Council of heads of Customs Services under Integration Committee of EurAsEC, having heard information of the State Customs Committee of the Russian Federation on Standard recommendations of responsibility of the railroads to customs authorities and interaction in case of search of not delivered goods,

DECIDED:

1. Accept Standard recommendations of responsibility of the railroads to customs authorities and interaction in case of search of not delivered goods (are applied).

2. To Customs Services of the Parties to be guided by the made Standard recommendations when implementing customs clearance and customs control of the goods moved with railway mode of transport.

Standard recommendations of responsibility of the railroads to customs authorities and interaction in case of search of not delivered goods

The made Standard recommendations are developed according to provisions of Bases of customs legislations of the State Parties of the CIS of February 10, 1995 for the purpose of standardization of requirements for responsibility of the railroads to customs authorities.

1. The railroads participating in transportation of goods under customs control bear responsibility to customs authorities for the goods accepted for shipment including customs payment.

2. Goods under customs control are transported by the railroads without any change of their packaging or condition, except changes owing to natural wear or transportations and storages, without use in any other purposes, except delivery, along the established routes to the place determined by customs authority, in the terms established by customs authority according to regular delivery dates proceeding from opportunities of the vehicle, the established route and other conditions of transportation decreased under normal conditions.

3. The railway station at which transportation of goods under customs control without fail begins puts down the stamp of the station certified by the signature of the ranking officer of the station in customs papers.

4. When transporting goods under customs control by railway transport customs papers on all transit of load are put to the rail waybill. At the same time customs authorities require submission without fail of the transport or shipping documents allowing to identify the transported goods for the purposes of customs control.

5. The railroad according to the national legal system bears responsibility for loss of customs or other papers on the goods which are under customs control.

6. In case of not delivery of the goods moved under customs control, the customs authority together with administration of the national railroad undertakes measures for search of the specified goods. By results of search actions the railroad because of which there was not delivery (loss) of goods and documents on them can be made responsible according to the national customs legislation.
