About fauna

The parliament adopts this law.

The fauna as one of the main components of natural biocenoses, plays important role in maintenance of ecological equilibrium. Number of animal species are source for the receipt of industrial, medicinal raw materials, foodstuff and other material values necessary for requirements satisfaction of the population and national economy, other types are used in the scientific, cultural and educational and esthetic purposes.

This law is the legal basis for ensuring effective protection and rational use of resources of fauna.

Section I General provisions

Article 1. Law coverage

(1) This law governs the relations in the field of protection and use of wild animals - mammals, birds, reptiles, amphibiouses, fishes, insects, Crustacea, mollusks, etc. (further - animals), living in condition of natural freedom on the land, in water, the atmosphere and the soil, constantly or temporarily inhabiting the republic territory.

(2) the Relations in the field of protection and use of pets, and also the wild animals containing in bondage or in semi-bondage for the economic, scientific, cultural and educational and esthetic purposes are regulated by the relevant legislation.

Article 2. Determination of special terms

Value of the terms which are found in the text of this law:

the rare and being under the threat of disappearance animals - animal species to which disappearance which met quantity of individuals are not enough for recovery and self-preservation of population under natural conditions threatens;

specially protected territory for avifauna – the natural space intended for preserving, maintenance and – depending on circumstances – recoveries of the favorable security status of bird species and specific habitats for the purpose of protection of the migrating types of wild birds;

biocenosis - the biological system representing set of populations of different types of the animals, plants and microorganisms inhabiting certain biotope;

biotope - the limited living floor space with rather homogeneous ecological conditions inhabited by characteristic biocenosis;

collections of animals of wild fauna - series of live animals or their effigies and medicines which are brought together, exposed and stored in zoos or the museums and being of scientific, art and other value;

ecological equilibrium - set of conditions of ecosystem which dynamics provides stability of its structure and functions;

the state fund of especially protected natural territories - the representative territory representing the scientific, historical, esthetic, cultural and educational value on which rare and valuable animal species and plants and their community live;

hunting complex - the protected or not protected hunting grounds more than 200 hectares forest and/or farmlands on which okhotkhozyaystvenny events are held - are created fodder fields, solonetzic soils, watering places, feeding troughs and other shoddy constructions for stable and long-term reproduction of hunting fauna - and to whom hunting is carried out. The hunting park and/or the hunting open-air cage can be part of hunting complex;

habitat - the area or type of the area where the organism or population exists in natural type;

the hunting park - the protected hunting grounds from 10 to 200 hectares forest and/or farmlands for content of hunting fauna in bondage and carrying out hunting for it;

waste product of animals - the results of life activity of animals used by society for the needs without withdrawal of animals from their natural environment;

useful property of animals - the line characterizing usefulness of animals for the environment, the populations, rural and forestry, etc.;

industrial fishery - stocking, cultivation and production of fish in the food purposes;

sports and amateur fishery - production of fish for private use;

regulation of number of hunting animals – catching of live animals, their immobilization, resettlement, killing, sports and amateur and selection hunting for wild animals in case of exceeding of their optimum number and in case of epizooty;

fauna - the largest systematic category in biology, set of the animal species which are living under natural conditions on the land, in water, the atmosphere and the soil, including the elementary, backboneless and chordate animals;

selection hunting – hunting actions for production from populations of settled hunting animals (hoofed mammals) of individuals degenerate, sick, wounded, with explicit variations in behavior, both floors and all age groupes;

sports and amateur hunting - search, tracing, prosecution by the person of animals for the purpose of production of trophies for private consumption;

the hunting open-air cage - the protected hunting grounds up to 10 hectares forest and/or farmlands for content of hunting fauna in bondage for the purpose of its reproduction and carrying out nataska of dogs of hunting breeds, the organization of competitions and testing of dogs.

Article 3. Property on fauna

(1) the Fauna is property of the state. Ensuring protection and preserving fauna is obligation of the state.

(2) Resources of fauna can be used according to Section III provisions.
