The government of the Republic of Belarus and the Government of the Russian Federation, on the one hand, and the Government of the Republic of Kazakhstan, on the other hand, hereinafter referred to as "Contracting parties",
aiming at further development of the balanced and mutually beneficial economic relations, expressing intention to continue implementation of the Agreement on creation of Economic union of September 24, 1993,
wishing to start forming between them the Customs union, agreed as follows:
Contracting parties create the single Customs union, the purposes and the principles of forming, the mechanism and stages of creation which procedure for functioning, and also distribution of customs duties, taxes and fees, conditions of introduction of temporary restrictions and customs control are determined by the Agreement on the Customs Union between the Russian Federation and the Republic of Belarus of January 6, 1995.
Contracting parties assume in full the rights and obligations following from the Agreement on the Customs union between the Russian Federation and the Republic of Belarus of January 6, 1995 in that, as for the purposes, the principles of functioning, the mechanism and stages of creation of the Customs union, distribution of customs duties, taxes and fees, conditions of introduction of temporary restrictions, customs control.
At the same time regulation of foreign economic activity of the Republic of Kazakhstan will be performed according to the Agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on single procedure for regulation of foreign economic activity of January 20, 1995.
For the purpose of implementation of this agreement Contracting Parties on the basis of the free standing agreement will create executive body of the Customs union.
Contracting parties before creation of executive body of the Customs union will be guided by provisions of the Agreement between the Government of the Russian Federation and the Government of the Republic of Belarus of January 6, 1995.
Contracting parties agreed that integral parts of this agreement are the Agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on single procedure for regulation of foreign economic activity of January 20, 1995 and the Protocol on introduction of free trade regime without withdrawals and restrictions between the Russian Federation and the Republic of Kazakhstan of January 20, 1995.
This agreement does not affect the right of any Contracting Party to acceptance according to international law and its domestic legislation of the measures necessary for protection of state security, public order, health or morality of the population, cultural and historical heritage of the people, protection of rare animals and plants.
Disputes and disagreements between Contracting Parties concerning interpretation or application of provisions of this agreement will be solved by consultations.
This agreement does not affect action of other international treaties of the Republic of Belarus, the Russian Federation and the Republic of Kazakhstan which do not contradict this agreement.
Each Contracting Party can stop the participation in the Agreement by the direction - the formal written notice to other Contracting Party about the intention to leave the Agreement in 12 months prior to exit.
This agreement is temporarily applied from signature date and becomes effective from the date of the last notification on accomplishment in the Republic of Belarus, the Russian Federation and the Republic of Kazakhstan of the interstate procedures necessary for its introduction in force.
It is made in Moscow on January 20, 1995 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Russian Federation which will send to each state which signed this agreement, its verified copy.
