The parliament adopts this law.

Chapter I General provisions

Article 1. Basic concepts

The main terms used in this law have the following

semantic content:

the publication - any type of the carrier of the textual, audiovisual and other information reproduced for the purpose of distribution, sale or public use;

the unpublished document - any type of the data carrier, not intended for distribution or sale;

library stock - the collection of publications and unpublished documents which is systematically completed and organized according to certain principles, regulations and rules;

the user - the physical person and legal entity or community using services of library;

the founder (owner) of library - physical person and legal entity, the creating, containing and liquidating library stock or this organization.

Article 2. Library

Library - public or private organized fund of publications and unpublished documents, information, cultural and educational or the organization acquiring, storing and organizing similar funds for the purpose of requirements satisfaction of users in reading and receipt of information.

Article 3. Principles of activities

Libraries perform the activities, being guided by policy in the field of culture, educations, science and information which is carried out by their founders according to the current legislation. The principles of activities of libraries are general availability, political neutrality, professional autonomy.

Article 4. Functions

Functions of libraries are determined by their founders according to their types and types.

Article 5. Types and types

(1) Depending on appointment of library are subdivided into the following types:

a) specialized libraries;

b) libraries of educational institutions;

c) public libraries.

(2) Depending on accessory of library are subdivided into the following types:

a) state libraries;

b) public libraries;

c) private libraries.

Article 6. Specialized libraries

(1) Specialized libraries provide information and documents on one or several allied industries.

(2) Specialized libraries are created under Parliament, the ministries and departments, at the companies and in organizations irrespective of their type of property, within professional, creative, cult and other domestic and foreign associations, societies and the organizations or physical persons according to the current legislation

Article 7. Libraries of educational institutions

Libraries of educational institutions perform the activities under educational institutions, have the appropriate training programs, funds and serve tasks of ensuring educational and research process.

Article 8. Public libraries

(1) Public libraries - the funds of universal nature or library organizations having similar funds - are intended for a wide range of users and carry out tasks of maintenance of high level of culture, civilization and education in society.

(2) Public libraries function as:

a) state, organized on territorial printsipuv each settlement, subdivided according to administrative-territorial division on rural, city, municipal, district, submitting to bodies of local public authority;

b) state, organized by the departmental principle, being under authority of the relevant ministries and departments;

c) public, submitting to management of the corresponding associations, societies and organizations;

d) private, provided for public use of their owners.

Article 9. National library system

(1) the National library system represents set of the library networks and bibliotekovedchesky centers organized by the territorial and industry principle, created and containing the state for the purpose of satisfaction of information, educational and cultural interests and requirements of society and submitting to the single coordinating body.

(2) enter national library system:

a) National library of the Republic of Moldova;

b) network of public libraries of system of the Ministry of Education, culture and researches;

c) network of libraries of the educational institutions subordinated to the Ministry of Education, culture and researches;

d) specialized libraries of the ministries, departments and other government and non-governmental structures.

(3) the Status of the bibliotekovedchesky center allocates the main library of territorial or departmental network which is performing bibliotekovedchesky functions and having the corresponding organizational structure. The charter, structure and the budget of the bibliotekovedchesky center are determined by his founder.

Article 10. National library of the Republic of Moldova

(1) the National library of the Republic of Moldova is created and functions under the authority of the Ministry of Education, culture and researches.

(2) the National library performs the following functions:

a) collects, owns and provides to users the most complete collection of national editions, valuable foreign publications, manuscripts, audiovisual and multimedia materials etc.;

b) collects, stores and masters the Moldovica collection consisting of the publications about the Republic of Moldova which appeared in the country and abroad including works of the local authors published abroad;

c) performs monitoring of national reserve of publications;

d) constitutes national summary catalogs;

e) provides interaction of public libraries, giving them specialized help;

f) constitutes fundamental bibliographies on different areas of knowledge;

g) participates in preparation of the Section "Exteriorica" of "The national bibliography of Moldova";

h) performs functions of the center depositary of publications of the UN and UNESCO in the Republic of Moldova;

i) performs functions of the national center for exchange of publications.

(3) Activities of National library are regulated by its charter approved by the Ministry of Education, culture and researches.

Article 11. Public libraries

Public libraries are created as public property.

Article 12. Private libraries

Private libraries belong to physical persons which are free in determination of their content and their provision in public use.
