About the consular fees
The Parliament adopts this organic law.
This law regulates the legal basis of establishment and collection of charges for rendering the consular services provided by the Ministry of Foreign Affairs and European Integration, diplomatic representations including permanent missions under the international organizations, and consular establishments of the Republic of Moldova.
In this law the stated below terms and expressions are used in the following value:
the consular fee - the payment brought in the government budget by the physical persons or legal entities which are or not being residents for rendering the consular services provided by the Ministry of Foreign Affairs and European Integration and diplomatic representations including permanent missions under the international organizations and consular establishments of the Republic of Moldova (further - organizations of diplomatic service);
the consular employee - person as a part of organizations of diplomatic service, authorized to render consular services;
consular legalization - action according to the signature attestation of person and the seal which is put down on the official document issued by organization of other state which will have legal force in the Republic of Moldova; action according to the signature attestation of person and the seal which is put down on the official document issued by organization of the Republic of Moldova which will have legal force in other state;
the visa - the permission issued to the citizen of other state or the stateless person, granting the right to entrance or transit across the territory of the Republic of Moldova, and also the stay right to territories of the country during certain term;
the passport of the dead - the document issued by organizations of diplomatic service, resolving transportation of body of the died person from other state including transit across the territory of the third state, to the Republic of Moldova;
the accompanying expenses - the expenses incurred by organizations of diplomatic service in connection with provision of consular services; the native of the Republic of Moldova - person who was born in the present territory of the Republic of Moldova who can submit the relevant document to the proof of it.
the document on trip - the temporary document for one-time entry into the Republic of Moldova which is issued to citizens of the Republic of Moldova to persons without nationality - to owners of the right to permanent or temporary stay in the Republic of Moldova, and also foreign citizens owners of the right to permanent or temporary stay in the Republic of Moldova who for the objective reasons could not receive the travel document in diplomatic representations or consulates of the state which citizens are in case these categories of persons are outside the Republic of Moldova and have no valid travel document for return to the Republic of Moldova.
permission to emigration - the formal permission of authorities of the Republic of Moldova on departure for permanent residence abroad.
(1) Subjects of collection are physical persons and legal entities of the Republic of Moldova, and also the foreign persons who are residents or not being residents and stateless persons.
(2) For stateless persons the same charges, as for citizens of the state of their stay are provided.
The consular fee is levied for:
a) registration of document package on receipt of the passport of the citizen of the Republic of Moldova and on receipt of the identity certificate of the citizen of the Republic of Moldova;
b) consular legalization;
c) request of the document or information;
d) consideration of the applications concerning nationality of the Republic of Moldova;
e) issue of certificates of nationality of the Republic of Moldova;
f) execution of visas;
g) Ceased to be valid according to the Law of the Republic of Moldova of 27.12.2011 No. 276
h) consideration of the applications about permission to emigration of citizens of the Republic of Moldova and registration of the corresponding document package;
i) scrap registration;
j) issue of the marriage certficate;
k) registration of annulment of marriage;
l) re-registration of acts of civil status;
m) consideration of the applications about change of surname, and/or name, and/or middle name with issue of the appropriate certificate;
n) making of notarial actions;
o) registration and issue of documents of consular nature according to the legislation of the Republic of Moldova and/or the legislation of other states;
p) assignment of the state identification number of physical person (IDNP) to the foreigners who are outside the Republic of Moldova with use of electronic means and the integrated information systems.
The size of the consular fees is established according to appendices 1 and 2, being integral part of this law.
(1) Collection of the consular fee is performed previously, before making of consular actions.
(2) Consular services are not subject to taxation by the state fee or any other charges established by bodies of the central or local public authority.
(3) By provision of consular services by the Ministry of Foreign Affairs and European Integration collection of the consular fee is performed in lei. Payments are enlisted on bank accounts of the State Treasury.
(4) By provision of consular services by diplomatic representations, including permanent missions under the international organizations, and consular establishments of the Republic of Moldova the consular fee is levied in euro or in currency of the state of stay. The collection levied in currency of the state of stay (in case euro is not currency of the state of stay), is calculated at the beginning of every quarter on average rate of the last quarter in the state of stay in relation to euro established by Central Bank of the state of stay.
(5) Payment confirmation of the consular fee is performed by presentation of the bank receipt or the receipt on the payment issued by organization of diplomatic service and also in other procedure established according to the current legislation.
(1) In addition to payment of the consular fee the physical persons and legal entities using consular services refund the related expenses incurred by organizations of diplomatic service.
(2) Payment on account of the accompanying expenses does not belong to the consular fees and does not join in them.
