Constitutive treaty of Eurasian economic community

of October 10, 2000

(as amended on on October 6, 2007)

The Republic of Belarus, the Republic of Kazakhstan, the Kyrgyz Republic, the Russian Federation and the Republic of Tajikistan which further are referred to as with Contracting Parties

movable by the aspiration to provide the dynamic development by approval of the carried-out social and economic transformations in case of effective use of economic potentials for increase in level of living of the people;

performed determination to increase efficiency of interaction for the purpose of development of processes of integration between them and to deepen mutual cooperation in different areas;

realizing need of coordination of approaches in case of integration into world economy and the international trade system;

expressing readiness to fully fulfill obligations assumed by them according to the Agreement on the Customs union between the Russian Federation and the Republic of Belarus of January 6, 1995, the Agreement on the Customs union of January 20, 1995, the Agreement on deepening of integration in economic and humanitarian areas of March 29, 1996 and the Agreement on the Customs union and the Common economic space of February 26, 1999;

confirming the commitment to the principles of Articles of organization of the United Nations, and also to the conventional principles and rules of international law,

agreed about the following:

Article 1. Organization of the international organization

Present Contracting Parties establish the international organization "Eurasian Economic Community" (further - EurAsEC or Community).

The EurAsEC has the powers which are voluntarily transferred to it by Contracting Parties according to provisions of this agreement. Contracting parties remain sovereign and equal subjects of international law.

Article 2. Purposes and tasks

The EurAsEC is created for effective promotion of process of forming by Contracting Parties of the Customs union and the Common economic space, and also realization of other purposes and tasks determined in the above-named agreements on the Customs union, the Agreement on deepening of integration in economic and humanitarian areas and the Agreement on the Customs union and the Common economic space according to the stages planned in the specified documents.

The agreements which are earlier signed by Contracting Parties among themselves, and also decisions of governing bodies of integration continue to be effective in the part which is not contradicting this Agreement.

Article 3. Bodies

Providing succession of the governing bodies of integration created by earlier Contracting Parties, for accomplishment of the purposes and tasks of this Agreement within EurAsEC are effective:

Interstate Council (Mezhgossovet);

Integration Committee;

Inter-parliamentary Assembly (MPA);

Court of Community.

The decision on the termination of activities of the governing bodies of integration founded by the Agreement on deepening of integration in economic and humanitarian areas of March 29, 1996 and the Agreement on the Customs union and the Common economic space of February 26, 1999 is accepted by Mezhgossovet.

Article 4. Presidency

Presidency in Interstate Council and Integration Committee is performed serially according to the procedure of the Russian alphabet by each state member of Community within one year.

The procedure for presidency in other bodies of Community is determined by relevant provisions.

Article 5. Interstate Council

Interstate Council is the supreme body of EurAsEC. Heads of states and heads of governments of Contracting Parties are its part.

Mezhgossovet considers the matters of principle of Community connected with common interests of the State Parties, determines the strategy, the directions and perspectives of development of integration and makes the decisions directed to realization of the purposes and tasks of EurAsEC.

Interstate Council gives instructions to Integration Committee, makes inquiries and recommendations to Inter-parliamentary Assembly, requests to Court of Community.

Mezhgossovet the decisions can establish facilitative branches of Community.

Mezhgossovet gathers on the level of heads of states at least once a year and at the level of heads of governments at least two times a year. Meetings are held under the leadership of the representative of the Contracting Party presiding in Mezhgossoveta.

Functions and operating procedure of Mezhgossovet are determined by the Provision which affirms Mezhgossovetom at the level of heads of the State Parties of EurAsEC.

Interstate Council is the supreme body of the Customs union. Decisions concerning the Customs union are made by Mezhgossovet's members from the Contracting Parties creating the Customs union.

Features of operating procedure of Mezhgossovet in case of accomplishment of functions of the supreme body of the Customs union by it are determined by the Provision approved by Interstate Council.

Article 6. Integration Committee

The integration Committee is permanent body of EurAsEC.

1. Main objectives of Integration Committee:

ensuring interaction of bodies of EurAsEC;

preparation of offers on the agenda of meetings of Mezhgossovet and level of their carrying out, and also drafts of decisions and documents;

preparation of offers on forming of the budget of EurAsEC and control of its execution;

control of implementation of the decisions made by Mezhgossovet.

For the purpose of accomplishment of the tasks Integration Committee:

makes decisions within the powers defined by this Agreement, and also delegated to it by Interstate Council;

annually represents Mezhgossoveta the report on situation in Community and the course of realization of its purposes and tasks, the report on the activities, and also on budget implementation of EurAsEC;

considers the measures directed to goal achievement of Community, including the conclusion of the relevant agreements and carrying out by Contracting Parties single policy on specific questions and prepares relevant proposals;

has the right to address with recommendations to Mezhgossovet, with recommendations and requests in Inter-parliamentary Assembly and the governments of Contracting Parties, with requests in Court of Community.

2. Deputy heads of governments of Contracting Parties are part of Integration Committee. The chairman of Integration Committee participates in Mezhgossovet's meetings.

Meetings of Integration Committee are held at least once in three months.

During the period between meetings of Integration Committee the current functioning of Community is ensured by the Commission of Permanent representatives (Permanent representatives) of the Contracting Parties under EurAsEC appointed by heads of the State Parties.
