The agreement between the Government of the Russian Federation and the Government of the Republic of Byelorussia on completion of unification and creation of single system of tariff and non-tariff regulation in the Union State

The government of the Russian Federation and the Government of the Republic of Byelorussia which are hereinafter referred to as with the Parties

being guided by the Agreement on creation of the Union State and the Action program of the Russian Federation and the Republic of Byelorussia on realization of provisions of the Agreement on creation of the Union State of December 8, 1999,

relying on the experience of integration accumulated in the Union of Belarus and Russia

stating achievement of considerable results on implementation of the Decision of the Supreme Council of the Union of Belarus and Russia "About completion of forming of single customs space of the Union of Belarus and Russia" of April 28, 1999,

solving problem of formation of economic union,

for the purpose of creation of equal and mutually advantageous conditions in mutual trade and trade with the third countries,

being guided by the conventional principles and rules of international law,

agreed about the following:

Article 1

The parties apply in trade with the third countries common customs tariff (export and import), except for goods on which rates of import and export duties in the Russian Federation and the Republic of Byelorussia have temporary distinctions. Lists of such goods are given in the Appendix which is integral part of this agreement.

Change of rates of import and export customs duties is performed as agreed by the parties.

Article 2

The parties apply the agreed principles of provision of the tariff privileges to the goods imported on single customs space of the Union State from the third countries.

Article 3

Concerning the countries with which at the Russian Federation or the Republic of Byelorussia the trade regime is not set or the countries with which the trade regime provided by the Russian Federation differs from the mode provided by the Republic of Byelorussia, the Parties set and apply the approved trade regime, including preferences to developing countries.

Changes of trade regime concerning the third countries, and also introduction and/or cancellation of temporary restrictions in trade with them are made according to the procedure, approved by the Parties.

Article 4

The parties independently perform accession to the World Trade Organization. For the purpose of development of the approved line item on the matter of the Party regularly hold consultations and perform exchange of information.

Article 5

The procedure for distribution of the amounts of import customs duties on the goods occurring from the territory of the third countries and also the export customs duties on the goods occurring from the territory of the state of one of the Parties between budgets of the states of the Parties is determined by the free standing agreement.

Article 6

The parties do not apply measure of non-tariff regulation to the goods occurring from the territory of the state of one of the Parties or issued in free circulation in such territory and goods intended for export/import to the territory of the state of other Party, except for which list the Parties agreed to determine in the separate Protocol.

Article 7

The parties apply agreed measures of non-tariff regulation to the goods intended for export to the third countries or import from the third countries.

Inventories, intended for export to the third countries or import from the third countries to which the Parties apply measures of non-tariff regulation, are determined by the Parties taking into account the Agreement between the Government of the Russian Federation and the Government of the Republic of Byelorussia on approval of inventories to which quantitative restrictions, prohibitions or restrictions, of February 12, 1999 are applied.

Article 8

The parties apply single procedure for export control according to the Agreement between the Government of the Russian Federation and the Government of the Republic of Byelorussia on single procedure for export control of April 13, 1999.

Article 9

The parties apply procedure for mutual recognition of licenses, certificates and import permits and/or commodity exportation according to the Protocol between the Government of the Russian Federation and the Government of the Republic of Byelorussia on procedure for mutual recognition of licenses, certificates and import permits and/or commodity exportation of February 12, 1999.

Article 10

For the purpose of ensuring unity of customs and tariff and non-tariff regulation in the Russian Federation and the Republic of Byelorussia responsibility for development, unification of measures of tariff and non-tariff regulation and development of the approved decision making mechanism on the specified questions, and also applications of measures of protection of the domestic market when implementing foreign trade in goods to assign to the Commission on tariff and non-tariff regulation under Council of Ministers of the Union State.

Article 11

Disputes and disagreements on interpretation and application of this agreement are solved the Parties by consultations and negotiations.

This agreement becomes effective from the date of the last written notice of the Parties of accomplishment of the interstate procedures necessary for the introduction of the Agreement in force *, and is valid before the expiration of 12 months from the date of receipt of one of the Parties of the formal written notice of other Party of intention to stop its action.

It is made in Moscow on January 29, 2001 in two authentic copies in Russian, and both texts are equally authoritative.
