1. Approve the enclosed Rules of the admission of foreigners and stateless persons to the state secrets of the Republic of Kazakhstan.

Rules of the admission of foreigners and stateless persons to the state secrets of the Republic of Kazakhstan

1. These rules of the admission of foreigners and stateless persons to the state secrets of the Republic of Kazakhstan (further - Rules) are developed according to item 4 of article 29 of the Law of the Republic of Kazakhstan "About the state secrets" and determine procedure for the admission of foreigners and stateless persons to the state secrets of the Republic of Kazakhstan.

2. Foreigners and stateless persons are allowed to the state secrets of the Republic of Kazakhstan only within implementation of international treaties of the Republic of Kazakhstan with observance of the requirements provided by the Rules of transfer of the state secrets and their carriers to foreign states and (or) the international organizations approved by the Government of the Republic of Kazakhstan.

3. For the admission of foreigners to the state secrets of the Republic of Kazakhstan the authorized body of foreign state determined in the international treaty in the procedure established by the legislation sends the petition to the head of state body in which the admission of foreigners to the state secrets of the Republic of Kazakhstan will be made.

The certificate confirming powers of the foreigner and containing data that he has the admission right to the classified information of the state of appropriate level of privacy is attached to the petition.

4. The head of state body or organization, where the admission of foreigners and stateless persons to the state secrets will be performed, agrees with bodies of homeland security of the Republic of Kazakhstan on opportunity and feasibility of the admission of specific foreigners and stateless persons to the state secrets. The term of coordination shall not exceed twenty working days.

5. In case of refusal in coordination of the admission of specific foreigners and stateless persons to the state secrets in the absence of opportunity and feasibility the head of state body directs in the procedure established by the legislation to authorized body of foreign state the notice to produce of candidates of other persons to the admission to the state secrets of the Republic of Kazakhstan or the stateless person the notification on refusal in the admission to the state secrets.

6. In case of positive coordination the head of state body or organization of the Republic of Kazakhstan issues the order on the admission of foreigners and persons without citizenship to the state secrets. Cross liabilities of administration, and also foreigners and stateless persons are reflected in the agreement on the admission to the state secrets.

7. 9. After briefing the foreigner and the stateless person give the commitment letter about nondisclosure of the state secrets of the Republic of Kazakhstan to which they will have access.

The commitment letter is stored in division on protection of the state secrets of state body or organization of the Republic of Kazakhstan at least five years after termination of work of foreigners and stateless persons with the state secrets of the Republic of Kazakhstan.

10. Information on the actual admission of foreigners and persons without citizenship in each case within twenty working days from the moment of the admission goes to bodies of homeland security of the Republic of Kazakhstan.
