About international treaties of the Republic of Moldova

Chapter I General provisions

Article 1. Scope

(1) This law is applied to international treaties of the Republic of Moldova and determines procedure for initiation, negotiating, signing, entry into force, application, suspension, denouncement or cancellation of agreements.

(2) Initiation, negotiating, signing, entry into force, application, suspension, denouncement or cancellation of international treaties of the Republic of Moldova are performed according to the principles and rules of international law, the Convention on the right of international treaties (Vienna, 1969), the Constitution of the Republic of Moldova, this law, and also provisions of international treaties which party is the Republic of Moldova.

(3) the Public agreements and other agreements which are not regulated by regulations of the international public law are not international treaties.

(4) In case of the conclusion of public agreements, except the agreements regulated by special regulations, the responsible body applies rules and requirements imposed to international treaties according to the special procedure established by the Government. The public agreements having financial effects except the agreements regulated by special laws without fail receive the decision of the Commission of Parliament on foreign policy and the European integration, affirm the Government and are submitted Parliament according to the procedure, established by the Government.

Article 2. Basic concepts

For the purposes of this law the following basic concepts are applied:

the international treaty (which is referred to as further also the agreement) - any agreement signed by the Republic of Moldova in writing intended to have legal effects and regulated by regulations of the international public law irrespective of, it consists of one document or of two or several documents connected among themselves, and also from the name (the agreement, the agreement, the convention, the general act, the pact, the memorandum, exchange of notes, the protocol, the declaration, the charter, the final act, the modus vivendi, the arrangement, etc., at the same time all of them have identical legal force);

the body responsible for the conclusion of the agreement, – the ministry, other central administrative authority or other authorized institution of the Republic of Moldova to which direct duties according to the legislation preparation of the international treaty belongs or which is authorized on that by the President of the Republic of Moldova or the Government of the Republic of Moldova;

powers - the document issued by the Minister of Foreign Affairs by means of whom one or several authorized persons are designated to represent the state for negotiating, adoption of the text of the international treaty or establishment of its authenticity, expression of consent of the Republic of Moldova to obligation for it of the agreement or making of any other act relating to the agreement;

initiation of negotiations - the message the Moldavian side to other party of the intention to sign the international treaty (whether it be transfer of the draft agreement or its bastings or the offer on resumption of negotiations) or acceptance of similar initiative of other party;

negotiation - stage of process of the conclusion of the international treaty throughout which the parties start discussion of elements of its content and form for the purpose of development of the final text;

initialing - establishment of authenticity of the text of the international treaty at stage of completion of negotiations by putting down on the text of the agreement of initials of authorized persons of the State Parties of negotiations;

agreement signature - the act of establishment of authenticity of the text of the international treaty performed by authorized persons of the states or method of expression of consent of the Republic of Moldova to obligation of the agreement for it;
