The protocol on single approaches in use of information technologies in case of customs control over movement of goods and vehicles through borders of state members of Eurasian economic community

The State Customs Committee of the Republic of Belarus, Customs committee of the Ministry of state revenues of the Republic of Kazakhstan, the State customs inspection under the Ministry of Finance of the Kyrgyz Republic, the State Customs Committee of the Russian Federation and Customs committee under the Government of the Republic of Tajikistan which further are referred to as with the Parties, recognizing need of simplification of international carriages as all modes of transport by electronic exchange of declarations and data on the goods moved through borders of state members of Eurasian economic community (EurAsEC);

recognizing international standards of development of information technologies, in particular standard rules of new edition of the International convention about simplification and harmonization of customs procedures;

based on the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998;

intending:

accelerate and facilitate movement of goods through the territories of state members of EurAsEC;

ensure safety of transportations of goods;

prevent illegal movement of goods,

agreed as follows:

Article 1

In the this Protocol the concepts established by the Bases of customs legislations of the State Parties of the Commonwealth of Independent States accepted by the decision of Council of heads of states of the Commonwealth of Independent States on February 10, 1995 are used.

For the purposes of the this Protocol the term "information technologies" is understood as set of computer aids and telecommunications, software and methods of their use for search, processing, storage, transfer and receipt of information.

Article 2

The parties will aim at development and use of information technologies which promote electronic exchange of information between state members of EurAsEC about movement of goods and vehicles through borders of Community.

Article 3

The single procedure for use of information technologies of customs control determines the list of the data which are subject to electronic exchange, standards of exchange of information, prototype methodical and technology solutions of development of information technologies.

Article 4

In case of development of information technologies of the Party will aim at observance of provisions of new edition of the International convention on the simplification and harmonization of customs procedures of World Customs Organization (The Kyoto convention, edition of 1999).

Article 5

Information technologies of the Parties provide information security according to the legislation of the states of the Parties on information, informatization and information security.

Article 6

Each of the Parties has the relevant division for work on electronic exchange of information.

Article 7

The disputes and disagreements concerning interpretation and application of the this Protocol are permitted by consultations and negotiations between the Parties.

Article 8

Under mutual written approval between the Parties in the this Protocol changes and additions which are drawn up by stand-alone programs to the this Protocol and being its integral part can be made.

Article 9

After entry into force the central customs authority of any state which joined agreements on the Customs union, recognizing the provisions of the this Protocol operating at the time of accession, and expressing readiness to carry out them in full can join the this Protocol. Accession is performed with the consent of the Parties, on conditions and according to the procedure, determined in the separate Protocol with the joining central customs authority.

Article 10

The this Protocol becomes effective after 30 days from the date of its signing. The either party can leave the this Protocol, having sent to the Secretariat of Integration Committee of Eurasian economic community which is depositary of the this Protocol, the written notice of the intention at least for three month to exit previously having settled obligations assumed according to the this Protocol.

It is made in ______________ "______" _________________ 2001 in one authentic copy in Russian. The authentic copy of the Protocol is stored in the Secretariat of Integration Committee of Eurasian economic community which will send to each Party its verified copy.
