About quality and safety of food staples and foodstuff for life and health of the person

This Law is directed to enhancement of legal, organizational and economic basis of state regulation in the field of quality assurance of food staples and foodstuff and their safety for life and health of the person (further, unless otherwise specified, - quality assurance and safety of food staples and foodstuff).

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

safety of food staples and foodstuff - the condition of food staples and foodstuff testimonial of lack of the unacceptable risk connected with harmful effects per capita and its future generations in case of their use in recommended conditions;

dietary supplements to food - natural, identical natural food and (or) biologically active agents, and also the pro-biotic microorganisms intended for the direct use by the person or introduction in structure of foodstuff for the purpose of enrichment of its food allowance and which are not the single source of food;

the manufacturer - the legal entity irrespective of its form of business, the individual entrepreneur, the production of food staples and foodstuff performing on its own behalf for realization to acquirers (consumers) and bearing responsibility for compliance of these of food staples and foodstuff to the established requirements to their quality and safety;

quality of foodstuff - set of properties and characteristics of foodstuff which cause their capability to satisfy physiological needs of the person for food in case of usual conditions of use, compliance of these properties and characteristics to requirements of technical regulatory legal acts, and (or) documents of the manufacturer, obligatory for observance, and (or) to the civil agreements signed by the manufacturer and (or) requirements which observance the manufacturer in voluntary procedure declared otherwise, and concerning dietary supplements to food - also set of the properties providing efficiency of dietary supplements to food on condition of their use for the purpose of for which they are intended;

quality of food staples - set of properties and characteristics of food staples which determine its suitability for use for the purpose of, for which it is intended, compliance of these properties and characteristics to requirements of technical regulatory legal acts, and (or) documents of the manufacturer, obligatory for observance, and (or) to the civil agreements signed by the manufacturer and (or) requirements which observance the manufacturer in voluntary procedure declared otherwise;

critical control point - production phase, conversions (processing), realization, storage, transportation of food staples and foodstuff on which methods production can be applied including laboratory or other, control and measures for safety of food staples and foodstuff for life and health of the person are taken;

the materials and products contacting to food staples and foodstuff (further, unless otherwise specified, - materials and products), - materials and products which, without being components of food staples and foodstuff, are applied to production, packing, realization, storage, transportation of food staples and foodstuff and their use;

turnover of food staples and foodstuff - development of foodstuff, conversion (processing), realization, storage, transportation, use, destruction, utilization, import to the Republic of Belarus, export from the Republic of Belarus of food staples and foodstuff;

batch of food staples and foodstuff - the certain amount of food staples and the foodstuff of one name which is equally packed, made by one manufacturer from one initial raw materials and materials according to one technical regulatory legal act in the field of technical regulation and standardization and (or) other documents of the manufacturer in certain period, accompanied with the shipping documents providing traceability of food staples and foodstuff and confirming their quality and safety;

conversion (processing) - thermal treatment (except freezing and chilling), smoking, conservation, maturing, souring, the ambassador, drying, pickling, concoction, extraction, extrusion or combination of these processes;

nutritional supplement - the substance, mix of substances having or not having own nutrition value, which are usually not eaten by the person directly, purposely entered into food staples and foodstuff with the technological purpose and (or) function in case of their production, storage and transportation that brings or can lead to the fact that these substance, mix of substances or products of their interaction with other substances become components of food staples and foodstuff;

nutrition value of food staples and foodstuff - complex of properties of food staples and the foodstuff providing physiological needs of the person for necessary substances and energies;

foodstuff - products of animal, vegetable, microbiological, mineral, artificial or biotechnological origin in the natural, processed (processed) type which are intended for the use by the person in food, including specialized foodstuff, the drinking water which is packed up in reservoir, drinking mineral water, soft drinks, dietary supplements to food, alcoholic products;

the thought-up (original) name of food staples and foodstuff - the word or the phrase which can supplement the name of food staples and foodstuff. Such name can not reflect their consumer properties and shall not replace the name of food staples and foodstuff;

food staples - the products of animal, vegetable, microbiological, mineral, artificial or biotechnological origin, and also drinking water used for production of foodstuff;

production of food staples and foodstuff - set or combination of consistently carried out stages of engineering procedure of creation of food staples and foodstuff for their realization;

traceability of food staples and foodstuff - opportunity dokumentarno (on paper and (or) electronic media) to establish the manufacturer and the subsequent owners who are in circulation of food staples and foodstuff except the final consumer, and also the place of origin (production) of food staples and foodstuff;

development of foodstuff - creation of samples and (or) the specifications and technical documentation, foodstuff, necessary for production organization;

realization of food staples and foodstuff - sale and different ways of alienation of food staples and foodstuff;

specialized foodstuff - the foodstuff intended for the purposes of the safe use by separate categories of consumers for which requirements to content and (or) ratio of separate substances or all substances and components and (or) in which content and (or) ratio of separate substances of their rather natural content in such foodstuff is changed are established and (or) in the list of whom is included the substances or components which are not present initially (except nutritional supplements and fragrances) and (or) concerning which the manufacturer declares their medicinal, dietary and (or) preventive properties;
