RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of May 10, 2011 No. 129

About approval of the Regulations on licensing of realtor activities

(as amended on 16-06-2020)

According to the laws of the Republic of Uzbekistan "About licensing of separate types of activity" and "About realtor activities" the Cabinet of Ministers decides:

1. Determine Goskomkonkurention of the Republic of Uzbekistan authorized state body in the field of realtor activities.

2. Approve Regulations on licensing of realtor activities according to appendix.

3. To the State Property Committee of the Republic of Uzbekistan in two weeks in accordance with the established procedure to develop and approve:

Regulations on commission of experts on preparation of the conclusions about issue of licenses for the right of implementation of realtor activities and its structure;

Regulations on procedure for issue of the qualification certificate of the realtor.

4. To the State Tax Committee together with Goskomkonkurention of the Republic of Uzbekistan to take in accordance with the established procedure corrective actions to the legal entities and physical persons performing realtor activities without the corresponding license.

5. The Section "State Property Committee of the Republic of Uzbekistan" of appendix No. 1 to the resolution of the Cabinet of Ministers of June 28, 2002 No. 236 "About measures for implementation of the Law of the Republic of Uzbekistan "About licensing of separate types of activity" (2002, No. 6, the Art. 36) to add the joint venture of the Republic of Uzbekistan with the paragraph of the following content:

"Realtor activities".

6. This resolution becomes effective since June 23, 2011.

7. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R.S.Azimov.

Regulations on licensing of realtor activities

I. General provisions

1. This Provision determines procedure for licensing of realtor activities.

2. Licensing of realtor activities is performed Goskomkonkurention of the Republic of Uzbekistan (further - the licensing body).

3. For consideration of documents on issue of licenses, preparation of the conclusions on them in the licensing body the commission of experts is created.

4. Realtor activities are performed by legal entities and physical persons. At the same time to the physical person - the realtor the license only for the right of rendering information and consulting services in the real estate market is granted.

5. The realtor organization for the statement the license for rendering one or several types of realtor services is granted.

6. Realtor activities are performed by rendering the following types of realtor services:

mediation in case of the conclusion of transactions with real estate objects and the rights to them;

organization of the biddings by real estate objects and rights to them;

trust management of real estate objects;

information and consulting services in the real estate market.

7. The license for the right of implementation of realtor activities is granted without restriction of effective period.

II. Licensed requirements and conditions

8. Licensed requirements and conditions when implementing realtor activities are:

a) observance by the licensee of the legislation in the field of implementation of realtor activities;

b) implementation of exclusively realtor activities;

c) availability of the policy of assurance of the civil responsibility;

d) availability in case of filing of application about licensing of completely created authorized capital in the amount of, provided by this Provision;

e) implementation by the worker having the qualification certificate of the realtor, realtor activities only in one realtor organization;

e) availability in staff of the realtor organization at least two workers having the qualification certificate of the realtor;

g) ensuring confidentiality of information obtained when rendering realtor services;

h) position assignment of the head of the realtor organization only the worker having the qualification certificate of the realtor;

i) availability at the realtor organization of the approved internal regulations of quality control of the provided services;

j) the notification of the licensing body in week time after passing of re-registration, about change of the name or the location (postal address) - for the legal entity, change of surname, name, middle name or residence - for physical person;

k) representation once in half-year in Goskomkonkurention of the Republic of Uzbekistan in the established form of data on realtor activities, and also, upon the demand of the State Property Committee of the Republic of Uzbekistan, other information connected with rendering realtor services.

Requirements of subitems "b", "g", "d", "e", "z", "i" do not extend to the realtor (physical person) when implementing realtor activities.

The realtor organizations performing:

information and consulting services in the real estate market shall have the authorized capital equal to at least 100-fold size of basic settlement size;

mediation in case of the conclusion of transactions with real estate objects and the rights to them - shall have the authorized capital equal the 500th multiple size of basic settlement size suffices;

trust management of real estate objects - shall have the authorized capital equal to at least 1000-fold size of basic settlement size;

the organization of the biddings by real estate objects and the rights to them shall have the authorized capital equal to at least 3000-fold size of basic settlement size.

The license applicant, intended to perform several types of realtor services, shall have the created authorized capital by the form of realtor services on which forming of the maximum size of the authorized capital is provided.

III. Documents necessary for receipt of the license

9. For receipt of the license the license applicant submits the following documents to the licensing body:

a) the statement for licensing with indication of:

names, form of business, the location (postal address), the name of the servicing bank, the room of the on-demand deposit account in bank, the list of founders (participants), their addresses and types of activity - for the legal entity;
