3. Replace in Item 26 of standards of disclosure of information by the subjects of natural monopolies rendering transportation services of oil and the oil products on bulk distribution lines approved by the order of the Government of the Russian Federation of October 18, 2010 N 844 (The Russian Federation Code, 2010, N 43, the Art. 5514), the word of "gas" words of "oil and oil products".

4. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

Rules of ensuring non-discriminatory access to services of subjects of natural monopolies in oil transportation (oil products) on bulk distribution lines in the Russian Federation

I. General provisions

1. The these rules developed according to the Federal Laws "About Protection of the Competition" and "About Natural Monopolies" determine procedure for providing for any persons performing activities in the territory of the Russian Federation, non-discriminatory access to services of subjects of natural monopolies in oil transportation (oil products) on bulk distribution lines for the purpose of consumption in the domestic market of the Russian Federation and supply activity out of limits of the territory of the Russian Federation.

2. In these rules the following concepts are applied:

"applicant" - person wishing to become the consumer of transportation services of oil (oil products) on bulk distribution lines;

"non-discriminatory access to services of subjects of natural monopolies in oil transportation (oil products) on bulk distribution lines" - providing for any persons of equal conditions of access to transportation services of oil (oil products) on bulk distribution lines in the presence of technology connection;

"operator" - the subject of natural monopoly providing rendering transportation services of oil (oil products) on bulk distribution lines;

"consumer" - the person who is the owner of oil (oil products) or owning it on other legal cause and meeting requirements of these rules, got in accordance with the established procedure access to transportation services of oil (oil products) on bulk distribution lines;

"point of departure" - initial delivery and acceptance point of route of transportation (oil delivery point (oil products) from the consumer);

"destination" - final delivery and acceptance point of route of transportation (Item of delivery or shipment of oil (oil products) to the consumer);

"delivery and acceptance point" - Item on accounting of quantity and quality evaluation of oil (oil products) on which the division of the accepting and handing over parties carries out transactions on acceptance delivery of oil (oil products).

3. The operator performs informing on conditions of receipt of access to transportation services of oil (oil products) on bulk distribution lines according to standards of disclosure of information by the subjects of natural monopolies rendering transportation services of oil and oil products on bulk distribution lines, approved by the order of the Government of the Russian Federation of October 18, 2010 N 844.

4. Connection of object of oil production to the bulk distribution line is performed according to the Rules of connection of objects of oil production to trunk oil pipelines in the Russian Federation and accounting of the subjects of business activity performing oil extraction approved by the order of the Government of the Russian Federation of February 17, 2011 N 90.

5. Connection of oil refinery to the bulk distribution line is performed in compliance by the Rules of connection of oil refineries to trunk oil pipelines and (or) oil pipelines and accounting of oil refineries in the Russian Federation approved by the order of the Government of the Russian Federation of December 21, 2009 N 1039.

II. Transportation services of oil (oil products)

6. Transportation services of oil (oil products) are provided by the operator based on the oil transportation agreement (oil products) on bulk distribution lines (further - the agreement) concluded by the operator and the consumer in accordance with the legislation of the Russian Federation and containing the following essential conditions:

a) procedure for acceptance, transportation and delivery of oil (oil products);

b) quantity and quality to the subject oil transportation (oil products);

c) points of departure and destinations;

d) payment procedure of transportation services of oil (oil products) consumer;

e) rights and obligations of the Parties of the agreement;

e) procedure for dispute settlement;

g) force majeure circumstances (force majeure);

h) responsibility of the parties for non-execution or improper execution of terms of the contract;

i) procedure for adjustment of quantity and quality to the subject oil transportation (oil products), terms of the beginning and the termination of oil supply (oil products), the points of departure and destinations, and also procedure of control of condition and application of oil metering stations (oil products).

7. The agreement is signed for 1 calendar year.

8. In case of agreement performance the consumer shall:

a) provide compliance intended for oil transportation (oil products) to requirements of technical regulations, standards and specifications;
