About bodies of homeland security of the Kyrgyz Republic
Bodies of homeland security are executive bodies of the Kyrgyz Republic and are intended for the prevention of causing damage of safety of the Kyrgyz Republic. Bodies of homeland security are component of forces of safety of the Kyrgyz Republic and within the powers conferred to them ensure safety of the personality, societies and the states, conduct work on identification, the prevention and suppression of prospecting subversive activities of foreign intelligence agencies and the organizations, and also illegal infringement of the constitutional system, sovereignty and territorial integrity of the Kyrgyz Republic.
The legal basis of activities of bodies of homeland security is constituted by the Constitution of the Kyrgyz Republic, this Law and other regulatory legal acts, and also the international agreements which came in the procedure established by the law into force which participant is the Kyrgyz Republic.
Activities of bodies of homeland security are based on the basis of the principles of legality, publicity, respect of the personality, its rights and freedoms.
Bodies of homeland security when implementing the activities shall observe rights and freedoms of man and citizen. For the purpose of ensuring national security, public order, protection of the rights and freedoms of other persons of right and freedom of man and citizen can be temporarily limited. Restrictions shall be proportional to the specified purposes according to the procedure and the limits determined by the legislation of the Kyrgyz Republic.
By this Law restrictions of the rights and freedoms in other purposes cannot be set and more than it is provided by the Constitution of the Kyrgyz Republic.
Bodies of homeland security shall make upon the demand of the citizen explanations concerning restriction of its rights and freedoms with them. Upon the demand of the citizen such explanation is made in writing.
Data on rendering the voluntary help by citizens of the Kyrgyz Republic to bodies of homeland security on secret basis are the state secret.
Actions of bodies of homeland security and their workers can be appealed in higher bodies of homeland security, prosecutor's office and court.
In case of violation by employees of bodies of homeland security on duty of the rights and freedoms of citizens the relevant organ of homeland security shall take measures to recovery of these rights and freedoms, compensation of the caused damage and involvement of guilty persons to responsibility.
Bodies of homeland security inform public authorities, the public and citizens on the activities for the questions carried to their maintaining.
Information constituting the state secrets and trade secret according to the legislation of the Kyrgyz Republic is not subject to disclosure. Also the information which is affecting private life, honor and advantage of citizens, became to homeland security known to bodies in the course of their office activities, except as specified, provided by the law is not subject to disclosure.
In bodies of homeland security creation and activities of political parties and their organizations is not allowed.
Staff of bodies of homeland security in the office activities is guided by the laws of the Kyrgyz Republic and is not connected by decisions of the political parties and grass-roots social movements pursuing political goals.
