1. This Provision determines according to article 25.10 of the Federal law "About Procedure for Departure from the Russian Federation and Entry into the Russian Federation" procedure for decision making about undesirability of stay (residence) of the foreign citizen or stateless person in the Russian Federation, the decision made in connection with availability of the circumstances creating real health hazard of the population except for specified (further hereinafter is referred to as - the decision on undesirability of stay).

2. The decision on undesirability of stay is made by the federal executive bodies provided by the list approved by the order of the Government of the Russian Federation of April 7, 2003 N199 (further hereinafter are referred to as - authorized federal executive bodies), no more than 1 month from the date of representation of the materials specified in Item 3 this provision in time.

3. In case of identification of the circumstances provided by the Federal Law "About Procedure for Departure from the Russian Federation and Entry into the Russian Federation" which are the basis for decision making about undesirability of stay, territorial authorities (divisions) of authorized federal executive bodies represent the materials confirming the specified circumstances to the corresponding authorized federal executive body.

The procedure for representation of materials and their consideration is determined by regulatory legal acts of authorized federal executive bodies.

4. In case of decision making about undesirability of stay the authorized federal executive body without delay informs on it the relevant territorial authority (division) which provided materials.

The territorial authority (division) of authorized federal executive body without delay brings the decision on undesirability of stay to the attention of face concerning which it is accepted, in case of stay (accommodation) of this person in the territory of the Russian Federation.

5. The federal executive body which made the decision on undesirability of stay sends to the federal executive body knowing safety issues, representation for accounting of persons to which entry into the Russian Federation is not resolved.
