This Law regulates legal, economic and organizational basis of fishery of the Kyrgyz Republic for the purpose of its every possible development, preserving and increase in fish inventories, increase in ryboproduktivnost of reservoirs and ponds, the most complete requirements satisfaction of the population in fish products.
Fishery - the system of fish breeding, fishery, reproduction and protection of fish inventories directed to improvement of specific structure of fish inventories of reservoirs and ponds, and also ensuring activities of rybokhozyaystvuyushchy subjects irrespective of their patterns of ownership, on cultivation of commodity fish, landing and breeding material, production, its protection and conversion.
This Law governs the relations arising in case of ownership, use and the order of natural and artificial inventories of fish in fishery reservoirs and reservoirs public of the Kyrgyz Republic.
Natural inventories of fish in the reservoirs of any category which are in the territory of the Kyrgyz Republic are property of the Kyrgyz Republic.
Fishery reservoirs - reservoirs which are used or can be used for trade fishery or the artificial reservoirs built especially for fish breeding matter for preserving and reproduction of inventories of food fishes, and also.
General use reservoirs - the rivers, lakes, ponds, water storage basins and their adnexal waters, except for reserved sites, intended for the organization of amateur and sports fishing.
Shall be provided with Rybokhozyaystvuyushchy subjects irrespective of patterns of ownership when maintaining fishery:
- capability of fish to reproduction;
- preserving performance of reservoirs;
- protection of the habitat, conditions of reproduction and ways of migration of fishes;
- prevention of undesirable changes in water ecosystems in case of artificial fish farming (further - fish breeding);
- effective and rational use of the pond areas for cultivation of commodity fish of landing and breeding material.
Are subject to maintaining the Government of the Kyrgyz Republic in the field of regulation of the relations on use and protection of fish inventories:
- the order fish inventories on fishery reservoirs of the state value and reservoirs public, establishment of procedure for their use and protection;
- organization of development and approval of programs of carrying out single fishery policy;
- determination of the main user of fishery reservoirs of the state value;
- approval of regulations on specially authorized state body of management of fishery.
Lakes Issyk Kul, Son-Kul and water storage basins Toktogul, Bazar-Korgonsky, Kirov, Orto-Tokoysky belong to fishery reservoirs of the state value.
The lake Issyk Kul is reservoir of the state value with the water area protected by the legislation of the Kyrgyz Republic where amateur and sports fishery, tourist activities, work of water transport, with prohibition on cultivation and incubation of iridescent trout and the predatory species of fish delivered from the outside are permitted.
According to the decision of the Government of the Kyrgyz Republic other reservoirs also can be carried to fishery reservoirs of the state value.
Specially authorized state body of management of fishery pursues single state policy in the field of development and maintaining fishery, performs the organization of fishery and reproduction of fish inventories, and also departmental protection of fish inventories.
The state body of environmental protection of the Kyrgyz Republic exercises the state control of protection and use of fish inventories and the circle of their dwelling.
In the reservoirs which are in non-state property the owner of reservoir disposes of inventories of fish.
Fish inventories, and also the fishes who are grown up in artificial reservoirs are subject to accounting which is made separately on reservoirs and species of fish in the procedure established by the legislation.
The subjects who are engaged in fishery shall provide annually to state bodies of management of fishery inventory information of fish resources and amounts of their production.
The disputes connected with use of fish inventories of reservoirs and their protection are permitted judicially according to the current legislation of the Kyrgyz Republic.
Fishery reservoirs or their sites can be provided in use to legal entities and physical persons for the purpose of fishery or fish breeding.
The procedure, rules and conditions of conducting production of fish inventories and fish breeding, provision in use of fishery reservoirs or their sites, protection of fish inventories and the circle of their dwelling are regulated by the provisions approved by the Government of the Kyrgyz Republic.
Legal entities and physical persons on the fixed reservoirs or their sites shall perform fishery conservation and fish-breeding and meliorative actions for improvement of condition of reservoirs and conditions of reproduction of fish and other water organisms, to carry out works on reproduction of food fishes, and also to contain coastal sites of fishery in proper sanitary condition
The procedure for the organization and conducting amateur and sports fishery is established by Regulations on the amateur and sports fishery approved by the Government of the Kyrgyz Republic."
In use for fishing activities the specialized fishery subjects who are engaged in production and cultivation of fish have the privilege to receipt of reservoir, its sites.
The main user of reservoir shall provide reservoir for implementation of fishery in the scientific purposes.
