Chapter 1. General provisions

Article 1. Public service of the Russian Federation

1. Public service of the Russian Federation (further - public service) - professional office activity of citizens of the Russian Federation (further - citizens) on ensuring execution of powers:

Russian Federation;

federal bodies of the government, other federal state bodies (further - federal state bodies);

subjects of the Russian Federation;

public authorities of subjects of the Russian Federation, other state bodies of subjects of the Russian Federation (further - state bodies of subjects of the Russian Federation);

persons replacing the positions established by the Constitution of the Russian Federation, the Federal Laws for direct execution of powers of federal state bodies, bodies of the public power of the federal territories (further - persons, replacement state positions of the Russian Federation);

persons replacing the positions established by constitutions, charters, the laws of subjects of the Russian Federation for direct execution of powers of state bodies of subjects of the Russian Federation (further - persons, replacement state positions of subjects of the Russian Federation);

federal territories;

bodies of the public power of the federal territories;

persons replacing in the federal territory of position, established by the Federal Laws and presidential decrees of the Russian Federation, and also the charter of the federal territory for direct execution of powers of bodies of the public power of the federal territory.

2. Activities of persons replacing the state positions of the Russian Federation and persons replacing the state positions of subjects of the Russian Federation, are not regulated by this Federal Law.

Article 2. System of public service

1. The system of public service includes:

public civil service;

military service;

public service of other types.

2. The public civil service is subdivided into Federal public civil service and the public civil service of the subject of the Russian Federation.

3. The military service and public service of other types which are established by the Federal Laws are types of the Federal State Service.

4. Legal regulation and the organization of Federal public civil service are under authority of the Russian Federation. Legal regulation of the public civil service of the subject of the Russian Federation is under joint authority of the Russian Federation and subjects of the Russian Federation, and its organization - under the authority of the subject of the Russian Federation.

Article 3. Basic principles of creation and functioning of system of public service

1. The basic principles of creation and functioning of system of public service are:

the federalism providing unity of system of public service and observance of the constitutional differentiation of areas of jurisdiction. and powers between federal bodies of the government and public authorities of subjects of the Russian Federation (further - state bodies);

legality;

priority of rights and freedoms of man and citizen, their direct action, obligation of their recognition, observance and protection;

equal access for citizens to public service;

the unity of legal and organizational basis of public service assuming legislative fixing of single approach to the organization of public service;

interrelation of public service and municipal service;

openness of public service and its availability to public control, objective informing society on activities of government employees;

professionalism and competence of government employees;

protection of government employees against illegal intervention in their professional office activity both state bodies and officials, and physical persons and legal entities;

the protection of system of public service and professional office activity of government employees against foreign influence assuming including prohibition on revenues to public service and stay on it foreign agents.

2. Realization of the principles of creation and functioning of system of public service is provided with the Federal Laws on types of public service. By the specified Federal Laws also other principles of creation and functioning of types of public service considering them features can be provided.

Article 4. Federal State Service

The Federal State Service - professional office activity of citizens on ensuring execution of powers of the Russian Federation, the federal territories, and also powers of federal state bodies, bodies of the public power of the federal territories, other bodies of the federal territories and persons replacing the state positions of the Russian Federation.

Article 5. Public civil service

1. The public civil service - type of the public service representing professional office activity of citizens on positions of the public civil service on ensuring execution of powers of federal state bodies, bodies of the public power of the federal territory, state bodies of subjects of the Russian Federation, persons replacing the state positions of the Russian Federation and persons replacing the state positions of subjects of the Russian Federation.

2. Federal public civil service - professional office activity of citizens on positions of Federal public civil service on ensuring execution of powers of federal state bodies, bodies of the public power of the federal territory and persons replacing the state positions of the Russian Federation.

3. The public civil service of the subject of the Russian Federation - professional office activity of citizens on positions of the public civil service of the subject of the Russian Federation on ensuring execution of powers of the subject of the Russian Federation, and also powers of state bodies of the subject of the Russian Federation and persons replacing the state positions of the subject of the Russian Federation.
