being guided by desire to develop friendship and to promote mutual safety of the Parties,
recognizing necessary creation of optimal conditions for departure of citizens of the states to the states which are not entering the Commonwealth of Independent States and entrance from them,
considering that effective remedy of achievement of these is more whole the cooperation and operational interaction of national authorities of safety, internal affairs, border troops, consular services, bodies of customs, immigration, medical, phytosanitary and veterinary control of the Parties is,
agreed as follows:
The agreement regulates procedure for departure of citizens of the State Parties of the Commonwealth of Independent States to the states which are not entering the Commonwealth of Independent States and entrance of citizens of the Parties from them, (further - Citizens of the Parties), through check points on sites of frontiers of the State Parties of the Commonwealth of Independent States with the states which are not entering the Commonwealth (further Borders).
For the purposes of this agreement the term Check point is understood as boundary transitions with the states which are not entering the Commonwealth, overland transport stations, and also the sea, river and air ports of the Parties opened according to the national legal system of the Parties for the international message and in which border, customs, immigration, medical, phytosanitary and veterinary control is performed.
After agreement signature of the Party will exchange lists of such Check points with indication of their name, the status, the mode of functioning in a month and will quickly inform each other on opening of new Check points or change of the status, the mode of functioning of operating points of the Omission.
Citizens of the Parties during stay in the territory of other Party in case of departure to the states which are not entering the Commonwealth, and entrance from them shall follow the legislation and rules of the state place of their stay.
Citizens of the Parties have the right to leave to the states which are not entering the Commonwealth and to drive from them through the Check points specified in Article 2 of this agreement, according to the valid and properly drawn up for trip abroad national foreign passports of the Parties or documents, them replacing (further - Documents).
Crossing by Citizens of the Sides of Borders through the Check points specified in Article 2 of this agreement will be performed according to the legislation and regulations regulating passport, customs, immigration, currency, quarantine and other formalities of that Party from which territory Citizens of the Parties leave to the states which are not entering the Commonwealth or on the territory of which they arrive from such state if other does not follow from the existing bilateral and multilateral agreements of the Parties.
The parties will exchange samples valid for departure to the states which are not entering the Commonwealth and entrance from them of documents and to provide each other necessary information on procedure for their issue and control methods on determination of authenticity of such documents. After the signature of this agreement each of the Parties in three-months time will determine procedure for issue of Documents to the citizens who are constantly living or temporarily being under contracts and contracts for the territories of the Parties.
After the signature of this agreement of the Party in three-months time will develop regulations on creation of the general information database and exchange of information on Citizens of the Parties, departure by which to the states which are not entering the Commonwealth it is closed according to the existing national legal system of the Parties.
The citizens of the Parties who arrived to the Check point from the states which are not entering the Commonwealth without necessary documents cannot be expelled back or transferred to the authorities of the states which are not entering the Commonwealth without the consent to it of the Party which citizens they are.
The order of interaction of competent authorities of the Parties in questions of content of Citizens of the Parties mentioned in part of 1 this Article, procedure for their documentation and transfer is regulated by the separate protocol which is integral part of this agreement and will be prepared as agreed by the parties.
Each of the Parties has the right to introduce temporary restrictions or to suspend this agreement or its part if these measures are necessary for safety of the Party, protection of public order or for the purpose of prevention of health hazard of the population of the Party.
About acceptance of such measures or about their cancellation each Party will be beforehand, but not later than thirty days before adoption of such decision, to inform other Parties through diplomatic channels. In the conditions of the emergency situation caused by social and economic, political, military, sanitary, ecological situation, the notification on such measures can be made in shorter time.
By mutual consent of the Parties according to provisions of the Vienna Convention "About the Right of International Treaties" of May 23, 1969 (Articles 39, of 40) can be made to this agreement additions and changes.
This agreement is signed for unrestricted term and becomes effective for the thirtieth day from the date of its signing. Each of the Parties has the right to leave this agreement, having notified on it in writing depositary in thirty days prior to expected date of exit.
