The parliament adopts this organic law.

Art. 1. - Approve the Code of road transport it (is applied).

Art. 2. - To the Ministry of Transport and Communications to take measures for realization of provisions of the specified code.

CODE OF THE ROAD TRANSPORT OF THE REPUBLIC OF MOLDOVA

The purpose of this Code is regulation of activities in the field of road transport and determination of the rights, obligations and responsibility of the carrier agents rendering motor transportation services in the Republic of Moldova and also the physical persons and legal entities using such services.

Chapter I General provisions

Article 1. Field of application of this Code

This code regulates the main conditions of implementation in the territory of the Republic of Moldova of motor transportations of the passengers, baggage and loads which are carried out by carrier agents, including carrier agents of other states, except for special motor transportations.

Article 2. The legal basis of the regulations relating to activities of road transport

This code is the legal basis for development of the following regulations relating to activities of road transport, approved by the Government:

a) Rules of motor transportations of passengers and baggage;

b) Rules of motor transportations of loads;

c) Rules of perishable traffic;

d) Rules of transportation of dangerous goods on the territory of the Republic of Moldova;

e) Regulations on permission and implementation of carriages of goods, weight and/or dimensions of which exceed the limits and the existing standard rates established by the law, on highways public;

f) Rules of provision of forwarding services;

g) Regulations on bus station (bus station);

h) Regulations on safety control of traffic at the companies, in organizations, the organizations performing public conveyance and loads.

i) Regulations on issue and use of multilateral permissions of the European conference of Ministers of Transport;

j) Regulations on issue and use of permissions to the international motor transportation carriages.

Article 3. Basic concepts

For the purpose of of this Code the following basic concepts are used in value:

passengers - the persons transported by the vehicle, who are not participating in management of it;

the transported loads - any inventory items shown by the consignor to transportation from the moment of their acceptance to transportation by the carrier agent until delivery to the consignee;

the carrier agent - the physical persons registered as the subject of business activity, or the legal entity owning vehicles or leasing them and performing city, suburban, long-distance and/or international carriages of passengers or loads;

crew of the vehicle - set of persons servicing this means;

the consignor - physical person or legal entity, being the owner or the manager of load;

the consignee - the physical person or legal entity having the right to the transported load;

the vehicle, the car - the self-moving mechanical system serving for public conveyance, baggage and loads on trackless ways or performing any works and services connected with transportations;

forwarding servicing - the productive activity consisting in the organization of cargo hauling, ensuring its sending and obtaining, accomplishment or the organization of accomplishment of other transactions connected with all stages of transportation;

city transportations - motor transportations of passengers, baggage and loads in city boundaries;

suburban transportations - motor transportations of passengers, baggage and loads between settlements of the Republic of Moldova along routes up to 50 km long inclusive;

long-distance transportations - motor transportations of passengers, baggage and loads between settlements of the Republic of Moldova along routes over 50 km long;

international carriages - motor transportations of passengers, baggage and loads out of limits of the Republic of Moldova or to the Republic of Moldova from abroad;

direct bulk transportations - the public conveyances, baggage and loads the vehicle in interaction with other modes of transport (railway, sea, river or air) performed according to the single transport document for all travel line;

commodity load - the load having material and commodity value;

non-commodity load - the load which does not have material and commodity value;

infrastructure of road transport - bus stations, bus stations, stopping points, car parking facilities, terminals, control platforms, the autoservice companies, gas stations;

bus station (bus station) - the complex of constructions including the building with the waiting room, ticket offices, other rooms and services intended for servicing of passengers and also platforms for landing and disembarkation of passengers, the parking of buses (minibuses);

the autopavilion - construction for protection against bad weather of the passengers expecting the vehicle;

stopping point - specially equipped place where the vehicle stops for landing and disembarkation of passengers;

the terminal - complex of the buildings, constructions and technical means intended for temporary storage, conversion and preparation of loads for transportation;

permission - the document issued in accordance with the established procedure by the central industry body of public management or other representative to them body, allowing business entity to render certain services in the field of motor transportations on resolutive conditions.

Article 4. Public administration by road transport

(1) Public administration road transport is exercised of the central industry body of public management, bodies of local public authority and other bodies authorized by the law according to competence of each of them to provide:

a) requirements satisfaction of national economy in motor transportations of passengers, baggage and loads;

b) creation of conditions for development on the basis of the competition of the motor transportation services rendered by physical persons and legal entities irrespective of type of property and form of business;

c) protection of legal and economic interests of the physical persons and legal entities rendering motor transportation services, and also consumers of these services.
