About approval of the Regulations on assessment and accreditation of educational institutions

(as amended on 21-07-2005)

In pursuance of the Education law and Law on assessment and accreditation of educational institutions of the Republic of Moldova

The parliament adopts this ordinary law.

Art. 1. - Approve Regulations on assessment and accreditation of educational institutions according to the appendix which is integral part of this law.

Art. 2. - To the government to take necessary measures for realization of the specified provision.

Regulations on assessment and accreditation of educational institutions

1. This provision is developed according to the Education law and the Law on assessment and accreditation of educational institutions of the Republic of Moldova.

2. Assessment and accreditation of educational institutions of all levels and any pattern of ownership are prerogative of the Ministry of Public Education and are performed by Department by assessment and accreditation of educational institutions (further - Department) operating within the Ministry of Public Education.

3. The ministry resolves issues of creation of ad hoc commissions by assessment and accreditation within the opportunities and the approved assignments. Ad hoc commissions are the standing bodies updating one third of the structure each four years and performing the activities on the basis of the regulations approved by the Government. The chairman and the secretary of ad hoc commission are appointed by the ministry.

4. The procedure of the academic assessment and accreditation of educational institution is based on complex of general criterions and mandatory standards. Criteria cover the main areas of the organization and functioning of educational institution: pedagogical personnel, education content, material and technical resources, research (in the higher and post-university education) and financial and economic activities. Each criterion has the standard reflecting the obligatory minimum level of the sphere of activity estimated by this criterion.

5. Creation of the state educational institution or licensing for activities of private educational institution of any of level and step of education and form of education, and also creation of new division or change of structure of the operating educational institution are performed according to the procedure, established by the legislation.

6. The newly created educational institution has the right to enlist, deduct and recover pupils and students, to employ and advance pedagogical and pedagogiko-auxiliary personnel, administrative personnel on service, to create educational and material and technical resources.

7. Accreditation of educational institution is performed in the following procedure:

the educational institution which is subject to accreditation submits the relevant ad hoc commission the report on self-assessment which approximate indicators are provided in appendix to this provision;

ad hoc commission, having taken the report of educational institution on self-assessment into account and considering results of spot test, prepares idea of accreditation of educational institution in general and/or its divisions and brings it in Department;

The department on the basis of representation to ad hoc commission prepares the decision on accreditation or not accreditation of educational institution which represents boards of the Ministry of Public Education;

to accredited educational institution the certificate of the sample approved by the Ministry of Public Education signed by the minister and the secretary of board of the ministry is issued.

8. Annually till August 1 the ministry constitutes and approves the plan of assessment and accreditation of educational institutions for the next calendar year.

9. The estimates included in the plan and accreditations educational institutions submit to the ministry the report on self-assessment according to Item 15, and a month before the beginning of assessment - the document confirming fee by assessment and accreditation.

10. The decision on not accreditation of educational institution or its separate divisions becomes effective at the end of the academic year during which it was accepted.

11. Private educational institutions pay services in assessment and accreditation from own means. For the state educational institutions included in the plan of assessment and accreditation, higher bodies provide in means expense budget for payment of the specified services respectively from the government budget, budgets of administrative and territorial units and/or from special means.

12. The financial resources received from fee by assessment and accreditation of educational institutions arrive into the special account of the ministry and are used according to the instructions concerning special means of the organizations financed from the budget.

13. The size of service fee by assessment and accreditation of educational institutions and payment procedure of work of members of ad hoc commissions are established by the Government according to the offer of the ministry approved with the Ministry of Finance and the Ministry of Labour, Social Protection and Family.

I. PEDAGOGICAL PERSONNEL

1. The states and pedagogical personnel at the time of filing of application about accreditation.

2. List of names of pedagogical employees of elementary school, gymnasium, lyceum, other douniversitetsky educational institutions.

2.1. Basic education and pedagogical category.

2.2. Age structure.

2.3. Security with academic load.

2.4. State of health of pedagogical workers and pedagogiko-support personnel. Medical leave (number of days).

3. Security of higher educational institution with regular pedagogical personnel; compliance to standard rates.

4. List of names of teachers of higher educational institution (faculty, specialty).

4.1. Basic education.

4.2. Scientific and pedagogical rank.

4.3. Academic degree.

4.4. Academic load on one teacher of faculties and specialties.

4.5. Quantitative ratio of pedagogical and pedagogiko-auxiliary personnel.

5. Hiring form (in the state, in combination). Assessment of pedagogical activities of the teachers working part-time.

6. Academic and creative freedom of the pedagogical worker.

7. The working atmosphere in higher educational institution (creative, conflict and so forth).
