Agreement between the Government of the Russian Federation and Government of Turkmenistan on mutual trips of citizens

of July 17, 1999

The government of the Russian Federation and the Government of Turkmenistan which are hereinafter referred to as with the Parties

being guided by desire of further development friendly and good-neighbourhood between two states,

aiming to enhance procedure for mutual trips of citizens on the basis of the principles of equality and mutual advantage,

agreed as follows:

Article 1

Citizens of the state of one Party drive, leave and move on the territory of the state of other Party according to the valid documents according to appendices 1 and 2 and on the conditions provided by this agreement.

Article 2

1. The citizens of the state of one Party who are owners of the valid diplomatic or service passports drive, leave and move on the territory of the state of other Party without visas. Specified persons can be in the territory of the state of other Party within 30 days, since date of crossing of border.

If citizens of the state of one Party (owners of diplomatic or service passports) intend to stay in the territory of the state of other Party more than 30 days, that diplomatic representation or consular establishment of the state which citizens these persons are sends inquiry for prolongation of term of stay of this person to the Ministry of Foreign Affairs of the state of stay which, in turn, gives the corresponding confirmation.

2. The citizens of the state of one Party who are the staff of diplomatic representation, either consular establishment, or other official representations, and also international organizations which are in the territory of the state of other Party and the having valid diplomatic or service passports of the state of one Party drive, leave and move on the territory of the state of other Party without visas for all term of official mission. The diplomatic representation of the state of one Party notifies the Ministry of Foreign Affairs of the state of other Party on arrival of these employees to place of employment.

3. The members of families living together with the employees specified in Item 2 of this Article, the having valid diplomatic or service passports (spouses, children, parents, grandsons, and also persons who are in their dependence), can be in the territory of the state of other Party without visas during all term of official mission of the employee.

4. Persons specified in Items 2 and 3 of this Article shall have the corresponding accreditation of the Ministry of Foreign Affairs of the state of stay.

Article 3

The citizens of the Russian Federation who are constantly living in the territory of Turkmenistan and the citizens of Turkmenistan who are constantly living in the territory of the Russian Federation, in the presence in the documents listed in appendices 1 and 2 to this agreement marks about permanent residence perform trips on the territory of the state of the nationality and return to the permanent address without visas according to the documents issued by competent authorities of the state of accommodation and proving the identity of the citizen of one state which is constantly living in the territory of other state.

Article 4

The citizens of the states of the Parties having double citizenship drive, leave and move on the territory of the states of the Parties without visas according to the valid national passports of the state of permanent residence and in the presence of the document confirming nationality of the state of other Party.

Article 5

The citizens of the states of the Parties who received the status of immigrants according to the Agreement between the Government of the Russian Federation and the Government of Turkmenistan on regulation of process of resettlement and protection of the rights of immigrants signed in Ashgabat on December 23, 1993 perform visa-free departure in case of resettlement on the territory of the state of other Party according to the valid national passports of the state of the Party of permanent residence and the document confirming availability of the status of immigrants.

Article 6

1. The visa-free procedure for crossing of borders of both states according to the documents listed in appendices 1 and 2 to this agreement for the following persons remains:

a) members of crews of aircrafts of civil aviation - according to the valid national passports and in the presence of entry in the general declaration (flight task);

b) members of crews of ocean and river crafts;

c) workers of train, refrigerator and locomotive crews of the railroads - according to the valid national passports and in the presence of travel route sheets;

d) employees of intergovernmental courier communication - according to the valid national passports and certificates of employees of intergovernmental courier communication;

e) persons making trips for assistance in case of natural disaster response, catastrophic crashes and epidemics;

e) the military personnel and civil personnel of the Ministry of Defence of the Russian Federation and the Federal Border Service of the Russian Federation which are part of task forces of the Ministry of Defence of the Russian Federation and the Federal Border Service of the Russian Federation in the territory of Turkmenistan and also members of their families;

military personnel of the Ministry of Defence of the Russian Federation, the Federal Border Service of the Russian Federation, staff of the Ministry of Internal Affairs of the Russian Federation, Federal Security Service of the Russian Federation, the judges and workers of offices of courts, prosecutors and employees of bodies of prosecutor's office of the Russian Federation following in business trip in task forces of the Ministry of Defence of the Russian Federation and the Federal Border Service of the Russian Federation in the territory of Turkmenistan including for investigation of the offenses made by the Russian citizens.

2. The subitem "e" of Item 1 of this Article is applied for validity between the Russian Federation and Turkmenistan about joint protection of frontier of Turkmenistan and the status of the military personnel of Border troops of the Russian Federation in the territory of Turkmenistan signed in Ashgabat on December 23, 1993 and also the Agreement between the Russian Federation and Turkmenistan on legal status and conditions of stay of parts of troops of air defense and the Air Force of the Russian Federation in the territory of Turkmenistan signed in Moscow on July 31, 1992.
