About approval of Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil

In compliance with the subitem 42) of article 16 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil.

2. Recognize invalid:

2) the order of the Government of the Republic of Kazakhstan of April 25, 2006 No. 323 "About modification of the order of the Government of the Republic of Kazakhstan of October 18, 1996 No. 1285" (SAPP of the Republic of Kazakhstan, 2006, No. 14, the Art. 138).

3. To the ministry of environmental protection of the Republic of Kazakhstan in the procedure established by the legislation to bring departmental regulations into accord with this resolution.

4. This resolution becomes effective from the date of the first official publication.

Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil

1. General provisions

1. Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil are developed according to the subitem 42) of article 16 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" and the Ecological code of the Republic of Kazakhstan.

2. The state inventory of burials contains the data characterizing type and type of the buried substances and the dumped waters with indication of their quantitative and qualitative indexes, mining, special engineering-geological, hydrogeological and ecological conditions of burial and dumping and includes:

1) general characteristic of subjects to burial of hazardous substances, radioactive waste and places of dumping of sewage: location, period of operation, charge, availability and arrangement of the supervisory network of monitoring of state of environment and monitoring of subsoil;

2) physical characteristic of subjects to burial of hazardous substances, radioactive waste and places of dumping of sewage: the characteristic of isolation, type of rocks, depth and effective capacity of layer collector, its area, porosity coefficient, the characteristic of the spreading and blocking water emphasis, speed of natural flow of underground waters, dumping storage both other quantitative and qualitative indexes;

3) characteristic of hazardous substances, radioactive waste, sewage: the name of product, technological production or process as a result of which the product, physical characteristic (complete chemical composition, content of toxic components, fire-and-explosion hazard, solubility, compatibility with other substances is formed in case of storage, the main contaminating radionuclides, their activity and other characteristics), the characteristic of transportation system.

The state inventory of burials is kept separately for the hazardous substances, radioactive waste and sewage dumped in subsoil according to the regulatory legal acts approved by authorized body in the field of environmental protection.

The list of hazardous substances is determined in the order of the Government of the Republic of Kazakhstan of June 30, 2007 No. 557 "About approval of the list of pollutants and types of waste for which standard rates of issues are established, and the payment for issues to the environment is levied".

The state inventory of burials is kept separately for hazardous substances, radioactive waste and sewage according to the reporting of users of nature, scientific research, project researches, other sources of ecological information and drawn up in the form of passports of objects of accounting (further - the Passport).

3. The users of nature having burials of hazardous substances, radioactive waste and performing dumping of sewage into subsoil irrespective of patterns of ownership and departmental accessory, users of nature annually as of January 1 during the first quarter of the year following reporting represent to authorized body of environmental protection of the passport, drawn up according to appendix to these rules.

2. Objects of accounting

4. Are subject to accounting of the state inventory of burials:

1) places of burials of the hazardous substances not suitable for further use and conversion of the agricultural chemicals, alkalis, acids prohibited to application of products and materials;

2) places of dumping of sewage of the following groups:

acidic water after oil desalting (containing hydrogen sulfide, oil products, mechanical impurity and dissolved salts which together with reservoir water after dehydration of oil moves on cleaning of hydrogen sulfide, oil and solid particles before downloading through delivery wells in the deep underground horizons);

sewage from demercaptanization installation (containing neutralized the alkali, oil products, mechanical impurity, soluble salts, mercaptides, sulfides arriving in network of the production and rain sewerage, further on treatment facilities of purification of production waters for removal of oil and solid particles before downloading in delivery wells);

commercial alkaline water from reservoirs of storage of commodity oil (with content of mechanical impurity and oil products which is partially used for preparation of alkaline solution partially arrives on alkali neutralization installation, further on treatment facilities for removal of solid particles and oil before downloading in delivery wells);

the thawed and rain sewage collected from the asphalted platforms, taken to network of the production and rain sewerage, further pumped out by pumping point on treatment facilities for removal of solid particles and oil before downloading in delivery wells;

3) the Items of burial of radioactive waste which are classified according to the destination on Items of storage and Items of burial. Are divided by depth of arrangement of Items of radioactive waste of rather land surface: on near-surface (capacity of protective cover to 10 meters); deep (waste is located at depth more than 10 meters from day surface).

3. Registration and approval of passports

5. Passports are constituted by users of nature according to appendix, in duplicate as of January 1 of the current year.

Passports go to authorized body on environmental protection of the Republic of Kazakhstan during the first quarter of the current year following reporting.
