The agreement between the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Republic of Uzbekistan on regulation of tariff policy in the field of rail transport

The government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Republic of Uzbekistan which are hereinafter referred to as - the Parties,

being effective according to the Contract on creation of the Common economic space between the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan of April 30, 1994 and the Agreement between the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Republic of Uzbekistan on carrying out coordinated policy in the field of transport and communications of April 5, 1995;

relying on the reached level of economic interaction between the State Parties;

recognizing need of application of the approved tariff policy for ensuring sustainable development of economy of the State Parties;

wishing to eliminate obstacles in effective transport service of the Common Economic Space, free movement of goods, services, labor power and the capitals;

understanding importance and need of carrying out mutually acceptable actions for ensuring efficiency of transportation of goods and passengers,

agreed as follows:

Article 1

Each of the Parties will provide within current laws and edited the free omission of railway vehicles, cargo transportation on the railway system which is in the territory of the State Parties including en route, to the third countries, and also will provide the omission of the cars and locomotives going in planned types of repair which transportation is drawn up by the relevant accompanying documents.

Article 2

The parties charge to railway administrations:

- apply the approved, economically reasonable, end-to-end tariff charges in all types of transport in the interstate message;

- proceeding from economic interests of the railroads to consider the possibility of application of reduced rates in case of transit transportation of goods with execution of the relevant agreements.

Article 3

The parties reserve the right of independent and independent determination of forms and conditions of tariff policy with the third countries.

Article 4

As the first-priority measures directed to realization of tariff policy in the interstate message, the Parties pursue the customs policy promoting simplification of conditions of cargo transportation.

Article 5

Change acting and introduction of the new regulating documents regulating rail activity and infringing on interests of the Parties are performed by all Parties under approval.

Article 6

The parties consider necessary rendering the state support to development of rail transport of the State Parties.

Article 7

Each of the Parties will refrain from the actions capable to cause damage to interests of other Party, will create favorable conditions for preserving technological unity of railway systems and realization of the principles of this agreement.

Article 8

This agreement can be changed or added by mutual consent of the Parties.

The matters of argument connected using or interpretation of this agreement, are permitted by consultations and negotiations of concerned parties.

Article 9

This agreement is signed for a period of five years and will be prolonged automatically for the next five-year periods if the Parties do not make other decision.

This agreement becomes effective from the moment of its signing.

Each of the Parties has the right to stop the participation in the Agreement, having in writing notified on it depositary at least in six months.

It is made in the city of Almaty on August 7, 1997 in one authentic copy in Russian.

The authentic copy is in Executive committee of Interstate Council of the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan which sends its verified copy to each State Party.
