About immunoprevention of infectious diseases

The preamble voided according to the Law of the Kyrgyz Republic of 05.07.2017 No. 119

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

immunoprevention of infectious diseases (further - immunoprevention) - system of the actions performed for the purpose of the prevention, restriction of distribution and liquidation of infectious diseases by carrying out preventive inoculations;

preventive inoculations - introduction in human body of medical immunobiological supplies for creation of specific immunity to infectious diseases;

medical immunobiological supplies - vaccines, anatoksina, the immunobiological medicines intended for creation of specific immunity to infectious diseases;

national calendar of preventive inoculations - the regulatory legal act establishing terms and procedure for carrying out to citizens of preventive inoculations;

the vaccine-challenged complications caused by the preventive inoculations included in national calendar of preventive inoculations and preventive inoculations according to epidemic indications (further - vaccine-challenged complications) - heavy and (or) permanent violations of the state of health owing to preventive inoculations;

the certificate of preventive inoculations - the document in which preventive inoculations of the citizen are registered.

Article 1-1. Regulation subject

This Law establishes the legal basis of state policy in the field of the immunoprevention of the managed infectious diseases performed for the purpose of health protection and ensuring sanitary and epidemiologic wellbeing of the population of the Kyrgyz Republic.

Article 2. The legislation of the Kyrgyz Republic in the field of immunoprevention

The legislation of the Kyrgyz Republic in the field of immunoprevention consists of this Law, other laws and other regulatory legal acts of the Kyrgyz Republic accepted according to them.

If the international treaty which came in the procedure established by the law into force which participant is the Kyrgyz Republic establishes other rules than provided by this Law, then rules of the international treaty are applied.

Article 3. Coverage of this Law

Operation of this Law extends to citizens and legal entities of the Kyrgyz Republic, and also to the foreign citizens and persons without citizenship who are constantly living in the territory of the Kyrgyz Republic.

Chapter II. State policy in the field of immunoprevention. The rights and obligations of citizens when implementing immunoprevention

Article 4. State policy in the field of immunoprevention

State policy in the field of immunoprevention is directed to the prevention, restriction of distribution and liquidation of infectious diseases.

In the field of immunoprevention the state guarantees:

- availability to citizens of preventive inoculations;

- free carrying out the preventive inoculations included in national calendar of preventive inoculations, and preventive inoculations according to epidemic indications in State Healthcare Institutions according to the Program of the state guarantees for providing citizens of the Kyrgyz Republic with the medical and sanitary help;

- social protection of citizens in case of vaccine-challenged complications;

- development and implementation of national target and regional programs;

- use for implementation of immunoprevention of effective medical immunobiological supplies;

- state quality control, efficiency and safety of medical immunobiological supplies;

- support of scientific research in the field of immunoprevention and development of new medical immunological supplies;

- inclusion in the state educational standards of training of health workers of questions of immunoprevention;

- enhancement of system of statistical observation;

- providing single state information policy;

- development of international cooperation.

Realization of state policy in the field of immunoprevention is provided by the Government of the Kyrgyz Republic and executive bodies on places.

Article 5. The rights and obligations of citizens when implementing immunoprevention

Citizens of the Kyrgyz Republic when implementing immunoprevention have the right:

- on obtaining from health workers of the complete and objective information about need of preventive inoculations, consequences of refusal of them, possible vaccine-challenged complications;

- at choice of healthcare institutions with state, municipal, private and other patterns of ownership;

- on free preventive inoculations in State Healthcare Institutions according to the Program of the state guarantees for providing citizens of the Kyrgyz Republic with the medical and sanitary help;

- on receipt of the paid preventive inoculations which are not included in national calendar of preventive inoculations in healthcare institutions of the state, municipal, private and other pattern of ownership;

- on free medical examination, and if necessary and physical examination before preventive inoculations in State Healthcare Institutions;

- on free treatment in State Healthcare Institutions in case of vaccine-challenged complications;

- on social protection in case of vaccine-challenged complications;

- on refusal of preventive inoculations if other is not provided by other regulations.

Lack of preventive inoculations attracts:

- prohibition for citizens on departure to the countries, stay in which according to the international medical and sanitary rules or international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic requires specific preventive inoculations;

- temporary refusal in reception of citizens in organizations of education and improving organizations in case of mass infectious diseases or in case of threat of emergence of epidemics;

- refusal in reception of citizens for works or discharge of citizens from works which accomplishment is connected with high risk of disease of infectious diseases.

The list of works which accomplishment is connected with high risk of disease of infectious diseases and requires obligatory carrying out preventive inoculations, is established by the Government of the Kyrgyz Republic.

The part four of Article 5 voided according to the Law of the Kyrgyz Republic of 05.07.2017 No. 119

When implementing immunoprevention citizens shall:

- implement instructions and recommendations of health workers;

- in writing to confirm refusal of preventive inoculations.

Parents or his legal representatives bear for the refusal of preventive inoculation which entailed development of disease of the minor, responsibility.
