The Russian Federation, the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan constituting the Joint Party, and People's Republic of China, which further are referred to as with the Parties

considering that maintenance and development of the long-term relations of neighborliness and friendship are equitable to radical interests of five states and their people,

being convinced that safety strengthening, preserving tranquility and stability around border between Russia, Kazakhstan, Kyrgyzstan, Tajikistan, on the one hand, and China, on the other hand, further referred to as with the region of border, are important contribution to peacekeeping in Asia-Pacific region and around the world,

confirming mutual nonuse of force or threats of force, refusal of aspiration to receive unilateral military superiority,

according to the Agreement between the Government of the Union of Soviet Socialist Republics and the Government of People's Republic of China on the guidelines of mutual reducing armed forces and enforcement of trust in military area around the Soviet-Chinese border of April 24, 1990,

aiming on the basis of the principle of mutual equal safety to reduce the armed forces deployed around border between Russia, Kazakhstan, Kyrgyzstan, Tajikistan and China to the minimum level answering to the relations of neighborliness and friendship between Russia, Kazakhstan, Kyrgyzstan, Tajikistan and China to give to the armed forces remaining around border, exclusively defensive nature

in development of the Agreement between the Russian Federation, the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan and People's Republic of China about enforcement of trust in military area around border of April 26, 1996

agreed as follows:

Article 1

For the purposes of this agreement the following terms are applied:

1. "Staff" means the staff of land forces, the Air Force which is on active duty, aircraft of air defense (air defense) and border troops (boundary parts).

2. "Border troops (boundary parts)" means the parts and divisions which are carrying out tasks on protection of frontier excepting the parts and divisions exercising border control at check points through border.

3. "The fighting tank" means the self-propelled armored fighting vehicle having high passability on the cross-country terrain and armored protection, armed with the caliber gun at least 75 mm having angle of rotation of 360 degrees and capable to hit armored and other targets.

4. "Armored combat vehicle" means the track laying or wheel fighting vehicle having high passability and armored protection, intended for transportation of fighting shooting (infantry) department for conducting mobile fighting. Armored personnel carriers and infantry fighting vehicles belong to armored combat vehicles.

5. "The artillery system" means self-propelled and not self-propelled artillery piece of caliber of 122 mm and above. And above guns, howitzers, tools combining properties of guns and howitzers, mortars and reactive systems of volley fire belong to artillery systems of caliber of 122 mm.

6. "The launcher of tactical missiles" means the device intended for content, preparation for start-up and missiles launch with range to 500 km.

7. "Warplane" means the airplane equipped with the managed and uncontrollable rockets, bombs, machine guns, aviation guns and other arms applied to defeat of the purposes in operational and tactical depth. "Warplane" does not include the educational and training airplanes used at the initial stage of training.

8. "The airplane of air reconnaissance and radio-electronic fight (REB)" means the airplane which is specially designed (re-equiped) and equipped with the equipment intended for conducting air reconnaissance and radio-electronic fight.

9. "The fighting helicopter" means the fighting rotary-wing aircraft intended for defeat of land and air targets. Shock helicopters and helicopters of fighting providing belong to fighting helicopters:

1) "The shock helicopter" means the helicopter equipped for use of anti-tank guided missiles, guided missiles of the class "air-to-ground" or "air-air" and equipped with complex system on management of firing and targeting of weapon.

2) "The helicopter of fighting providing" means the helicopter armed with machine gun, the gun and uncontrollable rockets, bombs or bombing cartridges and capable to carry out such fighting tasks as defeat and suppression is more whole.

10. "The fighting river ship of the Navies (Naval Forces)" means the ship intended for conducting combat operations and equipped with systems of arms.

11. "The place of reducing" means the place where reduction of armaments and military equipment according to this agreement is performed.

12. "East site" means East part of frontier between Russia and China.

13. "The western site" means the Western part of frontier between Russia and China, and also frontiers between Kazakhstan, Kyrgyzstan, Tajikistan and China.

Article 2

The armed forces of the Parties deployed in the region of border as component of armed forces of the Parties will not be used for attack on other Party, to conduct any military activities menacing to other Party and breaking tranquility and stability around border.

Article 3

1. The parties will reduce and will limit the number of staff and quantity of main types of arms and military equipment of land forces, the Air Force and aircraft of air defense deployed in geographical limits of application of the Agreement and will establish for them limits.

2. Warplanes of aircraft of air defense are set off in limit of the warplanes remaining after reducing.

3. For border troops (boundary parts) located in geographical limits of application of the Agreement, the Parties establish limit on the number of their staff and quantity of arms and military equipment.

4. The parties will not place the fighting river ships of the Navies (Naval Forces) in geographical limits of application of the Agreement.

5. From the date of the introduction of this agreement in force and before completion of the period of reducing the Party do not transfer the staff, arms and military equipment which are subject to reducing and restriction according to this agreement to other types of armed forces which do not fall under reducing and restriction under this agreement, or in border troops (boundary parts) deployed in geographical limits of application of the Agreement.

Article 4

1. Geographical limits of application of the Agreement is the geographical area located on depth in 100 kilometers on both sides from the line of border between Russia, Kazakhstan, Kyrgyzstan, Tajikistan, on the one hand, and China, on the other hand.

2. As sensitive areas the certain areas limited on the area in geographical limits of application of the Agreement are allocated. On East site from the Russian side is Khabarovsk sensitive district and the Vladivostok sensitive district.

In the above-stated sensitive areas the staff number, quantity and categories of arms and military equipment of the armed forces and border troops which are subject to reducing and restriction according to this agreement join in the limits provided by this agreement.

Concerning being in sensitive regions of staff, arms and military equipment of the armed forces and border troops which are subject to reducing and restriction according to this agreement, inspection on site is not carried out.

3. Specific regulations on geographical limits of application of the Agreement and sensitive areas contain in the Protocol on geographical limits of application of the Agreement.

Article 5

1. After the term of the reducing determined in this agreement, the limit of staff of land forces, the Air Force and aircraft of air defense remaining for each of the Parties in geographical limits of application of the Agreement will not exceed 130,4 of one thousand people, including in land forces - 115,4 of one thousand people, in the Air Force - 14,1 of one thousand people, in aircraft of air defense - 0,9 of one thousand people.

The limit of staff for East site will not exceed 119,4 of one thousand people, including in land forces - 104,4 of one thousand people, in the Air Force - 14,1 of one thousand people, in aircraft of air defense - 0,9 of one thousand people.

The limit of staff for the Western site will not exceed 11 thousand people, including in land forces - 11 thousand people, in the Air Force - 0 people, in aircraft of air defense - 0 people.

2. From the date of the introduction of this agreement in force the limit of number of staff of border troops (boundary parts) for each of the Parties in geographical limits of application of the Agreement will not exceed 55,0 of one thousand people, including for East site - 38,5 of one thousand people, for the Western site - 16,5 of one thousand people.

3. For planned replacement of staff in geographical limits of application of the Agreement of the Party have the right to temporary exceeding of the staff number levels established by this agreement. When carrying out planned replacement of Staff once a year temporary excesses constitute no more than 35 percent and are limited for a period of 90 days. When carrying out replacement two times a year temporary excesses constitute no more than 30 percent and are limited for a period of 90 days in each case.

4. The parties mutually inform each other on temporary exceeding of limits on staff number according to the Protocol on exchange of information.

Article 6

1. The following categories of arms and military equipment are subject to reducing and restriction according to this agreement: fighting tanks, armored combat vehicles, artillery systems, launchers of tactical missiles, warplanes, fighting helicopters.

Airplanes of investigation and REB do not fall under reducing. The parties according to the Protocol on exchange of information inform each other on types, quantity, types and places of dislocation of these airplanes, and also have the right to perform such information.

2. In at the expense of limits of the arms and military equipment remaining with each of the Parties in geographical limits of application of the Agreement arms and military equipment which are in military units, and also on warehousing enter.

3. After the term of the reducing determined in this agreement, the limit of the following categories of arms and military equipment of land forces, the Air Force and aircraft of air defense remaining for each of the Parties in geographical limits of application of the Agreement will not exceed:

1) fighting tanks - 3900, including in military units - 3050, on warehousing - 850;

2) armored combat vehicles - 5890, including in military units - 4520, on warehousing - 1370;
