Agreement between the Government of the Russian Federation and Government of the Republic of Moldova on sci-tech cooperation

of October 8, 1996

The government of the Russian Federation and the Government of the Republic of Moldova which are hereinafter referred to as by the Parties

considering historically developed scientific and technical bonds between the Russian Federation and the Republic of Moldova,

wishing to develop and strengthen cooperation between two countries in science and technology, making thereby contribution to economic and social development of both countries,

being guided by the Agreement on sci-tech cooperation within the State Parties of the Commonwealth of Independent States of March 13, 1992 and the Agreement on creation of general scientific and technological space of the State Parties of the Commonwealth of Independent States of November 3, 1995,

agreed as follows:

Article 1.

The parties will help sci-tech cooperation on the basis of the principles of equality and mutual advantage, creating for this purpose necessary organizational, legal and financial and economic conditions.

Article 2.

The cooperation within this agreement will be performed in accordance with the legislation of the Russian Federation both the Republic of Moldova and contracts between the Parties.

Article 3.

The cooperation will be performed by the ministries, departments, research establishments, the scientific organizations and societies, higher educational institutions and the companies, and also the Russian-Moldavian financial and industrial groups.

Content of cooperation, its economic and organizational conditions will be approved by directly cooperating organizations on the basis of free standing agreements, agreements and contracts, including:

financing of cooperation;

protection of intellectual property;

use of results of joint research operations;

responsibility for accuracy of the information and quality of the materials and the equipment transferred in process of cooperation;

method of operation of scientific and technical objects and scientific equipment of joint use;

damage liability, put to any of participants of cooperation in case of accomplishment of joint operations;

conditions of sending of scientists and specialists.

Article 4.

The cooperation will be implemented in the following forms:

implementation joint scientific and technical programs and projects;

creation of the joint scientific and technical organizations, temporary research teams, and also the innovative companies providing development of the new equipment and technologies;

carrying out scientific works in the research organizations, higher educational institutions, technoparks, on industrial enterprises of other country, including joint field surveys and expeditions;

participation of scientists and specialists of other country in the scientific and technical developments which are carried out in the Russian Federation and the Republic of Moldova;

holding joint seminars, scientific conferences, working meetings and exhibitions.

The cooperation can be performed also in other mutually agreed forms.

Article 5.

The parties will promote ensuring access of scientists and specialists of both countries to the unique and latest experimental equipment, and also cooperation in case of its development, production and acquisition.

Article 6.

The parties will promote creating favorable conditions for stay in the territory of the country of scientists and specialists from other country, exchange of scientific devices and the equipment, scientific and technical documentation in case of accomplishment of joint surveys and developments.

Article 7.

The parties will develop cooperation in the field of scientific and technical information, to promote exchange of scientific and technical and scientific and pedagogical literature.

The scientific and scientific and technical information obtained during cooperation within this agreement can be available in case of mutual consent of the cooperating organizations to world scientific community.

Article 8.

For realization of cooperation within this agreement according to the mutual arrangement of his participants the organizations, organizations, scientists, specialists and experts from the third countries and the international organizations can be invited.

Article 9.

Protection and distribution of intellectual property rights to the results of joint operations received within cooperation on the basis of this agreement are performed in accordance with the legislation of the Russian Federation both the Republic of Moldova and agreements between the cooperating organizations.

Article 10.

For the purpose of coordination of joint surveys and developments, and also ensuring effective implementation of this agreement of the Party will create the Russian-Moldavian Commission on sci-tech cooperation (further - the Commission) which will be headed by heads of the State committee of the Russian Federation on science and technologies and the Ministries of Economics of the Republic of Moldova.

Within the Commission consultations concerning the state scientific and technical policy and economic legal regulation in this sphere, and also approval on this basis of the priority directions of bilateral sci-tech cooperation will be held.

The commission can use the different organizational forms of sci-tech cooperation meeting the requirements of efficiency and efficiency.

The commission will hold the meetings at least once a year serially in the Russian Federation and the Republic of Moldova.

The commission will develop the relevant provision for the organization of the activities.

Article 11.

This agreement does not affect the rights and obligations of the Parties following from other international treaties signed by them.
