About safety of hydraulic engineering constructions
This Law governs the relations connected with safety of hydraulic engineering constructions during their designing, construction, operation, reconstruction, recovery, preservation and liquidation, establishes obligations of public authorities, owners of constructions and operators.
1.0. The concepts used in this Law express the following values:
1.0.1. the hydraulic engineering construction - water storage basins, the dikes, the main water supply systems, hydroelectric power stations, the floodgate, water final, intake, water settling, drainage unites, water pumping points, tunnels, channels, collectors binding level, the bank protection, shore protection, regulating beds, rybopropuskny and fish-protecting constructions located in the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic sea constructions (platforms, priestakadny platforms, stationary sea platforms, technical constructions interacting with aquatic environment and provided for safety of navigation and the parking of courts shipping locks), and also other special technical constructions, held for use underground and land water resources and prevention of harmful effects of water;
1.0.2. safety of the hydraulic engineering construction - the properties of hydraulic engineering constructions providing protection of life, human health, valuable interests of the state, environment and economic objects against disasters and dangerous incidents which can result from accident and damage of the hydraulic engineering construction;
1.0.3. assessment of safety of the hydraulic engineering construction determination of compliance of technical condition of the hydraulic engineering construction and skill level of operational structure to regulations and rules, the established this Law and other corresponding regulatory legal acts;
1.0.4. criteria of safety of the hydraulic engineering construction the highest limit of indicators of quality and amount of stability and technical condition of the hydraulic engineering construction, and also the operating conditions corresponding to admissible limit of risk of emergence of accident on construction;
1.0.5. safety of the hydraulic engineering construction development and implementation of complex measures for prevention of emergence of accident on the hydraulic engineering construction;
1.0.6. the declaration of safety of the hydraulic engineering construction the document proving safety of the hydraulic engineering construction and reflecting in itself security measures;
1.0.7. the owner of the hydraulic engineering construction the legal entity or physical person having the right to own, dispose of the hydraulic engineering construction and to grant permission for its use;
1.0.8. the operator of the hydraulic engineering construction the legal entity, irrespective of pattern of ownership and legal form, or the physical person operating the hydraulic engineering construction for the purpose of implementation of economic or business activity;
1.0.9. emergency situation which involves damnification of life, to health, property of people, the environment and economic objects, and also material losses in certain territory resulted on the hydraulic engineering construction of accident and damage.
2.1. The legislation on safety of hydraulic engineering constructions consists of this Law, the Water code of the Azerbaijan Republic, the laws of the Azerbaijan Republic "About melioration and irrigation", "About water supply and waste waters", "About power", "About rational use of energy resources and energy efficiency", "About technical safety" and other regulatory legal acts.
2.2. If established in interstate agreements which participant is the Azerbaijan Republic, the rules connected with safety of hydraulic engineering constructions will differ from the rules provided by this Law rules of international treaties are applied.
2.3. International cooperation in the field of safety of hydraulic engineering constructions is performed according to the legislation of the Azerbaijan Republic and rules of international law based on prisoners between the Azerbaijan Republic and other states and the international organizations of agreements, agreements and arrangements.
3.1. Hydraulic engineering constructions, depending on purpose, degree of safety, the mode of protection and features of use, in the territory of the Azerbaijan Republic are classified, being subdivided into hydraulic engineering constructions of the state and local value.
3.2. The hydroelectric power stations of cascade type operated together with other state, large water storage basins, water pumping, dikes, tunnels, the main channels, collectors, protective constructions of water storage basins and the coast of the rivers, and also sea constructions located in the sector of the Caspian Sea (lake) belonging the Azerbaijan Republic treat especially protected hydraulic engineering constructions of the state value.
3.3. The list, the mode of protection of hydraulic engineering constructions of the state and local value, their classification by safety are established by relevant organ of the executive authority.
4.1. Hydraulic engineering constructions can be in the state-owned, municipal and private property.
4.2. The right of operation of hydraulic engineering constructions is acquired according to the procedure, stipulated by the legislation the Azerbaijan Republic.
5.1. The state register of hydraulic engineering constructions is data set, reflecting purpose, technical characteristics, degree of safety and classification by safety of construction, and is kept for the purpose of the organization of their systematized registration, effective use and protection.
5.2. Rules of creation and maintaining the state register of hydraulic engineering constructions are established by relevant organ of the executive authority.
5.3. After approval the declaration of safety of hydraulic engineering constructions joins in the state register.
6.1. Safety of hydraulic engineering constructions is ensured based on the following requirements:
6.1.1. risk identifications of accident on constructions;
6.1.2. creation and observance of the declaration of safety of constructions;
