About the central executive bodies

This Law determines the organization, powers and procedure for activities of the central executive bodies of Ukraine.

Section I. General provisions

Article 1. Determination and system of the central executive bodies

1. The system of the central executive bodies is constituted by the ministries of Ukraine (further - the ministries) and other central executive bodies.

The system of the central executive bodies is component of system of executive bodies which supreme body is the Cabinet of Ministers of Ukraine.

2. The ministries provide forming and realize state policy in one or several spheres, other central executive bodies perform separate functions on realization of state policy.

Powers of the ministries, other central executive bodies, extend to all territory of the state.

Article 2. Principles of activities of the ministries and other central executive bodies

1. Activities of the ministries and other central executive bodies are based on the principles of supremacy of law, ensuring compliance with rights and freedoms of man and citizen, continuity, legality, ensuring unity of state policy, openness and transparency, responsibility.

2. The ministries are effective by the principle of one-man management. Other central executive bodies are effective by the principle of one-man management if other is not provided by the law.

3. The companies, the organizations and the organizations relating to the sphere of management of the ministries, other central executive bodies cannot perform powers of authority, except the cases determined by the law.

Article 3. Legal principles of activities of the ministries, other central executive bodies

1. The ministries, other central executive bodies in the activities are guided by the Constitution of Ukraine, it and other laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation of Ukraine.

2. The organization, powers and procedure for activities of the ministries, other central executive bodies are determined by the Constitution of Ukraine, present and other laws of Ukraine.

3. Regulations on the ministries, other central executive bodies are approved by the Cabinet of Ministers of Ukraine.

Article 4. Status and attributes of the ministries, other central executive bodies

1. The ministries and other central executive bodies are legal entities of the public law.

The ministries, other central executive bodies acquire the status of the legal entity from the date of entering into the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming of record about their state registration as legal entity.

The ministries, other central executive bodies stop as legal entities from the date of entering into the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming of record about state registration of their termination.

2. The ministry, other central executive body has seal with the image of the State Emblem of Ukraine and the name, own forms, accounts in bodies of the Public treasurer service of Ukraine.

Article 5. Education, reorganization and liquidation of the ministries and other central executive bodies

1. The ministries and other central executive bodies will be formed, will be reorganized and liquidated by the Cabinet of Ministers of Ukraine on representation of the Prime Minister of Ukraine.

3. 7. The ministries, other central executive bodies concerning which the act of the Cabinet of Ministers of Ukraine of their termination became effective continue to perform powers and functions in certain spheres of competence before completion of implementation of actions by training of the ministry, other central executive body to which pass powers and functions of the ministry, other central executive body which stops, and possibilities of ensuring implementation by it of these functions and powers about what the relevant act of the Cabinet of Ministers of Ukraine is issued.

Provisions of paragraph one of this part are effective also if to the Ministry, other central executive body which is formed powers and functions of the ministry are delegated, to other central executive body which continues to function and also if to the Ministry, other central executive body powers and functions of the ministry are delegated, to other central executive body without formation of the new ministry, to other central executive body.

8. The act of the Cabinet of Ministers of Ukraine of reorganization of the ministry, other central executive body determines legal successors of the reorganized body to whom pass powers and functions, property, the rights and obligations of such body.
