About chemical safety
This Law determines the legal basis of protection against harmful effects of chemistry on life, health of the person and the environment, uses of chemicals for the benefit of economic, social and other development, work with them, providing the rights of consumers, and also the legitimate interests of the state connected with activities in the field of chemistry.
In this Law the following concepts are used:
1) control zone - the territory which is outside the sanitary protection zone on which work on chemical control is carried out;
2) chemical infection - distribution of dangerous chemicals in the environment in the concentration or quantities creating threat for the person during certain time;
3) zone of chemical infection - the territory within which dangerous chemicals in the concentration or quantities creating threat for the person during certain time are widespread or cumulative;
4) chemically dangerous objects - objects of production, storage, use and transportation of dangerous chemicals on which in case of accident there can be chemical infection;
5) chemical accident - the accident which is followed by leakage or emission of dangerous chemicals from processing equipment or the damaged container capable to lead to death or infection of people or pollution with dangerous chemicals of the environment in concentration, dangerous to the person;
6) chemical threat - the potential reason of harm arising in chemical production and when using chemical products;
7) the period of life activity of chemical products - time of production, use, storage, transportation, realization, destruction and neutralization of chemical products;
8) chemical weapon - toxic chemicals and their precursors which can be used for production of the ammunition and any other devices which are specially intended for deadly defeat or causing other harm due to their toxic properties;
9) dangerous chemical - chemical or set of the chemicals capable to do harm to life and health of the person and the environment;
10) chemically dangerous wastes - waste which owing to reactionary capability or toxicity independently or in case of the introduction in contact with other waste and the environment pose direct hazard to life and health of the person, state of environment;
11) chemical safety of the population - condition in case of which by observance of precepts of law and sanitary hygienic rules, accomplishment of production and technical requirements, and also holding the relevant organizational and special events is excluded conditions for chemical infection or defeat of people, environmental pollution by dangerous chemicals;
12) precursor - any chemical reagent participating on any production stage of toxic chemical;
13) toxic chemical - any chemical which in total or separately due to the chemical impact on vital processes can cause lethal outcome, the temporary paralyzing effect or to do permanent harm to the person or animals;
14) risk assessment - the package of measures, the dangerous chemicals directed to identification of possible impact for life and health of the person, the environment including determination of degree of dangerous concentration.
1. The legislation of Turkmenistan on chemical safety is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.
2. If the international treaty of Turkmenistan establishes other regulations than provided by this Law, then regulations of the international treaty are applied.
