The agreement on cooperation of state members of Eurasian economic community in the field of certification and/or accreditation of the educational organizations / organizations (educational programs)

The governments of state members of Eurasian economic community (further - EurAsEC) which are hereinafter referred to as with the Parties

considering provisions of the Agreement between the Government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Russian Federation and the Government of the Republic of Tajikistan about mutual recognition and equivalence of education documents, academic degrees and ranks of November 24, 1998, with changes of February 26, 2002,

proceeding from importance of coordination of collateral actions in the fields of education and forming of general educational space,

recognizing feasibility of interaction in creation of the approved approaches for education quality assurance, agreed as follows:

Article 1

For the purposes of this agreement the stated below terms mean the following:

accreditation - periodic assessment and recognition by the state or public organization of activities of the educational organization / organization (educational program), as answering to the established criteria, requirements, regulations and educational standards;

certification - periodic assessment by the state of compliance of the educational services rendered by the educational organization / organization to requirements of educational standards;

quality of education - the education compliance (received and received) to requirements and interests of the personality, society, state;

the educational program - set of main objectives, tasks and content of formation of certain level and/or orientation, and also the list and the sequence of the educational actions necessary for the goal achievement and tasks established by the educational standard.

Article 2

The parties create the approved approaches to providing quality assurance of education and adhere to the agreed principles in the field of certification and/or accreditation of the educational organizations / organizations (educational programs) of state members of EurAsEC.

For the purpose of forming of the approved approaches to providing quality assurance of formation of the Party:

develop offers and recommendations about harmonization of the national legal system and techniques (technologies) in the field of certification and/or accreditation of the educational organizations / organizations (educational programs) of state members of EurAsEC;

provide exchange of legislative and other regulatory legal acts, methodical documents in the field of assessment and quality assurance of education.

Article 3

The parties create the approved approaches to education quality evaluation taking into account the accumulated experience in state members of EurAsEC, and also specifics of national educational systems.

Article 4

The parties create national banks of data of the certified and/or accredited educational organizations / organizations (educational programs) and provide each other the corresponding information.

Article 5

The parties determine the authorized bodies / organizations responsible for implementation of this agreement and performing coordination of interaction of the Parties concerning certification and/or accreditation.

The parties in three-months time from the date of entry into force of this agreement notify depositary on the authorized bodies / organizations.

In case of change of authorized bodies / organizations of the Party without delay notify depositary.

Article 6

The parties can involve in development of the approved procedures of certification and/or accreditation of the educational organizations / organizations (educational programs), criteria and techniques of their assessment of the corresponding specialists of Eurasian network of quality assurance of education and other organizations recommended by authorized bodies / organizations of the Parties.

Article 7

The parties assist each other and to the certified and/or accredited educational organizations / organizations in realization of joint projects in the field of assessment and quality assurance of education.

Article 8

The realization of Articles 6, 7 is enabled due to off-budget financing if other is not stipulated by the legislation the states of the Parties.

Article 9

This agreement does not affect the rights and obligations of the Parties following from other international treaties which participants they are.

Article 10

1. The disputes between the Parties connected with interpretation and/or application of provisions of this agreement are permitted, first of all, by negotiation and consultations.

2. If the dispute is not settled by the parties of dispute by negotiations and consultations within six months from the date of the official written request for their carrying out sent to one of the parties of dispute to other party of dispute, then, in the absence of other arrangement between the parties of dispute on method of its permission, the either party of dispute can bring this dispute for consideration To trial of Eurasian economic community.

Article 11

According to the mutual arrangement of the Parties changes which are drawn up by separate protocols can be made to this agreement.

Article 12

This agreement becomes effective from the date of receipt by depositary of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

Article 13

This agreement is open for accession to it of other states.

Documents on accession are checked to depositary.

For the joining state this agreement becomes effective from the date of receipt by depositary of the document on accession.

Article 14

Each Party can leave this agreement, having in writing notified on it depositary. This agreement is terminated concerning such Party in six months after receipt of the adequate notice by depositary.

It is made in St. Petersburg on May 21, 2010 in one copy in Russian. The authentic copy of this agreement is stored in Integration Committee of Eurasian economic community which, being depositary of this agreement, will send to the Parties its verified copy.
