About troops of carabineers (internal troops) of the Ministry of Internal Affairs

Chapter I General provisions

Article 1. Troops of carabineers (internal troops) of the Ministry of Internal Affairs

Troops of carabineers (internal troops) are intended for maintenance together with police or by own efforts public order, protection of the rights and fundamental freedoms of citizens, property of the owner, prevention of violations of the law.

Troops of carabineers are component of Armed forces and participate in defensive actions according to the law.

Troops of carabineers, being component of organizational structure of the Ministry of Internal Affairs, treat Department of troops of carabineers and perform the functions and tasks in all territory of the republic under its management and control.

The Ministry of Internal Affairs bears complete responsibility for management of troops of carabineers, the organization of accomplishment of the tasks assigned to them, training of staff, respect for military discipline and regulations, their material, financial and medical support.

All activities of troops of carabineers are depoliticized and are performed only on the basis and in pursuance of the law.

Article 2. Main objectives of troops of carabineers

The main objectives of troops of carabineers are:

a) permanent providing according to the law together with police of measures for protection of law and order, protection of the rights, fundamental freedoms and legitimate interests of citizens;

b) assistance to police agencies or independent actions for maintenance of public order and fight against crime;

c) implementation of protection of correctional institutions and convoy of arrested and the condemned persons during their movement;

d) protection and protection of objects and loads of special importance;

e) participation in ensuring compliance with legal regime of emergency, obsidional and warlike situation;

e) participation in mitigation of consequences of accidents or emergency situations of natural, technogenic or ecological nature.

Use of troops of carabineers for the solution of the tasks which are not connected directly with ensuring public order, protection of the rights and fundamental freedoms of citizens, property of the owner, prevention of violations of the law is performed only based on the resolution of Parliament, and in extreme situations - according to the presidential decree of the Republic of Moldova.

Article 3. Principles of activities of troops of carabineers

Troops of carabineers build the activities on the principles of legality, centralized management, one-man management, social justice, humanity and observance of the rights of the personality.

Article 4. Structure of troops of carabineers and principles of management of them

Troops of carabineers are organized on the army principles and consist of command of troops, crews (regiments) and territorial battalions.

The structure and numerical structure of troops of carabineers affirm the President of the Republic of Moldova.

Parts of troops of carabineers depending on office tasks can be: operational and mobile; on protection of especially important objects; on protection of special loads; patrol and point-policemen; on protection of executive and labor organizations and convoy.

The states of parts and divisions of troops of carabineers affirm the Minister of Internal Affairs.

Management of troops of carabineers is performed of the deputy minister of internal affairs - the head of the department of troops of carabineers through commanders of parts.

The right to give orders to operational and mobile parts of carabineers for the purpose of accomplishment of tasks during emergency state is had:

a) the Minister of Internal Affairs - to all parts of troops of carabineers;

b) the head of the department of troops of carabineers - to the level of crew (regiment);

c) the commander of crew (regiment) - to battalion level;

d) the commander of battalion - to company level.

In the period of emergency, obsidional or warlike situation when there is explicit danger of the actions menacing to homeland security, constitutional order and life of citizens in case of natural disasters or catastrophic crashes of part and division of troops of carabineers can be used at the discretion of commanders of crews (regiments), battalions who report further on higher command on the taken measures.

The battalion is the main operational unit of troops of carabineers providing protection of public order in one or several areas.

The battalion consists of variable quantity of companies, platoons and departments of carabineers.

The company of carabineers provides protection of secure procedure in several communes. The senior officer orders it. It has variable quantity of platoons in the subordination. In places of dislocation it has at the order the necessary number of officers for management and control of service, and also reserve of the military personnel of conscription service for accomplishment of operational tasks.

The platoon of carabineers provides protection of public order in three-five communes. The junior officer orders it. It has the variable number of departments in the subordination. In places of dislocation it has at the order reserve of the military personnel of conscription service for accomplishment of operational tasks.

The department of carabineers provides protection of public order in one commune and is under supervision of policy station. The department consists of three-five carabineers. The subofficer (sergeant) who is under operational supervision of the local police inspector orders it.

Article 5. Dislocation of troops of carabineers

Dislocation of troops of carabineers affirms the President of the Republic of Moldova on representation of the Minister of Internal Affairs.

Article 6. Legal basis of activities of troops of carabineers

Troops of carabineers in the activities are guided by the Constitution this Law, other legal acts, presidential decrees of the Republic of Moldova, the orders of the Government, articles of war, orders, orders and instructions of the Minister of Internal Affairs and head of the department of troops of carabineers.

Relations of troops of carabineers with bodies of local public authority are under construction on the basis of provisions of this Law. Nobody, except state bodies and officials, directly on that the authorized legislation having the right to interfere with activities of troops of carabineers in case of accomplishment of service duties by them.
