About approval of the Instruction about procedure for training, instructing and assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety

Based on paragraph two of subitem 128.1 of Item 128 of the Regulations on licensing of separate types of activity approved by the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450 "About licensing of separate types of activity" the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for training, instructing and assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety.

2. This resolution becomes effective after its official publication.

The instruction about procedure for training, instructing and assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety

Chapter 1. General provisions

1. This Instruction establishes procedure for carrying out training, instructing and assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety under the organization and implementation of activities in the field of use of atomic energy and sources of ionizing radiation (further - III).

2. For the purposes of this Instruction terms and determinations in the values established in the Law of the Republic of Belarus of January 5, 1998 "About radiation safety of the population" are used (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1998, No. 5, the Art. 25) and the Law of the Republic of Belarus of July 30, 2008 "About use of atomic energy" (The national register of legal acts of the Republic of Belarus, 2008, No. 187, 2/1523).

3. Action of this Instruction extends to workers (technical leads, specialists), including appointed the order on the organization responsible for control of ensuring radiation safety, responsible for radiation and (or) nuclear safety, and other specialists for whom work at this employer is principle place of employment, having the qualification conforming to requirements of the legislation regulating the licensed activities.

Chapter 2. Frequency and procedure for training

4. Persons specified in Item 3 of this Instruction shall be trained concerning ensuring nuclear and radiation safety (further - training) no later than one month from the date of position assignment and periodically according to requirements of regulatory legal acts, but at least once in five years.

5. Training is performed in the organizations of education (centers) having the permission to the right of carrying out professional training, retraining and advanced training of persons responsible for nuclear and radiation safety, and also persons responsible for radiation control to persons under surveillance issued by Department on nuclear and radiation safety of the Ministry of Emergency Situations of the Republic of Belarus (daleegosatomnadzor) to Gosatomnadzor objects and productions (further - organizations (centers).

6. Training is performed according to the curricula and programs approved by the head of organization (center) on the basis of the standard curricula and programs approved with Gosatomnadzor.

7. Training comes to the end with final assessment of knowledge.

Chapter 3. Procedure for briefing concerning ensuring nuclear and radiation safety

8. The employees of the organizations performing works with III shall undergo instructing in questions of ensuring nuclear and radiation safety (further - instructing).

9. Instructing is performed according to the procedure, established by the Instruction about the procedure for preparation (training), retraining, training, instructing, advanced training and examination working concerning the labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of November 28, 2008 No. 175 (The national register of legal acts of the Republic of Belarus, 2009, No. 53, 8/20209).

10. When briefing the questions concerning safe operation of subjects to use of atomic energy and III shall be taken up.

11. Person who was trained and assessment of knowledge of questions of ensuring nuclear and radiation safety to which these obligations are assigned instructs.

Chapter 4. Procedure for creation and work of the commissions on assessment of knowledge

12. Assessment of knowledge is performed by the commissions on assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety (further - the commissions) which are created in:

organizations (centers) - primary assessment of knowledge;

The Ministry of Emergency Situations of the Republic of Belarus (further - the Ministry of Emergency Situations) - periodic assessment of knowledge;

the organizations planning or performing activities in the field of use of atomic energy and (or) III (daleeorganization) - periodic assessment of knowledge.

13. The procedure for creation of the commissions of organizations (centers) is determined by local regulatory legal acts of these organizations.

14. The procedure for creation, activities and structure of the commission of the Ministry of Emergency Situations is determined by local regulatory legal acts of the Ministry of Emergency Situations.

15. The commission of the organization is created by the order of the head of the organization. The commissions of the organization are included the head or the deputy manager responsible for control of ensuring radiation safety, persons designated responsible for control of ensuring radiation safety, responsible for radiation and (or) nuclear safety and also heads of the structural divisions performing activities in the field of use of atomic energy and III.

The head or the deputy manager responsible for control of ensuring radiation safety (for subjects to use of III), or responsible for nuclear safety (for subjects to use of atomic energy) which performs the common directorship and bears the personal responsibility for results of activities of the commission is appointed the commission chairman of the organization.
