About approval of Traffic regulations of the Republic of Kazakhstan, Basic provisions according to the admission of vehicles to operation and obligations of service employees and participants of traffic on safety control of traffic and the List of field and special services which transport is subject to the equipment special luminous and sound signals and coloring according to special tsvetografichesky schemes

For the purpose of reduction of regulatory legal acts of the Republic of Kazakhstan in the field of traffic in compliance with requirements of the international convention about traffic, and also in pursuance of Article 92 parts 4 Constitutions of the Republic of Kazakhstan and article 12 of the Law of the Republic of Kazakhstan of July 15, 1996. "About traffic safety" the Government of the Republic of Kazakhstan decides:

1. Approve and enact since January 1, 1998:

Traffic regulations of the Republic of Kazakhstan (appendix 1);

Basic provisions according to the admission of vehicles to operation and obligation of service employees and participants of traffic on traffic safety control (appendix 2);

The list of field and special services which transport is subject to the equipment special luminous and sound signals and coloring according to special tsvetografichesky schemes (appendix 3).

2. Grant to the Ministry of Internal Affairs of the Republic of Kazakhstan the order placement right according to the edition (reissuing) of Traffic regulations of the Republic of Kazakhstan, Basic provisions according to the admission of vehicles to operation and obligations of service employees and participants of traffic on traffic safety control.

3. To provide to the Ministry of Internal Affairs of the Republic of Kazakhstan till December 15, 1997 the edition of the specified regulating documents in the mass edition and coverage, on radio and television of their requirements.

Traffic regulations of the Republic of Kazakhstan

1. General provisions

1.1. These rules of traffic of the Republic of Kazakhstan (further - Rules) establish single procedure for traffic in all territory of the Republic of Kazakhstan. Other normative and legal acts concerning traffic shall be based on requirements of Rules and not contradict them.

1.2. In Rules the following basic concepts are used:

the highway - the road designated by sign 5.1. and having the carriageways separated from each other by lane line for each driving direction, and in case of its absence - road barrier without intersection at grades with other roads, railway or tramroads, pedestrian or bicycle lanes;

the bus - the vehicle intended for public conveyance and baggage, having more than eight places for sitting excepting driver's seat;

the road train - the motorized vehicle linked to trail car (trail cars);

baggage - the property of the passenger packed and transported in baggage compartment of the bus, the minibus or in the luggage car accompanying the bus, the minibus within the regulations established by Rules of public conveyance and baggage and also in taxi based on the supplementary agreement with carrier;

traffic safety - the traffic condition reflecting degree of security of his participants and the state from the road accidents and their effects;

the bicycle - the vehicle, except wheelchairs, having two wheels or more and set in motion by the muscular strength of the people who are on it;

the driver - person managing the vehicle, the driver conducting on the road of pack, riding animals or herd. To the driver it is equated training to driving;

forced stop - traffic congestion of the vehicle because of its materiel failure or danger created by the transported load, condition of the driver (passenger) or emergence of obstacle in the road;

the main road - the road designated by signs 2.1, 2.3.1-2.3.3 or 5.1 in relation to crossed (adjoining), or paved road (asfalto-and tsementobeton, stone materials and so forth) in relation to soil. Availability on minor road right in front of the intersection of the site with covering does not do it equal on value with crossed;

lawn (bed) - the land area with accurately certain borders which in the city register of the earth is determined as "lawn" ("bed");

the road - the highways public, the economic highway, the city street and the settlement which are subject to the state accounting and representing complex of the engineering constructions intended for movement of vehicles. The road includes one or several carriageways, and also tramroads, sidewalks, roadsides and lane lines in case of their availability;

traffic - set of the public relations arising when moving people and loads on roads with use of vehicles or without them (pedestrians) and also in the course of regulation of conditions of this movement;

the road accident - the event which arose in the course of movement on the road of the vehicle and with its participation with which people died or are wounded vehicles, constructions, loads are damaged, or other material damage is caused;

railroad crossing - crossing of the road with railway tracks at one level. Border of moving is the road stretch limited to the imagined line at distance of 10 m from the next rail; the region of the carriageway - is determined by the line of marking, and in case of its absence the conditional line passing on edge of road carpet and also in the place of adjunction of the carriageway to tramroads at the roadside. In case of impossibility to determine edge of road carpet including on road conditions the region of the carriageway is determined by the driver by edge of knurled strip;

the living area - the site, the built-up territory or the array designated by sign 5.38;

the large-size vehicle - the vehicle with load or without load, the having exceeding of the outline dimensions established by regulatory legal acts;

maneuvering - start of motion from stop (parking), stop, turn (turn), evolution, braking and movement of the vehicle back run;

the route vehicle - the general use vehicle (the bus, the trolleybus, the tram) intended for transportation across roads of passengers and moving along the established route with the designated stopping points (stops);

off-load weight - the mass of the unmanned vehicle, passengers and load, but with complete stock of fuel and necessary set of the tool;

weight with loading - the actual mass of the loaded vehicle, crew and passengers;

the motorized vehicle - the vehicle, except the moped, set in motion by the engine. The term extends also to any tractors and self-propelled machines;

the moped - two - or the three wheeled vehicle set in motion by the engine with working volume no more than 50 cm3 and having the maximum constructive speed no more than 50 km/h. Bicycles with outboard engine, mokik and other vehicles with similar characteristics are equated to mopeds;

the motorcycle - the two-wheeled motorized vehicle with side trail car or without it. Are equated to motorcycles three - and the four-wheel motorized vehicles having weight in the equipped condition no more than 400 kg;

the settlement - the built-up territory on which entrances and departures with which are designated by signs 5.22 - 5.25;

insufficient visibility - visibility of the road less than 300 m in the conditions of fog, rain, dust, snowfall and to that similar, and also in twilight;

irregular public conveyances and baggage - the transport services rendered by carriers with use of buses, minibuses in orders (requests) of physical persons and legal entities;

overtaking - the advancing of the vehicle moving ahead at the minimum safe distance or structure of vehicles connected with departure from the occupied strip;

roadside - the soil or strengthened by covering strip between edge (or curbstone) and the region of the carriageway on one with it level;

dangerous goods - load which owing to properties and features inherent in it in transit, production of handling works and storage can serve as cause of explosion, the fire or damage of technical means, devices, buildings, structures and constructions, and also death, injuring or disease of people, animal, to do harm to the environment;

danger to movement - the sudden change in traffic menacing to its safety and requiring alteration of speed and (or) maneuvering of the vehicle;

the organization of traffic - complex of organizational and technical actions and administrative actions for mission control on roads;

organized pedestrian column - the group of the pedestrians moving on the road organized and designated according to requirements of Item 3.2 of Rules;

organized road convoy - group of three and more motorized vehicles, the following directly one after another on the same driving lane with constantly included headlights accompanied by the head vehicle with the switched-on flashing indicator of blue color or indicators of blue and red colors;

stop - deliberate traffic congestion of the vehicle for a while up to 5 minutes, and also on bigger if it is necessary for landing or disembarkation of passengers or loading or unloading of the vehicle;

Note. The need of traffic congestion of the vehicle caused by the organization of traffic is not considered stop (parking).

the passenger - the person who is in (on) the vehicle and not managing it;

the intersection - the place of crossing, adjunction or branching of roads at one level limited to the imagined lines connecting respectively opposite, the most remote from the center of the intersection of the beginning of curves of carriageways. Do not reckon as intersections of the place of crossing (adjunction) with field, forest and other minor roads before which priority signs are not established;

evolution - change of the driving lane occupied by the vehicle with preserving initial driving direction;

the pedestrian - the person who is out of the vehicle on the road and not performing on it work. The persons moving in wheelchairs without engine, conducting the bicycle, the moped, the motorcycle carrying the sledge, the cart, the nursery or wheelchair are equated to pedestrians;

the crosswalk - the site of the carriageway designated by signs 5.16. 1, 5.16.2 and (or) marking 1.14.1 - 1.14.3 "*" and allocated for movement of pedestrians across the road. In the absence of marking width of the crosswalk is determined by distance between signs 5.16.1 and 5.16.2 by road axis;

driving lane - any of longitudinal strips of the carriageway designated or not designated by marking and having width sufficient for movement of cars in one row;

benefit (priority) - the right to first-priority movement in the planned direction in relation to other participants of movement;

obstacle for movement - the motionless object on driving lane which is not allowing to continue movement on this strip. The jam or the vehicle which stopped on this driving lane according to requirements of Rules is not obstacle;

trail car - the vehicle which is not equipped with the engine and intended for movement in structure with the motorized vehicle. The term extends to semitrailer trucks and pole trailers;

the carriageway - the road element intended for movement of trackless vehicles;

lane line - structurally allocated road element dividing adjacent carriageways and not intended for movement or stop of trackless vehicles and pedestrians, except for forced stop of pedestrians when crossing the road out of the settlement;

the permitted maximum weight - the mass of the equipped vehicle with load, the driver and passengers established by manufacturer as the most admissible. The amount of the permitted maximum mass of the vehicles which are part is accepted to the permitted maximum mass of structure of the vehicles that is linked and moving as single whole;

the traffic controller - the employee of law-enforcement bodies (police), military automobile police or the serviceman of road and commandant's division, the employee of Committee of transport control of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - Committee of transport control), the worker of road operational service, the person on duty on railroad crossing, ferry crossing having the corresponding certificate and equipment (uniform or distinctive mark - armband, staff, disk with red signal or the retroreflector, red lamp or tag), authorized to perform administrative operations on mission control on roads;

the parking - deliberate traffic congestion of the vehicle for the period of more than 5 minutes for the reasons which are not connected with landing or disembarkation of passengers either loading or unloading of the vehicle;

night-time - period from the end of evening twilight prior to the beginning of morning twilight;

the vehicle - the device intended for transportation across roads of people, loads or the equipment installed on it;

the sidewalk - the road element intended for movement of pedestrians, adjoining the carriageway or separated it by lawn;

the heavyweight vehicle - the vehicle with load or without load, the fully loaded mass or load distribution on axes of which exceeds sizes of maximum allowable loads for this category of roads and constructions on them;

give way (not to create hindrances) - the requirement meaning that the participant of traffic shall not begin, renew or continue movement perform any maneuver if it can force other participants of movement having in relation to it advantage, to change driving direction or speed;

the participant of traffic - person which is directly involved in the course of movement as the driver, the pedestrian, the passenger of the vehicle.

1.3. In the territory of the Republic of Kazakhstan right-hand traffic of vehicles is established.

1.4. Necessary changes and restrictions in the organization of traffic are introduced in accordance with the established procedure within Rules only by means of route signs, road marking, signals of traffic lights and traffic controllers, and also orders of persons, representatives to regulate movement.
