decision to provide with dispatching servicing IFR flights (further - PPP) is made are determined as dispatching areas, terminal areas (terminal control areas) or control zones.

Those parts of controlled airspace in which the dispatching services providing also accomplishment of flights on PVP are provided are designated as airspace of classes B, C or D.

7-4. In that case when dispatching areas and control zones are determined within the region of flight information, they are constituent of this region of flight information.

7-5. Airfields in which the decision to provide dispatching services of movement is made are determined as controlled airfields. Airfields in which dispatching servicing of airfield movement is not provided are determined as uncontrollable airfields.

7-6. Borders of the dispatching areas including, among other things, airways and terminal control areas are established so that they covered the airspace sufficient for inclusion of trajectories of those flights on PPP or their parts for which it is reasonable to provide the corresponding types of dispatching air traffic maintenance taking into account opportunities of navaids, as a rule, used in this area.

The lower bound of the dispatching area is established at the height at least 200 m over terrestrial or surface of the water.

The upper bound of the dispatching area, taking into account provisions of Item 37 of these rules, is established in the following cases:

1) dispatching air traffic maintenance will not be provided above this border;

2) this dispatching area is located below the upper dispatching area, and in this case its upper bound matches with the lower bound of the upper dispatching area.

7-7. Side borders of control zones cover those, the parts of airspace which are not entering dispatching areas through which there pass trajectories of flights on PPP of the air vehicles which are arriving to airfields and taking off from airfields.

Side borders of control zone will be spaced from the center of the relevant airfield or airfields at distance of at least 9,3 of km in the directions from where landing approaches can be made. The control zone can include two or several airfields which are close located one from another.

If the control zone is located within side borders of the dispatching area, it stretches up from the Earth's surface at least to the lower bound of the dispatching area. If necessary it is possible to establish the upper bound above the lower bound of the dispatching area.

7-8. Flights on PVP in parts of airspace of the classes E or G, and also flights on PPP in the parts of airspace of class G determined as airspace areas with obligatory maintaining radio communication are carried out on condition of conducting two-way radio communication of "air-to-ground" in the established regulations of work if other is previously not approved with body of the air traffic maintenance responsible for the specified area.

All flights of air vehicles in the airspace area with the obligatory defendant (transponder) (TMZ) shall be carried out with the included defendant (transponder) if other is previously not approved with body of the air traffic maintenance responsible for the specified area.

9. Borders of elements of structure of airspace are established on geographical coordinates and heights. Borders and conditions of use of elements of structure of airspace are published in documents of aeronautical information according to the Rules of providing with aeronautical information in civil aviation approved by authorized body in the field of civil aviation.

10. The list of areas (zones) of flight information and dispatching areas and their border are determined by the supplier of aeronautical servicing subordinated to authorized body in the field of civil aviation, and published in documents of aeronautical information.

Borders of terminal control areas and control zones, TMZ and RMZ are developed by the supplier of aeronautical servicing and published in documents of aeronautical information.

Borders of zones of airfield movement of uncontrollable airfield are developed by the operator of airfield, approved with body of air traffic maintenance and/or air traffic control around which responsibility there is airfield, and published in documents of aeronautical information.

Borders of areas (zones) of air traffic control match with borders of areas (zones) of flight information and dispatching areas.

11.  No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017

12. Airways are allowed to operation according to the Rules of the admission of airways to operation approved by authorized body in the field of civil aviation. For application of the navigation based on characteristics (PBN) on airways, the supplier of aeronautical servicing in coordination with authorized organization in the field of civil aviation, navigation specifications according to the Instruction on the organization and air traffic maintenance approved by authorized body in the field of civil aviation are established.

Opening of the international airways is performed in coordination with competent authorities of the adjacent states and International Civil Aviation Organization (further - ICAO).

Providing the equipment of airways with means of radio engineering flight servicing is performed by the supplier of aeronautical servicing.

16. In case of delimitation of areas of airfields (terminal control areas) schemes of departure and landing approach, go-around, holding flight, and also standard departure routes on devices (SID), standard routes of arrival on devices (STAR), routes of entrance (exit) to airways are considered.

Development of the specified schemes is performed according to the Rules of production of flights in the field of civil and (or) state aviation of the Republic of Kazakhstan approved by authorized bodies in aircraft spheres.

17. No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017

17-1. For each object (polygon, shooting range, training center, pit, the field, the mine, section) on which the works connected with production of firing practice, rockets firings, explosive works, uncontrollable aerostats are carried out (except for the uncontrollable probes or aerostats specified in the subitem 5) of Item 22 of these rules) and other activities posing safety hazard of flights, the owner or the body responsible for operation of object are performed, the agreement on interaction with the Department of Internal Affairs centers in which coordination measures between the Department of Internal Affairs center and body of Department of Internal Affairs for time of the beginning and cessation of work, establishment of vertical and horizontal borders and measure for interaction are specified is drafted. The agreement on interaction is approved with the Department of Internal Affairs center and body of Department of Internal Affairs around which responsibility there is object, and affirms person in charge (head) of object.

In case of approval of the agreement on interaction the body of Department of Internal Affairs can initiate change of vertical and horizontal borders, and also the action period for the purpose of safety control in case of production of flights.

17-2. In case of accomplishment of flights of the unmanned aerial vehicles, except as specified, specified in Item 82-1 of these rules, the operator or the owner of the unmanned aerial vehicle in the Department of Internal Affairs center and body of Department of Internal Affairs in which zone of responsibility accomplishment of flights is planned provide information on production of flights of the unmanned aerial vehicle for review in the form determined by the service regulations of unmanned aerial vehicles in airspace of the Republic of Kazakhstan approved by authorized body in the field of civil aviation.

18. Special flying areas of the state aircraft are understood as the airspace of the established sizes intended for accomplishment of test flights, aerial refueling, flights at small and extremely small heights, rockets firings, aerial gunneries and other special flights.

19. No. 650 is excluded according to the Order of the Government of the Republic of Kazakhstan of 19.10.2017

20. Prohibited areas are established in airspace of the Republic of Kazakhstan for protection of important state objects, key industrial complexes (nuclear electric powerplants, nuclear and radiation objects, chemically dangerous objects, and also other especially important objects from the point of view of homeland security of the country), the protected objects from the harmful effects and destructions resulting from possible incidents in airspace. Prohibited areas are published in documents of aeronautical information.

21. Danger areas, zones of restriction of flights are established by the Main air traffic control center of authorized body in the field of the state aircraft (further - HZ of the Department of Internal Affairs) and are brought to the attention of users by means of the notice of NOTAM or are published in documents of aeronautical information. For establishment of the danger area, zone of restriction of flights airspace users for the benefit of whom the specified danger area, zone of restriction of flights are established not later than 9 days before commissioning of the danger area, zone of restriction of flights, represent to HZ of the Department of Internal Affairs request for establishment of the danger area, zone of restriction of flights with indication of its vertical and horizontal borders, the period of action and nature of the performed activities.

22. Danger areas are established for the benefit of the following types of activity, connected with:

1) work with ammunition on objects of their storage;

2) implementation of scientific research in the atmosphere;

3) electromagnetic radiations;

4) light radiations;

5) launch areas of uncontrollable aerostats or probes (except for uncontrollable aerostats or probes which are classified as lungs, according to Item 83-1 of these rules);

6) zones of fall of the separated parts of launch vehicles.

23. Zones of restriction of flights are established over areas of carrying out all types of firing practice, rockets firings, explosive works, the national natural parks, national parks, historical and cultural monuments, and also over the protected objects for representation of the interested state bodies.

24. If activities for the benefit of which the danger area, zone of restriction of flights are established have no permanent character, action of the danger area, zones of restriction of flights is limited to the temporary period.

Data on activities in danger areas, zones of restriction of the flights limited to the temporary period are led up by means of the notice of NOTAM according to the types of messages on movement of air vehicles and production of the activities connected with use of airspace provided by appendix 3 to these rules.

25. In case of danger of inadvertent entrance of air vehicles to the danger area, zone of restriction of flights, and also in the cases provided by subitems of 2)-4) of Item 27 of these rules, activities for use of airspace in the specified zones are limited or stops.

26. Prohibited areas are established by authorized body in the field of the state aircraft on representation of persons interested in establishment of such zones.

The list of prohibited areas and zone of restriction of flights are approved with Service of the state protection of the Republic of Kazakhstan and bodies of homeland security.

26-1. In case of initial establishment of prohibited areas, danger areas or zones of restriction of flights designation is appropriated to each zone.

26-2. The appropriated designation is used for designation of zone in all subsequent changes concerning this zone.

26-3. Designation consists of the following group of letters and digits:

1) alphabetic designation of UA;

2) letter P - for the prohibited area, letter R - for zone of restriction of flights and letter D - for the danger area respectively;

3) number which is not duplicated within the territory of the Republic of Kazakhstan.

27. Use of airspace in prohibited areas, and also in zones of restriction of flights, danger areas activities in which is performed on permanent basis, it is forbidden, except for:

1) uses of airspace by persons for the benefit of which such zones are established;

2) accomplishment of flights on interception of air courts violators, and also accomplishment of other operational tasks for the benefit of the state;

3) accomplishment of flights for the purpose of carrying out search and rescue works and works on assistance in case of emergency situations;

4) accomplishment of flights of the air vehicles performed according to the international treaties signed by the Republic of Kazakhstan.

28. In need of use of airspace in prohibited areas, zones of restriction of flights, danger areas in cases, not stipulated in Item 27 these rules, airspace users get permission of authorized body in the field of the state aircraft.

29. Over the territory of the Republic of Kazakhstan along its Frontier the border strip - the airspace adjoining overland Frontier of the Republic of Kazakhstan 25 kilometers wide, and also over territorial waters 12 nautical miles wide (22.2 kilometers) is established.

30. Production of the activities connected with use of airspace of border strip is approved with bodies of the border service of Committee of homeland security of the Republic of Kazakhstan, bodies of troops of air defense, controls air traffic at least in 5 days prior to activities.

Flights in border strip without radio communication of aircraft crew with body of air traffic maintenance (air traffic control) are not made.

30-1. Flights of unmanned aerial vehicles in airspace over borderland are performed according to item 4 of article 33 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

31. When using airspace of border strip forced variations from the established route are made towards the territory of the Republic of Kazakhstan.

31-1. Schemes of departure, arrival, landing approach on airfields and go-around shall exclude, and in case of impossibility of exception - as much as possible to limit flight of air vehicles over settlements. The procedure for establishment of such schemes (routes) is determined by the Rules of production of flights in civil aviation of the Republic of Kazakhstan approved by authorized body in the field of civil aviation and the Rules of production of flights of the state aircraft of the Republic of Kazakhstan approved by authorized body in the field of the state aircraft.

32. Flights of air vehicles over settlements out of the established schemes (routes) for the purpose of implementation of actions for rescue of life and to health protection of people, suppression and disclosure of crimes, and also accomplishment of aerial works, parachute jumps, flights of unmanned aerial vehicles, raising of fastened aerostats are carried out at height providing realization of the specified actions with safety control of accomplishment of flights by the organizer of such flights.

Approval of accomplishment of flights of civil air vehicles over settlements out of the established schemes (routes), except for the flights connected with actions for rescue of life and health protection of people, suppression and disclosure of crimes, and also the flights which are carried out within holding security actions of Service of the state protection of the Republic of Kazakhstan, and issue of permissions to flights of the national air vehicles and unmanned aerial vehicles of all elements of aviation is made by the Department of Internal Affairs centers in case of the flight plan filing according to the procedure provided by Section 4 of these rules.

The Department of Internal Affairs centers in case of approval of such flights:

1) is excluded by entrances to prohibited areas and zones of restriction, except for flights on which special permissions of authorized body in the field of the state aircraft are issued;

2) is checked by availability of necessary approvals, stipulated in Item 82-2 these rules.

During security actions flights of air vehicles over settlements are approved with bodies of homeland security and Service of the state protection of the Republic of Kazakhstan.

33. No. 569 is excluded according to the Order of the Government of the Republic of Kazakhstan of 01.08.2019

34. Flights of air vehicles on supersonic speeds are permitted only in special flying areas of the state aircraft or at the height more than 11000 meters.

35. For accomplishment of demonstration and demonstration flights of air vehicles and other flight vehicles special zones (flight zones) located in specially allocated airspace of certain areas out of or over settlements with observance of the required security measures excluding fall of the air vehicle or flight vehicle on residential arrays and accumulations of people are established.

§ 2. Classification of airspace of the Republic of Kazakhstan

36. Airspace of Department of Internal Affairs is classified and designated as follows:

Class A. Only flights on PPP are permitted; all air vehicles are provided with dispatching servicing and echeloned.

Class B. Flights on PPP and PVP are permitted; all air vehicles are provided with dispatching servicing and echeloned.

Class C. Flights on PPP and PVP are permitted; all air vehicles are provided with dispatching servicing, and the air vehicles which are carrying out flights on PPP are echeloned concerning other air vehicles which are carrying out flights on PPP and PVP. The air vehicles which are carrying out flights on PVP are echeloned rather air vehicles which are carrying out flights on PPP and obtain information on movement concerning other air vehicles which are carrying out flights on PVP.
