2) amounts of the tariff quotas for import to the territory of the Republic of Kazakhstan of the meat occurring and imported from the countries with which at the countries - members of the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation free-trade agreements are not signed or exist withdrawals from free trade regime concerning goods for 2011;

3) distribution of amounts of the tariff quotas between participants of foreign economic activity for 2011 (the 1st stage).

1. General provisions

These rules of distribution of amounts of the tariff quotas between participants of foreign economic activity on import to the Republic of Kazakhstan of some types of meat (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 12, 2004 "On regulation of trading activity" and determine procedure and method of distribution of amounts of the tariff quotas as instrument of regulation of foreign trade activity.

2. The procedure and terms of issue of licenses are determined by the legislation of the Republic of Kazakhstan on licensing.

3. In these rules the following concepts are used:

1) preceding period - two years which are directly preceding year of establishment of the tariff quota;

2) supplying countries - the countries with which at the participating countries of the Customs union and the Common economic space free-trade agreements are not signed or exist withdrawals from free trade regime concerning goods;

3) amount of commodity importation by the historical supplier - goods quantity in kind, coming from the supplying countries imported on the territory of the Republic of Kazakhstan in customs procedure "release for internal consumption" for preceding period;

4) commercially profitable quantity - goods amount more than 25 kilograms;

5) amount of the tariff quota - the amount of goods determined by the Government of the Republic of Kazakhstan for one calendar year which import is assessed at inside quote rates of import customs duties of the Common customs tariff of the Customs union;

6) the historical supplier - the legal entity or physical person registered as the individual entrepreneur according to the legislation of the Republic of Kazakhstan, corresponding to the following criteria:

shall perform commodity importation in preceding period or within year, to directly prior year in which the tariff quota, from supplying countries in customs procedure "release for internal consumption" is established;

the commodity importation amount within the year which is directly preceding year in which the tariff quota is established shall not be less commercially profitable quantity;

7) goods - separate types of meat concerning which the tariff quota, coming from supplying countries is established;

8) the new supplier - the legal entity or physical person registered as the individual entrepreneur according to the legislation of the Republic of Kazakhstan, which is not the historical supplier of goods;
