Agreement between the Government of the Russian Federation and Government of Ukraine on visa-free trips of citizens of the Russian Federation and Ukraine

of January 16, 1997

The government of the Russian Federation and the Government of Ukraine which are hereinafter referred to as by the Parties

for the purpose of further development of friendship between two states, legal settlement of trips of their citizens

agreed as follows:

Article 1

Citizens of the state of one Party can drive, leave and move on the territory of the state of other Party without visas with observance of the rules of stay existing in this state according to the documents proving the identity and confirming nationality specified in Appendices 1 and 2 to this agreement.

Citizens of the state of one Party on the basis of reciprocity are exempted from registration in competent authorities in the place of their stay in the territory of the state of other Party if the term of such stay does not exceed 90 days from the moment of entrance on the territory of the state of this other Party, in the presence at them the migration card with the mark of bodies of border control which is put down in case of entrance on the territory of the state of stay.

By agreement between the Government of the Russian Federation and the Government of Ukraine changes can be made to the list of the documents specified in Appendices 1 and 2 to this agreement. Such arrangement is drawn up by exchange of diplomatic notes.

Article 2

The citizens of the states of the Parties who are constantly living in the third states can drive, leave and follow en route through the territory of the states of the Parties without visas according to the documents specified in Appendices 1 and 2 to this agreement.

Article 3

The parties shall allow citizens of the states of the Parties into the third states through check points on frontier, open for the international passenger traffic, according to the documents valid for trip abroad.

The parties will take measures to non-admission of departure from the territory of their states to the third states of citizens of the states of the Parties which departure is limited according to the national legal system of the either party, before the termination of the circumstances interfering their departure.

Article 4

The parties will inform without delay each other through diplomatic channels on new identity documents and confirming nationality and to direct their samples, and also to inform on the changes concerning the documents specified in Appendices 1 and 2 to this agreement.

Article 5

Trips of citizens of the states of the Parties are performed through check points on frontier between the Russian Federation and Ukraine.

Article 6

Each of the Parties has the right fully or partially to suspend separate provisions of this agreement if it is necessary for safety of the state, preserving public order for public health care.

And about cancellation of such measures of the Party will inform on acceptance beforehand each other through diplomatic channels.

Article 7

The parties will communicate and consult, as required, on the questions connected using provisions of this agreement.

The parties by mutual consent can make changes and additions to this agreement.

Article 8

This agreement becomes effective from the date of exchange of the Parties of the corresponding notes on diplomatic kanalam*.

This agreement is signed for unrestricted term. Each of the Parties can terminate this agreement, having notified on it other Party in writing. In this case the Agreement voids after six months from the date of such notification.

It is made in the city of Moscow on January 16, 1997 in duplicate, everyone in the Russian and Ukrainian languages, and both tests are equally authoritative.

Appendix 1

The list of documents for entrance, departure and movement on the territory of Ukraine citizens of the Russian Federation

1. The passport of the citizen of the former USSR with the insert, the certificate (mark) of citizenship of the Russian Federation or with the text about belonging to the Russian citizenship, or with stamp about registration (permanent registration) in the territory of the Russian Federation as of February 6, 1992.

2. The certificate of birth (for children up to 16 years).

3. Identity certificate of the general (admiral) of the Armed Forces of the Russian Federation.

4. Identity certificate of the officer of the Armed Forces of the Russian Federation.

5. Identity certificate of the ensign (warrant officer) of the Armed Forces of the Russian Federation.

6. Military ID of the serviceman of the Armed Forces of the Russian Federation.

7. Diplomatic passport.

8. The diplomatic passport of the former USSR with record about citizenship of the Russian Federation (till September 16, 1997).

9. Service passport.

10. The service passport of the former USSR with record about citizenship of the Russian Federation (till September 16, 1997).

11. Foreign passport.

12. The foreign passport of the former USSR with record or mark about citizenship of the Russian Federation.

13. The passport of the seaman (in the presence of the muster roll or the statement from it).

14. The flight certificate of the crew member of the aircraft (in travel time as a part of crew).

15. The identity certificate of the worker of rail transport (in travel time as a part of crews of train).

16. The certificate on return to the Russian Federation (only for return to the Russian Federation).
