The agreement between the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Republic of Tajikistan and the Government of the Republic of Uzbekistan on cooperation in the field of quarantine of plants

The government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Republic of Tajikistan and the Government of the Republic of Uzbekistan which further are referred to as with the Parties

recognizing importance of cooperation in prevention of delivery and distribution of quarantine objects,

being guided by desire to continue and expand cooperation in the field of quarantine of plants and to provide coordination of the governmental quarantine activities;

proceeding from interests of mutual protection of the territory from drift and distribution of quarantine objects during the implementing of contracts and development of economic and commercial intercourses between the Parties,

agreed as follows:

Article 1

In this agreement the provided terms have the following value:

quarantine objects - types of wreckers, causative agents of diseases of plants and weeds which are absent or restrictedly are extended to the territories of the states of the Parties, but can do considerable harm to plants or vegetable products;

quarantine materials - any materials which promote or by means of which quarantine objects can extend (seeds, landing material, plants and their parts, other products of plant origin);

quarantine of plants - the activities directed to the prevention of introduction and/or distribution of quarantine harmful organisms or to ensuring official fight against them.

Article 2

The competent authorities of the Parties performing coordination of sales activity of this agreement are:

from the Republic of Kazakhstan - the Ministry of Agriculture through Department of protection and quarantine of plants;

from the Kyrgyz Republic - the Ministry of agricultural and water economy through the State inspectorate for quarantine of plants;

from the Republic of Tajikistan - the Ministry of Agriculture through the State inspectorate for quarantine of plants;

from the Republic of Uzbekistan - the Ministry of agricultural and water economy through the Main state inspectorate for quarantine of plants.

Competent authorities of the Parties establish direct connection for the purpose of accomplishment of this agreement, and also have the right to sign mutual agreements, to jointly carry out procedures of implementation of the phytosanitary measures harmonized with the international requirements.

Article 3

The parties will hold necessary events for quarantine check of quarantine materials when importing, exporting and transit through Items on quarantine of plants on borders of the states of the Parties according to lists of the quarantine objects determined by the joint decision of competent authorities of the Parties.

Expenses on quarantine check of quarantine materials are incurred by the owner of load on the rates accepted in the territory of the Parties.

Article 4

The parties shall follow the phytosanitary rules on import, export and transit of the quarantine materials directed from the territory of the state of one party to the territory of the state of other Party approved according to the national legal system of the states.

Article 5

For the purpose of ensuring effective cooperation in the field of quarantine of plants, the Party shall:

take necessary measures for prevention of penetration of quarantine objects from the territory of one Party on the territory another when importing, exporting and transit;

exchange the legal acts regulating actions for quarantine of plants in their territory not later than two months from the date of their publication;

it is mutual to communicate about research works, editions in their countries in special magazines, monographs and important publications in the field of quarantine of plants;

exchange specialists by their sending for the purpose of implementation by them to selective quarantine check of quarantine materials for the purpose of production, procurement, the operational solution of questions of quarantine of plants on border check-points, and also for the purpose of studying of practical experience in the field of quarantine of plants.

Article 6

Each batch of the quarantine material made in the territories of the states of the Parties, imported or going as transit goods shall be followed by the phytosanitary certificate issued by service on quarantine of plants of the exporting country of which makes sure that quarantine material meets the phytosanitary requirements imposed by the importing party.

Export and transit of seed and landing material, and also re-export of quarantine materials irrespective of country of source is allowed accompanied by the phytosanitary certificate and the quarantine import permit of the importing party.

Expenses on issue of the phytosanitary certificate and quarantine import permit are born by the owner of load on the rates accepted in the state.

Competent authorities of the Parties reserve the right when purchasing job lots of quarantine material to expose additional terms on phytosanitary condition of such materials. In these cases preliminary control when exporting quarantine materials can be exercised in the territory of the exporting country together with quarantine inspectors of the Parties.

When carrying out joint phytosanitary control specialists of services of quarantine of plants shall be guided by the legal acts and requirements harmonized with the international agreements and accepted in their states.

The party accepting specialists of quarantine service of other Party provides them with service premises, the laboratory equipment and other materials for carrying out phytosanitary works on condition of observance of safe engineering of work.

The procedure and other requirements of joint phytosanitary control determine competent authorities of the Parties according to the reached agreement in each separate case.

Article 7

Availability of the phytosanitary certificate does not exclude the right of each of the Parties to carry out quarantine inspection of loads according to phytosanitary requirements of the state.

The parties determine in the territories of the states border check-points through which export, import, transit of quarantine materials for the purpose of their check and prevention of penetration of quarantine objects is performed.

Article 8

When exporting quarantine material sawdust, paper, plastic and other materials which shall be free from the soil will be applied as packaging material of shaving, and hay, straw, chaff, leaves will not be used for this purpose without prior consent competent authorities of the Parties.

The vehicles used by one Party for transportation of quarantine material on the territory of other Party shall be cleared and if necessary are disinfected.
