About providing the free and equal right of crossing of borders of the State Parties of the Customs union by physical persons and free movement by them of goods and currency

The government and National Bank of the Republic of Belarus, the Government and National Bank of the Republic of Kazakhstan, the Government and National Bank of the Kyrgyz Republic and the Government and the Central Bank of the Russian Federation which are referred to as further with the Parties

being guided by the Statement of heads of the State Parties of the Customs union "About ten simple steps towards to simple people",

confirming commitment to liberty principles and the equal rights of movement of citizens within general customs border of the Customs union,

considering priority task of removal of distinctions in the conditions of movement of goods and currency by the physical persons who are constantly living in the territory of the State Parties of agreements on the Customs union

agreed as follows:

Article 1

This agreement determines procedure and conditions:

- free crossing by the physical persons who are constantly living in the State Parties of the Customs union including temporarily being beyond their limits (further - physical persons), frontiers between the State Parties of the Customs union;

- movements by physical persons through customs borders between the State Parties of the Customs union of the goods which are not intended for productive or other business activity;

- movements of currency by physical persons.

Article 2

The parties in two-month time after entry into force of this agreement will take measures for the organization at check points on frontiers, and also in air international ports through which are performed air traffic between the State Parties of the Customs union, movement of physical persons and their goods in the priority, simplified procedure, including, if necessary, creation of special "corridors".

Article 3

The parties are determined that the basis of the omission of physical persons in the priority, simplified procedure is availability of the existing documents confirming the fact of their permanent residence in the territory of one of the State Parties of agreements on the Customs union.

The omission of physical persons in the priority, simplified procedure includes implementation of border (passport) control (verification of documents) which is made according to national legal systems of the State Parties.

Article 4

The goods moved with physical persons in the priority, simplified procedure are exempted from declaring in writing except as specified when reasons to believe are had that person moves goods which import and export is prohibited or limited by national legal systems of the State Parties, taking into account provisions of Article 6 of this agreement.

Article 5

The goods coming from the State Parties of the Customs union are passed through their internal customs borders without restrictions on weight, quantity, cost and declaring in writing, collections of customs payments, taxes and fees, except for customs duties for storage.

Provisions of this Article do not extend to the goods prohibited or limited to import/export according to national legal systems of the State Parties of the Customs union.

Article 6

The goods coming from the third countries are passed through customs borders of the State Parties of the Customs union, without declaring in writing, collections of customs payments and charges for customs clearance provided that their total cost does not exceed the amount, equivalent 1000 US dollars, within total weight of baggage to 50 kg on one person.

Article 7

Movement foreign and national currencies of the State Parties of the Customs union in single customs area of the State Parties of the Customs union is performed without restrictions.

The specified currencies move in single customs area of the State Parties of the Customs union without declaring in writing, except as specified their declaring at own will of physical person.

Movement of national currencies of the State Parties of agreements on the Customs union through their external customs borders is performed according to the procedure, established by the national legal system of that state for which the exported currency is national.

Article 8

The parties agreed that before creation of single customs area of the State Parties of the Customs union physical persons have the right freely without declaring in writing and submissions of the allowing documents which are the basis for export of cash foreign currency to one-timely import/export through internal and external customs borders of the State Parties of the Customs union cash foreign currency in the amount equal and not exceeding in equivalent of 3000 US dollars.

In case of import/export by physical person through internal and external customs borders of the State Parties of the Customs union of the cash foreign currency exceeding in equivalent of 3000 US dollars the procedure established by the legislation of the State Party of the Customs union in which, whom such currency is imported/is exported is effective. At the same time the customs declaration which is drawn up by customs authority when importing of cash foreign currency by physical person to the participating state of the Customs union is good cause for its export from this state (within the amount specified in the declaration).

Article 9

Before creation of single customs area of the State Parties of the Customs union movement of national currencies of the State Parties of the Customs union through their customs borders is performed according to the procedure, established by the legislation of the State Party of the Customs union from which, which the currency is exported/is imported.

In process of change of economic situation in the State Parties of the Customs union of the Party can establish other approved regulations of import/export of cash foreign currency by physical persons through internal and external customs borders of the State Parties of the Customs union.

Behind each State Party of the Customs union the right to establish, in case of critical condition of paying balance, other regulation of the maximum export from customs area of the state by one physical person of currency of the third states and national currency remains. This state informs other participating states of the Customs union on establishment of such regulation.

Article 10

The parties will provide implementation of information and explanatory measures for the population, including information on procedure for movement of goods and currency through customs borders of the State Parties of the Customs union, about regulations of duty-free movement of goods, regulations of free movement of currency.
