The agreement on the basic principles of frontier cooperation of the State Parties of the Agreement on deepening of integration in economic and humanitarian areas of March 29, 1996

of February 26, 1999

The government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Russian Federation and the Government of the Republic of Tajikistan which are hereinafter referred to as by the Parties

in view of that main objective of this agreement is strengthening and development of frontier mutual cooperation,

relying on close historical and cultural and ethnic ties of the population living in the territories of border regions

being guided by the principles of mutual advantage, respecting sovereignty and territorial integrity of the State Parties,

aiming to create favorable conditions for development of economic, scientific and technical, cultural, humanitarian cooperation between border regions of the Parties,

agreed as follows:

Article 1

The basic concepts used in this agreement:

the border region - the region within administrative or other state territorial educations which administrative-territorial borders match with the line of frontier of the State Parties of this agreement;

the population of border regions - the citizens of the states of the Parties who are constantly living in the territory of border regions;

governing body of the region - the regional state body formed according to the administrative-territorial structure of the state;

cooperation of border regions - the coordinated actions of state bodies, business entities, public organizations and the population of the Parties directed to strengthening and development of the relations between border regions;

traditional economic activity - the activities of the border population which historically developed for a long time and business entities of the State Parties.

Article 2

The parties will promote processes of expansion and development of integration between border regions of the State Parties of this agreement, to establishment of mutually advantageous bonds.

Each of the Parties taking into account mutual interests will make efforts for the solution of the legal, administrative or technical issues complicating movement within border regions of citizens, goods and services, elimination of other possible obstacles for development of frontier cooperation according to the national legal system of the states.

Article 3

The cooperation of border regions will be performed on the basis of two and multi-lateral agreements (agreements) between state bodies of management of regions, different business entities signed within the competence with observance of regulations of national legal systems and provisions of international treaties.

Article 4

Each of the Parties, for the purpose of creating favorable conditions for strengthening and development of cooperation of border regions, provides in the territories which are under its jurisdiction, national treatment to the population of border regions of the state of other Party on questions:

- temporary residence;

- occupations traditional economic activity;

- education and medical services;

- occupations small business.

Article 5

The parties for the purpose of effective use of economic capacity of border regions will create favorable conditions for activities of joint businesses in the different forms of business provided by the national legal system of the states of the Parties.

Article 6

The parties will take the measures for support of producers of goods and services of border regions of the State Parties providing:

providing with information on market situation;

creation of the automated system of search of partners in interregional economic bonds;

provision at the request of information and the legislation of the State Parties of this agreement;

organization of exhibitions, fairs and advertizing of goods of local production;

creation and development of system of communications.

Article 7

For the purpose of investment attraction, deepenings of economic integration and the accelerated development of border regions of the Party jointly will study economic and legal opportunities of creation in their territories of different types of the free economic zones (FEZ) and zones of border trade and will make agreed decisions.

Article 8

The parties will take measures for simplification for the population of border regions of the State Parties of procedures passport, customs, immigration, other types of control, and for this purpose authorized state bodies of the Parties will sign among themselves the relevant agreements.

Article 9

The parties will promote the joint decision border regions of questions of market development of transport services, joint operation of transport communications and infrastructure, providing favorable conditions for implementation of transportations of passengers and loads by vehicles.

Article 10

The parties, will promote carrying out in border regions of the State Parties approved industrial and; the agrarian policy based on the cooperation, specialization and regional labor division providing effective use of natural and production resources.

The parties will promote realization of the joint interregional investing programs aimed at the development of production of agro-industrial complex and industrial output, competitive in the world markets.

Article 11

For the purpose of effective use of the border regions of energy resources and uninterrupted providing their population which are available in the territories electro-, heat power and different types of energy carriers. The parties will promote market development of energy carriers within the Agreement on interaction of power systems between the State Parties of the Agreement of the March 29, 1996 signed on November 24, 1998.

Article 12

The parties will promote border regions in the joint solution of the questions connected with environmental protection, rational use of natural and water resources, construction of Items of sanitary and epidemiologic control and quarantine of plants in places of boundary transitions, rendering mutual aid in emergency situations, to promote implementation of regional ecological programs.

Article 13

The parties will promote development of cooperation between border regions in scientific and technical, cultural, humanitarian areas:

to holding joint cultural sporting events;

to ensuring distribution in the territory of teleradio programs and periodicals;

to exchange of teachers and students;

organizations of carrying out joint research operations for urgent problems;

to establishment of contacts between medical institutions for rendering mutual aid, the organization of consultations of specialists and exchange of information on medicine problems.
