The Treaty of Accession of the Kyrgyz Republic to Agreements on the Customs union

of March 29, 1996

The State Parties of Agreements on the Customs union, of January 6 and 20, 1995 - The Republic of Byelorussia, the Republic of Kazakhstan and the Russian Federation, on behalf of their Governments, on the one hand, and the Kyrgyz Republic on behalf of its Government, on the other hand, hereinafter referred to as with Contracting Parties,

continuing implementation of the Agreement on creation of Economic union of September 24, 1993,

aiming at further development of the balanced and mutually beneficial economic relations,

confirming readiness to follow the principles, the purposes and tasks of the Customs union,

stating accomplishment by the Kyrgyz Republic of the Conditions of forming of the Customs union approved by the Intergovernmental Belarusian-Kazakhstan-Russian commission on November 22, 1995

agreed as follows:

Article 1.

The Kyrgyz Republic joins Agreements on the Customs union of January 6 and 20, 1995 and the decision of the Intergovernmental Belarusian-Kazakhstan-Russian commission of November 22, 1995 about conditions of forming of the Customs union.

Article 2.

Contracting parties assume in full the rights and obligations following from Agreements on the Customs union of January 6 and 20, 1995 and other existing documents in that as for the purposes, the principles and conditions, and also stages and the mechanism of forming and functioning of the Customs union.

Article 3.

Contracting parties taking into account accomplishment of obligations by the Kyrgyz Side on forming of single system of regulation of foreign economic activity, standardization of the foreign trade and customs legislation and establishment of single trade regime of the State Parties of the Customs union in the relations with the third countries introduce free trade regime in full without withdrawals and restrictions in trade and economic relations between the states by members of the Customs union - the Republic of Byelorussia, the Republic of Kazakhstan, the Russian Federation and the Kyrgyz Republic. At the same time all previous agreements and protocols between Contracting Parties concerning withdrawals from free trade regime are considered invalid.

Article 4.

This Agreement does not affect the right of any Contracting Party to acceptance according to international law and its domestic legislation of measures for protection of state security, public order, health and morality of the population, cultural and historical heritage of the people, protection of rare animals and plants.

Article 5.

Disputes and disagreements between Contracting Parties concerning interpretation and/or application of provisions of this agreement will be solved by consultations and/or negotiations.

Article 6.

This Agreement does not affect action of other international treaties of the State Parties of the Customs union which do not contradict this Agreement.

Article 7.

Each Contracting Party can stop the participation in this Agreement by the direction to other Contracting Parties of the formal written notice of the intention to withdraw from this Agreement in 12 months prior to the expected term of exit.

Article 8.

This Agreement is temporarily applied from the date of its signing and becomes effective from the date of the last notification on accomplishment in the Republic of Byelorussia, the Republic of Kazakhstan, the Russian Federation and the Kyrgyz Republic of the interstate procedures necessary for its entry into force.

It is made in Moscow on March 29, 1996 in one copy in Russian. The authentic copy is stored in Government archive of the Russian Federation. The Russian side will send to each state which signed this agreement, its verified copy.
