1. Approve Regulations on procedure for issue and exchange of the car driver license for the right of control of the moped, the motorcycle, the car, structure of vehicles, tram, trolleybus, and also the international car driver license it (is applied).

2. This resolution becomes effective in 10 days after its official publication.

Regulations on procedure for issue and exchange of the car driver license for the right of control of the moped, motorcycle, car, structure of vehicles, tram, trolleybus, and also issues of the international car driver license

Chapter 1. General provisions

1. This Provision determines procedure for issue and exchange of the car driver license for the right of control of the moped, motorcycle, car, structure of vehicles, by tram, trolleybus (further, unless otherwise specified, – the car driver license), exchange of the car driver license of sample of the Ministry of Internal Affairs of the USSR, and also issue of the international car driver license.

2. In this Provision terms and their determinations in the values determined by the Law of the Republic of Belarus "About traffic" (further – the Law) and the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures" are applied.

3. Issue of the car driver license, acceptance of theoretical and (or) practical qualification examinations (further – examination) are performed by authorized body in which zone of servicing is:

the residence or the place of stay of physical person if according to the legislation person shall be registered in the place of stay (further – check-in location);

the organization which granted the certificate on preparation, retraining, advanced training of drivers of motorized vehicles, self-propelled machines (further – the certificate on preparation).

Exchange, issue of the car driver license instead of the lost (kidnapped person), and also issue of the car driver license instead of the car driver license of sample of the Ministry of Internal Affairs of the USSR and the international car driver license are performed by authorized bodies regardless of check-in location of citizens.

The form of the form of the international car driver license is established by the Ministry of Internal Affairs (further – the Ministry of Internal Affairs).

The military personnel undergoing compulsory military service, cadets of the organizations of education performing training on specialties of military profile for Armed Forces or bodies of the border service, persons directed to study by military commissariats, and also pupils of day form of education of the organizations of education realizing educational programs of professional, secondary vocational, higher education, having the right to take examination and to receive the car driver license in authorized body in which zone of servicing the military unit or organization of education is located.

4. The documents issued by competent authorities of foreign states for issue of the car driver license are accepted in the presence of their legalization or putting down of apostille if other is not stipulated by the legislation or international treaties of the Republic of Belarus.

The documents constituted in foreign language shall be followed by transfer into the Belarusian and (or) Russian languages, attested notarially if other is not stipulated by the legislation about ministerial procedures.

5. On the right of management of which the car driver license is issued to category and subcategory of motorized vehicles (further – the vehicle), are determined in part two of article 24 of the Law.

Chapter 2. Issue and exchange of the car driver license, issue of the international car driver license

6. The car driver license is issued based on the statement in form according to appendix 1 and in case of submission of the documents and (or) data provided by the list of the ministerial procedures performed by state bodies and other organizations for the petitions from citizens approved by the Presidential decree of the Republic of Belarus of April 26, 2010 No. 200 (further – the list):

to person who had training, retraining of transport drivers (except for wheel tractors) (further – preparation), or as an exceptional case, provided in Item 15 of this provision, without preparation passing (Item 15.1 of the list);

to person having the car driver license issued by foreign state (Item 15.2 of the list);

to the employee of diplomatic, consular representation and members of his family, the employee of the international organization, representative office of the international organization accredited under the Ministry of Foreign Affairs and members of his family (Item 15.3 of the list).

7. Filing of application on implementation of the ministerial procedure provided in Item 15.1 of the list is preceded by delivery in the authorized body determined in part one of Item of 3 this provision, examination:

theoretical and practical – for receipt of the car driver license on the right of control of vehicles of categories "A", "B", "C", subcategories of "A1";

practical – for receipt of the car driver license on the right of control of vehicles of categories "D", "VE", "SE", "DE";

theoretical – for receipt of the car driver license on the right of control of vehicles of categories "AM", "F", "I".

8. The ministerial procedures provided in Items 15.1 and 15.2 of the list in the presence of the car driver license issued by the State automobile inspection (further – GAI) the Ministry of Internal Affairs, or the car driver license of sample of the Ministry of Internal Affairs of the USSR are performed without passing theoretical examination if such examination is provided by this Provision.

9. The car driver license on the right of control of vehicles of category "AM" is issued or the specified category joins in the car driver license without passing an examination in case of:

availability of the car driver license on the right of control of vehicles or the self-propelled machine;
