State Parties of the Agreement on collective security,
based on the Agreement on collective security of May 15, 1992 (further - the Agreement),
being guided by the conventional principles of international law,
wishing to provide necessary conditions for effective realization of the purposes and the principles of the Collective Security Treaty Organization (further - the Organization),
agreed as follows:
For the purposes of this agreement the stated below terms mean:
"Parties" - the State Parties of this agreement;
"state members" - state members of the Organization;
"Council" - the Council of collective security formed according to Chapter IV of Articles of organization;
"the state of stay" - state member in the territory of which the Secretariat of the Organization is located or its event is held;
"bodies of the Organization" - Council of collective security, Council of Foreign Ministers, the Council of Ministers of Defense, Committee of secretaries of the Security Councils of state members of the Organization;
"representatives of state members" - representatives of state members of the Organization, including heads and members of delegations, participating in the events held within the Organization;
"the plenipotentiary under the Organization" (further - the Envoy) the representative appointed by state member of the Organization according to its national legal system allocated by the state directing it necessary powers for activities for questions of the Organization and for work in the Permanent Council founded according to Chapter IV of Articles of organization;
"permanent mission of state member under the Organization" (Representation) - the mission of permanent nature headed by the Envoy sent by state member of the Organization for representation of its interests to the Organizations;
"premises of Representation" - buildings or their parts used for the purposes of representation, including the residence of the chief representative, and also the parcels of land relating to them, coma the property right to them belonged;
"staff of Representation" - the Envoy and members of personnel of Representation;
"members of personnel of Representation" - members of diplomatic staff, administrative technicians and service personnel of Representation;
"members of diplomatic staff" - the members of personnel of Representation having diplomatic rank;
"members of administrative technicians" - the members of personnel of Representation performing administrative maintenance of representation;
"members of service personnel" - the members of personnel of Representation who are carrying out obligations on servicing of Representation;
"Secretariat" - permanent working body of the Organization;
"Secretary general" - the highest administrative official of the Organization heading the Secretariat, appointed by Council;
"officials" are persons approved in the procedure established within the Organization for representation of state members of the Organization according to the quotas for positions assigned to each state member which list is determined by Council;
"employees" - persons working as specialists within the Organization on the basis of the contracts signed with them;
"premises of the Organization" - all rooms, buildings or part of buildings used for the official purposes of the Organization and provided to the Organization by the state of stay;
"members of families" - the spouse (spouse), minor children and persons which are dependent on the Secretary general, Envoys and other staff of Representations, officials and the staff of the Organization.
The organization uses in the territory of each state member the legal capacity necessary for realization of its purposes according to Articles of organization.
The property and assets of the Organization are inviolable. They use immunity from any form of administrative or judicial intervention, except as specified, when the Organization itself refuses immunity.
Premises of the Organization, and also its archives and documents, including office correspondence, regardless of the location, are not subject to search, requisition, confiscation or any other form of intervention.
Representatives of appropriate authorities and management of the state of stay cannot enter premises of the Organization differently, as with the consent of the Secretary general or person replacing it.
Execution of any actions according to the decision of appropriate authorities and managements of the state of stay can take place in premises of the Organization only with the consent of the Secretary general or person replacing it.
Premises of the Organization cannot serve as shelter for the persons pursued under the law of the either party or which are subject to issue to state member or the third state.
Immunity of premises of the Organization does not grant the right to use them for the purpose of, not the compatible to functions of the Organization or causing damage to safety Parties, to interests of their physical persons or legal entities.
The state of stay takes proper measures for protection of premises of the Organization against any invasion and causing damage.
The organization in state members is exempted from the direct taxes and charges, duties and other payments, except for those which are payment for specific types of servicing (services).
The objects and other property intended for official use by the Organization are exempted in state members from taxation by customs duties, taxes and the charges connected with it, except for charges for transportation, storage, customs clearance out of the places determined for this purpose or out of working hours of the relevant customs authority and service of this sort according to the procedure, provided for other international organizations. Their use in other purposes, including their sale or transfer to use, attract customs payment and accomplishment of other requirements according to the legislation of the state of stay.
Concerning the official means of communication the Organization uses at least favorable conditions, than those which are provided by the state of stay to diplomatic missions.
The organization can place flag, emblem or other symbolics of the Organization on the rooms occupied by it and to use them on office vehicles. Placement of symbolics of the Organization in other places is subject to approval of the state of stay.
