Questions of the Public migratory service of Ukraine

1. Approve Regulations on the Public migratory service of Ukraine it (is applied).

2. To the Ministry of Internal Affairs of Ukraine, the Ministry of Culture of Ukraine, the State committee of Ukraine, for nationalities and religions to provide proper accomplishment of functions which belonged to the called bodies before entry into force of this Decree and are transferred to powers of the Public migratory service of Ukraine before completion of forming of system of its bodies.

3. Before legislative settlement of the organization and activities of the Public migratory service of Ukraine:

for ensuring accomplishment of the tasks assigned to the Public migratory service of Ukraine on realization of state policy in the sphere of counteraction of illegal migration, and also administrative prosecution for violation of the law in the sphere of registration of physical persons, issues of identity documents and confirming nationality to form division of militia of migratory control with a total limiting number of 1500 units in the Ministry of Internal Affairs of Ukraine, having functionally subordinated him to the Public migratory service of Ukraine.

Determine that:

the division of militia of migratory control of the Ministry of Internal Affairs of Ukraine is financed by the means provided in the government budget for the corresponding year for implementation of actions for counteraction of illegal (illegal) migration, and also other means which are provided for the Public migratory service of Ukraine;

the structure, the staff list and the estimate of division of militia of migratory control of the Ministry of Internal Affairs of Ukraine affirms the Minister of Internal Affairs of Ukraine in coordination with the Chairman of the Public migratory service of Ukraine;

the chief (deputy chief) of division of militia of migratory control of the Ministry of Internal Affairs of Ukraine and heads of its structural divisions are appointed to positions and dismissed by the Minister of Internal Affairs of Ukraine in coordination with the Chairman of the Public migratory service of Ukraine. Other employees of division of militia of migratory control and its territorial authorities are appointed to positions and dismissed according to the procedure which affirms the joint order of the Ministry of Internal Affairs of Ukraine and the Public migratory service of Ukraine;

on employees of militia of migratory control of the Ministry of Internal Affairs of Ukraine operation of the Law of Ukraine "On militia" and Regulations on service by the ordinary and commanding structure of law-enforcement bodies, the USSR Cabinet of Ministers approved by the resolution of July 29, 1991 N 114 expatiates;

the regulations on division of militia of migratory control of the Ministry of Internal Affairs of Ukraine affirm the joint order of the Ministry of Internal Affairs of Ukraine and the Public migratory service of Ukraine.

4. To the Cabinet of Ministers of Ukraine in a month:

resolve issue of placement and material logistics of the Public migratory service of Ukraine;

resolve issue concerning transfer in accordance with the established procedure to the sphere of management of the Public migratory service of Ukraine of the companies and organizations necessary for ensuring implementation of its functions;

submit in accordance with the established procedure proposals of rather legislative settlement of the organization and activities of the Public migratory service of Ukraine;

bring the decisions into accord with this Decree.

5. To Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and to the Sevastopol city, district, district public administrations in the cities of Kiev and Sevastopol in two-month time to take measures for ensuring functioning of territorial authorities and divisions of the Public migratory service of Ukraine within competence.

6. Recommend to local government bodies to promote in ensuring functioning of territorial authorities and divisions of the Public migratory service of Ukraine.

7. Recognize invalid:

Article 2 of the Presidential decree of Ukraine of March 27, 2001 N 215 "Questions of the organization of accomplishment of the Law of Ukraine "Of citizenship of Ukraine";

Article 1 of the Presidential decree of Ukraine of August 7, 2001 N 596 "Questions of the organization of accomplishment of the Law of Ukraine "Of immigration".

8. This Decree becomes effective from the date of its publication.

Regulations on the Public migratory service of Ukraine

1. The public migratory service of Ukraine (GMS of Ukraine) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs of Ukraine (further - the Minister).

GMS of Ukraine is a part of the system of executive bodies and is formed for realization of state policy in spheres of migration (immigration and emigration), including counteractions of illegal (illegal) migration, nationality, registration of physical persons, refugees and other categories of migrants determined by the legislation.
