About free economic zones

This Law determines organizational, legal, economic basis of creation, management, functioning and liquidation of free economic zones in the territory of the Republic of Tajikistan and regulates procedure and conditions of application of special legal regime in business and investing activities in free economic zones.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

- the free economic zone - the certain (limited) site of the territory of the Republic of Tajikistan with precisely designated borders in which preferential economic terms and special legal regime for implementation of business and investing activities are created;

- special legal regime free economic zonysovokupnost of the precepts of law establishing special conditions of implementation of the taxation, the currency address, customs regime, employment relationships and other conditions in the territory of the free economic zone;

- infrastructure of the free economic zone - set of the elements designed to provide conditions for productive and economic activity in the territory of the free economic zone, including barriers, buildings and constructions, subjects to technical arrangement of the territory, environmental protection and social appointment;

- authorized state body on free economic zones - the state body authorized by the Government of the Republic of Tajikistan concerning creation, managements, functioning and liquidations of free economic zones in the Republic of Tajikistan;

- administration of the free economic zone - the organization having the status of public institution and exercising control of the free economic zone;

- the unified register of subjects of the free economic zone – the information database containing the information about subjects of the free economic zones created in the territory of the Republic of Tajikistan;

- the serving company – the subject of the free economic zone rendering infrastructure services, construction of facilities of infrastructure and other similar services based on the agreement for further activities of subjects of the free economic zone;

- the principle of "single window" – the form of provision of the state services in the territory of the free economic zone providing minimization of participation of applicants in collection and preparation of documents and restriction of their direct contact with subjects of rendering the state services;

- the budget of administration of the free economic zone - the money used for organization and household expenses of the free economic zone and for ensuring achievements of its purposes and tasks;

- fund of development of free economic zones - set of the money intended for financing of creation and ensuring development of infrastructure of free economic zones, and also for rendering temporary financial aid to subjects of business activity, registered in free economic zones;

- the supervisory board of free economic zones - the expert, advisory and coordinating body of activities of free economic zones;

- subjects of the free economic zone are subjects of business activity, irrespective of their forms of business, registered according to the legislation of the Republic of Tajikistan administration of the free economic zone;

- the certificate of the subject of the free economic zone - the document confirming the right of activities and use of special legal regime in the free economic zone;

- business - the plan - the document provided by the subject of the free economic zone according to the investment project in which the detailed information about payback periods, efficiency, requirements and market research is reflected.
