About bonds of national property

Chapter I General provisions

Article 1. Concept of the check of national property

(1) Bon of national property is special personalized government security which is issued to the citizen of the Republic of Moldova and grants to it the right to acquisition of share of state-owned property and its use according to the current legislation.

(2) Bon of national property and coupons are printed on one leaf. On its face in frame the check of national property around which - coupons of various advantage is located. In the upper part of the check words are placed: Republic of Moldova, between which in medallion - the State Emblem. Below in horizontal brace words are printed: "The check of national property", under skobkoynomer of the check. On the right side from number under word line: "Quantity of shares", from left - the word: "Amount in figures". Below under lines it is written: "Sum in words"; "surname, name, the owner's middle name" (in the Romanian and Russian languages); "number, month, year of birth"; "signature of the head"; "item m"; "signature of the chief accountant"; "number, month and year of issue". On the face of each coupon number of the check of national property and quantity of the shares equal in general are specified to general working life. Article 2. Owner of the check of national property

(1) the Owner of the check of national property has the right to acquire property (shares, including at par value within 20 percent of cost of the company).

(2) Bon of national property is not subject to alienation, except cases of transfer to his relatives of the first priority. In case of alienation of the check of national property to relatives of the first priority they have the same rights, as its owner. The owner of the check of national property transfers the right to its use by proxy, certified notarially.

(3) the Fact of transfer of the check to relatives of the first priority can be certified by primeriya or pretura at the place of residence, heads of the companies, organizations and organizations for place of employment or studies, and concerning pensioners - the relevant departments of social security.

(4) the Owner of the check can sign the declaration of trust with the investment funds and trust companies having the corresponding licenses without notarial certificate;

Chapter II Cost of checks of national property

Article 3. Calculation of cost of the check of national property

(1) the Amount of means on which bonds of national property are issued is determined by the cost of that part of state-owned property which is subject to free distribution. The share of the state-owned property distributed on bonds of national property affirms Parliament.

(2) the Cost of the check of the national property issued to each citizen of the Republic of Moldova consists of two parts:

- costs of the checks of national property issued to all citizens of the Republic of Moldova including the children who were born by the time of the beginning of issue of checks of national property on the basis of 5 years of conditional length of service;

- costs of the checks of national property issued to citizens of the Republic of Moldova depending on general length of service at the companies in organizations and the organizations * the republics.

(3) General length of service is determined according to the Law on the state provision of pensions. In case of calculation of general length of service privileges according to Article 11 are provided to separate categories of citizens. To all citizens of the Republic of Moldova joins in total quantity of the fulfilled years in addition for 5 years of conditional length of service.

(4) Nominal value of the check of national property is determined by multiplication of number of the years equal to general length of service, by the settlement cost of that part of the privatized property which falls on one year of length of service.

(5) Estimated cost of the privatized part of property which falls on one year of work is determined by division of cost of the privatized property of the republic into the total quantity of the fulfilled years all citizens of the Republic of Moldova in its territory as of September 1, 1992 calculated according to part (3). Calculation is made proceeding from property value as of January 1, 1992 taking into account coefficients of recalculation of the main and turnover appliances in connection with liberalization of the prices since January 2, 1992.

(6) the Ministry of privatization and management of state-owned property and its territorial agencies inform citizens of the Republic of Moldova through mass media the cost of part of property which falls on one year of length of service in the national economy of the republic, and also procedure, the place, time of the beginning of issue of checks of national property and number of the settlement account on which the state fee is listed for the received bonds.

Article 4. Accounting of the citizens having the right to checks of the people of property

(1) the Companies irrespective of type of property and forms of managing represent to territorial agencies of State Department of privatization lists of the citizens working at these companies in the place of the main work; local authorities of social security - lists of the citizens staying in these bodies on the registry and the unemployed: retirement pensioners, pensioners in case of incomplete length of service, pensioners on the occasion of loss of the supporter, disabled people of all categories, persons receiving social pensions; local government bodies - lists of the citizens living in their territory and who are not considered at the companies and in local authorities of social security; departments of national education - lists of children - the orphans who do not have guardians and custodians.

(2) Lists of children are constituted at the companies for the place of the main work or residence (if do not work) mothers, in the absence of mothers - fathers, guardians or custodians in the place of their main work or residence (if do not work) based on the certificate of birth of the child.
