About highways

The parliament adopts this law.

This law partially shifts appendix I to the Directive 96/53/SE of Council of July 25, 1996 establishing for some vehicles moving on Community, the most admissible dimensions in case of national and international carriages and allowable gross weight in case of international carriages, published in the Official magazine of the European Union by L 235 of September 17, 1996 with the subsequent changes made by Regulations (EU) 2019/1242 European Parliament and Council of June 20, 2019 about establishment of standards of efficiency of emissions of CO2 for new vehicles of big load-carrying capacity, and also about change of Regulations (EU) No. 595/2009 and (EU) 2018/956 of the European Parliament and Council and the Directive 96/53/EU of Council.

This law determines the economic, legal and organizational principles of management, content, development and use of highways.

Article 1. General provisions

(1) This law establishes the economic, legal and organizational principles of administration, content, development and use of highways.

(2) the Purposes of this law are:

a) establishment of the main regulatory base concerning functioning of highways and their use, concerning acquisition and use of the parcels of land adjacent to highways, in respect of management, approval and control of activities in the field of road economy, including concerning respect for interests of users of highways, owners of highways and the state;

b) increase in efficiency of the state administration of activities in the field of road economy;

c) improvement of the investment climate in the field of road economy and the related activities;

d) ensuring integration of national highways into the international transportation network.

(3) In this law the following basic concepts are used:

highways – the land means of communication which are specially equipped for movement of vehicles and pedestrians;

administration of highways – activities which purpose is designing, construction, upgrade, rehabilitation, repair and content of highways, and also management of them;

management of highways – activities, constituent of administration of highways which object is creation and updating of bank of specifications of highways, the inventory of highways; operation and development of system of optimized administration, management of traffic; implementation of inspections and examinations of highways public by means of tool measurements and survey of condition; award of concessions and regulation of use of zones of highways public; ensuring integrity of property of highways;

the parcel of land adjacent to the highway, – highway zone, its conservation zones and zone of streets;

artificial feature - special construction, such as bridges, viaducts, road moving and so on, the means of communication built for the purpose of maintenance and for ensuring its passability in case of availability of obstacles (deep valleys, water currents and others). 

(4) Constituents of the highway are: right of way and safety areas; suprastruktura and infrastructure of the highway; bridges, bridges, ditches, drainage trays, viaducts, moving in two levels, zones under road moving, tunnels and other artificial features; defensive, protective, security and strengthening works of highways; sidewalks, bicycle lanes; parking lots, stops and parking; Items of collection of payment; access stages; the technological roads equipped for content of highways; the route signs and other devices intended for traffic security; smart transport systems and related constructions; office or control sites, sites within visibility triangle at intersections, sites between the highway and/or the highway and access stages; nature protection systems, lands and green plantings in zone of the highway and guardbands, except for conservation zones.

(5) Highways are subject to state registration in the Register of objects of technical infrastructure.

Article 2. Classification of highways

(1) According to the destination highways are subdivided on:

a) public roads – the roads intended for traffic and pedestrians for the purpose of requirements satisfaction in motor transportations of national economy, the population and defense of the country. These roads are public property;

b) privately owned roads – the roads intended for traffic and pedestrians for the purpose of satisfaction of private needs for process economic, forest, oil, mountain, agricultural, energy, industrial and other similar types of activity; access roads to buildings and on-site roads; access roads to building sites. These roads are administered by physical persons or legal entities, or in management of which they are in property.
