Chapter I. General provisions

Art. 1. - (1) Privatization of housing stock is the process of alienation of housing stock of the state, public organizations performed by public authorities on which the state confirmed the property right, and other state and cooperative associations and the companies constructed at the expense of the funds allocated from the government budget, in private property of citizens of the Republic of Moldova and their associations (joint-stock, economic and other companies), directed to satisfaction of their needs for housing and forming of real owners by the free order by immovable property.

Art. 2. - Privatization of housing stock, including creative workshops, is performed on voluntary basis with respect for principles of social justice and social security of citizens as for bonds of national property and money (national and/or foreign currency), and is non-paid in the cases determined by this law. Privatization of housing stock, including creative workshops, for foreign currency can be performed only by nonresidents.

Art. 3. - In case of acquisition of the apartment (house) or creative workshop for money citizens pay its cost one-timely or by installments - monthly within five years with equal shares with payment of the initial contribution in the amount of at least 40 percent of cost of the apartment (house) and in addition with payment of the minimum bank interest from the outstanding amount for the provided payment by installments.

Art. 4. - (1) the Bodies given the right to perform privatization of housing stock (further - authorized bodies) are:

a) councils of municipiums of Chisinau and Belts;

b) authorized body of Executive committee of autonomous territorial education Gagauzia - in the territory of Gagauzia;

c) regional councils - in other settlements of the republic.

(2) Authorized bodies in coordination with bodies of local public authority create the commissions on privatization of housing stock. Data of the commissions representatives of authorized bodies, bodies of local public authority, financial and housing bodies, architectural management, body of fire supervision, the sanitary and epidemiologic station, territorial bureau of technical inventory count, and to sale or voluntary conveyance of apartments (houses) of departmental or public housing stock - and representatives of the relevant companies, associations, organizations, organizations ** and their trade-union committees are included.
